5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Case 2024-01 – KUSA (Van Vliet) vs Brunner – Appeal

“General Observations and Supplementary Commentary
The Members of the FAC would fail in their responsibilities towards the Kennel Union should they not bring to the attention of the Executive Committee their concerns relating to events which took place at the Baakens Valley Working and Herding & All Breeds Training School’s Non-championship Show held on 22 March 2024. These include:

The Judge on the day failing to adhere to Schedule 05B(02) App B Special Requirements in the FCI-IBGH 3 test with regard to the order in which exercises were to be carried out;

The Club failing to adhere to the Schedule 03 Regulation 37.1 which states (underline and bolding added for clarity): “The Show Committee shall report, in writing, to the Secretary any case of alleged fraudulent or discreditable conduct, and any default or omission at or in connection with a Show which is brought to its notice. Every such report shall be submitted to the Secretary within seven (7) days of the show and shall be accompanied by all documents and information in connection therewith which is in its possession of power.”;

The Trial not meeting the requirements under Schedule 05B(02) App B which state, under Trial Participants, that: “The examination (trial) must have a minimum of 4 participants per trial day. The minimum number of participants per day may only be less if for FCI-BH/VT or BH/VT (NPO) examinations these dogs pass and try for a further examination (FCI-IGP-1, FCI-IFH 1) at the same event.”;

The Non-championship Show held on 22 March 2024 not being compliant with the stipulation for trial days as provided for in Schedule 05B(02) App B under Trial Days; and

The validity of qualifications awarded on the day.
The intention is to enable the Executive Committee to consider taking appropriate pre-emptive steps, either by way of regulation, or training, to hopefully avoid the recurrence of such disruptive events in future.
At the request of the Fedco Appeals Committee, the KUSA Secretary appeals to the Executive Committee to decide on the actions to be taken so that these may be recorded in the Minutes for noting by the FAC and Fedco.
After discussion it was decided that CPA send a letter to the National IGP Sub-Committee (NIGPSC) bringing the concerns expressed by the FAC to their attention and urging them to take the necessary steps to improve IGP Judges’ knowledge of the FCI Regulations pertaining to the judging of Trials to avoid future incidents such as those which occurred at the Non-championship Show in question. Furthermore, Exco required input from the NIGPSC regarding the validity of the awards made on the day given that several Regulations were contravened by the Judge and Club.
The NIGPSC should also be urged to alert Clubs hosting Trials to the Regulations Schedule 03 Regulation 37.1, which requires any default or omission at or in connection with a Show to be reported to the KUSA Secretary within seven (7) days of the Show.

Carried forward from the previous meeting pending a response from the NIGPSC on the validity of the awards made on the day.
No further updates received. A reminder was sent to the NIGPSC on 15.01.2025.
CPA reported that a response had been received from Mr JQ Swartz that the relevant training is being provided. The validity of the awards was, however, still in question. After discussion, it was decided that the awards were to remain in place.
5.1.2 Case 2024-03 – KUSA vs Ingram
A DSC has been appointed, and the hearing has been scheduled for 23 January 2025.

A DSC has been appointed, and the hearing has been scheduled for 13 February 2025.

5.1.4 Case 2024-05 – KUSA (Austen & NFSKC) vs Pieterse, Van den Doel & Katts

5.2.1 Applications for Second Championship Show
5.2.1.1 Australian Shepherd Club of East Gauteng 19.07.2025
The above Club has made an application to hold a second Championship Breed Show, in conjunction with the Shows held over the “PetExpo” Weekend.

The above Club has made an application to hold a second Championship Dogsport Show, to add to the NAPC Bumper Weekend.

5.2.1.3 Highway Kennel Club 05.07.2025
The above Club has made an application to hold a second Championship Breed Show, to give KZN more opportunities for qualifications.

5.2.2 OTHER CLUB / SHOW MATTERS
5.2.2.1 Objection to shared show date – 10-11.04.2025
Baakens Valley Working & Herding Club have made an application to hold a second Dog Jumping & Agility Show on an existing Cluster weekend. One of the Clubs on those days, Madiba Bay Agility Club, has objected to sharing the date with 4 Clubs. Exhibitors have expressed concern about overworking their dogs and the strain on finances. Adding this show to the weekend is likely to result in exhibitors choosing which rounds to enter, thereby taking entries away from the Clubs with their traditional show dates over the weekend

GBR to refer matter to Eastern Cape & Border Provincial Council and provide feedback at the next Exco meeting.

On 13.01.2025, the Chairman of EC&BPC advised the KUSA Secretary as follows:
“After some thought and a discussion with the Exco Chairman, it has been decided that Exco will deal with this complaint.”
GBR reported that after liaising with Baakens Valley Working and Herding Club, they are willing to withdraw their application for the 2025 Cluster weekend.

5.2.2.2 Entry in Contravention of Schedule 03 Regulations
7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.
7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.
Decision – a R500 fine to be imposed for the submission of Official Show Entry Forms in contravention of the Regulations.
5.2.2.3 Show Returns not received
The following Clubs are in contravention of Schedules 03/04, 07 and 08 with regard to Show Returns, and all are accumulating Penalties for late submission of Show Returns.

NS to send a warning letter to the Chairman of the Free State Kennel Club, Mr J Taute, advising that Show Licences for 2025 will be withheld and applications to host second Championship Shows will not be considered until such time that all outstanding documentation and fees have been received.
5.2.2.4 Dog Jumping Inter-provincial Order of Judging – 11-12.04.2025
The National Dog Jumping Sub-Committee has approved a change to the order of judging for the PE Inter-provincial.
Schedule 05E(31) (Regulations for DJ Inter-provincials):
8. FORMAT
8.1 The event will consist of two (2) rounds for each dog and points will be awarded as laid down in Regulation 9. 8.2 The first round must be run under Table “A” and the second round must be run under Table “B”.
8.3 Dogs will be awarded points for their performance in each round as per the scoring system set out in Regulation 9.
8.4 The scores of the best three (3) dogs in each team will be calculated for each round.
8.5 The points gained for each round will then be added together to determine the overall winning team.
8.6 In the event that two (2) or more teams tie for any of the final placings, each team will nominate one Handler and dog to participate in a run-off. The run-off course will be at the discretion of the Judge. Should both these dogs be eliminated, each team will nominate a different dog for the run-off. This process will be repeated until a winner can be declared.
Due to time constraints on the days required, the Eastern Cape Sub-Committee is running Round 2 followed by Round 1 as per the attached Show Schedule and letter of explanation.
The National Dog Jumping Sub-Committee requests that this be sanctioned and approved by Exco.

5.2.2.5 Late Submission of Show Documents – Western Cape Staffordshire Bull Terrier Club – 01.03.2025
The Above Club is requesting that they be allowed to go ahead with their Show on 01 March 2025. Their documents were due on 01 September 2024, but were received on 16 January 2025.
Schedule 03:
2. Every application for a licence to hold a Championship Show shall be made not less than six (6) calendar months for Shows held from 1 January 2003 before the proposed date, on an official Kennel Union form, signed on behalf of the applicant Club by the Chairman, Treasurer and Secretary, who shall ,give their full addresses, setting out the information required therein, and such application shall be accompanied by the draft schedule of the Show, a letter of acceptance from each prospective Judge and the fee prescribed in terms of Schedule 07.
5.17 Where a Club, for any reason whatsoever, has been unable to finalise its Draft Schedule twelve (12) weeks before the first day of the Show, no licence shall be issued for that event. If a licence has already been paid for, Licence Fees will be refunded to the Club, subject to the deduction of Penalty Fees incurred up to twelve (12) weeks and, should the Penalty Fees be in excess of the Licence Fees, the Club shall be responsible for payment of the shortfall.
The 12-week cut-off for their Show to be cancelled was 07 December 2024.
They were also required to submit AGM documentation as well as Financials, and this has subsequently been received.
After discussion, there was doubt whether Exco had the authority to grant the request. BJ proposed that he should contact the Chairman of the Federal Council to request her to obtain permission from Fedco to grant the dispensation requested via a round robin resolution.

5.2.5 Schedule 03 Reg. 14 & Reg. 19.8 – Exclusion of Dogs
5.2.5.1 Temporary Exclusion Order – Retriever (Flat-coated) – Sheadoes Sweet Talker – Reg No. ZA011488B20
It was reported that the abovementioned dog had acted and behaved aggressively by attacking another Exhibit at the TKC Kennel Club Championship Show held on 13.10.2024. Both the Club and the Registered Owner have submitted documents relating to this incident. A preliminary TEO was issued on 18.10.2024.
The dog is to complete a socialisation course (TEO Manual 12.2.1.3), provide KUSA with a letter of proof from the Training Club (TEO Manual 12.2.1.3.2 and 12.2.1.3.3) and then complete a CGC Silver (TEO Manual 12.2.1.4).
The Owner has submitted the following documents in support of the TEO being lifted:

Unsigned letter from Club saying the dog had attended a training day and not shown any aggression

Unsigned letter from an observer at the training day and on the day the dog completed its CGC

After discussion it was decided that the dog must complete a 3-month dog training course and it was noted that the dog has been enrolled with the Dog Training Club of Bredell. Once a suitable socialisation course has been completed, a letter of clearance needed to be obtained from the relevant Club before the lifting of the TEO would be considered by Exco.
The owner of the dog has provided evidence of the dog having been enrolled in two training Clubs. Signed copies of the two letters provided had since been provided to the KUSA Office

5.1.1 Case 2024-01 – KUSA (Van Vliet) vs Brunner – Appeal

“General Observations and Supplementary Commentary
The Members of the FAC would fail in their responsibilities towards the Kennel Union should they not bring to the attention of the Executive Committee their concerns relating to events which took place at the Baakens Valley Working and Herding & All Breeds Training School’s Non-championship Show held on 22 March 2024. These include:
- The Judge on the day failing to adhere to Schedule 05B(02) App B Special Requirements in the FCI-IBGH 3 test with regard to the order in which exercises were to be carried out;
- The Club failing to adhere to the Schedule 03 Regulation 37.1 which states (underline and bolding added for clarity): “The Show Committee shall report, in writing, to the Secretary any case of alleged fraudulent or discreditable conduct, and any default or omission at or in connection with a Show which is brought to its notice. Every such report shall be submitted to the Secretary within seven (7) days of the show and shall be accompanied by all documents and information in connection therewith which is in its possession of power.”;
- The Trial not meeting the requirements under Schedule 05B(02) App B which state, under Trial Participants, that: “The examination (trial) must have a minimum of 4 participants per trial day. The minimum number of participants per day may only be less if for FCI-BH/VT or BH/VT (NPO) examinations these dogs pass and try for a further examination (FCI-IGP-1, FCI-IFH 1) at the same event.”;
- The Non-championship Show held on 22 March 2024 not being compliant with the stipulation for trial days as provided for in Schedule 05B(02) App B under Trial Days; and
- The validity of qualifications awarded on the day.
The intention is to enable the Executive Committee to consider taking appropriate pre-emptive steps, either by way of regulation, or training, to hopefully avoid the recurrence of such disruptive events in future.
At the request of the Fedco Appeals Committee, the KUSA Secretary appeals to the Executive Committee to decide on the actions to be taken so that these may be recorded in the Minutes for noting by the FAC and Fedco.
After discussion it was decided that CPA send a letter to the National IGP Sub-Committee (NIGPSC) bringing the concerns expressed by the FAC to their attention and urging them to take the necessary steps to improve IGP Judges’ knowledge of the FCI Regulations pertaining to the judging of Trials to avoid future incidents such as those which occurred at the Non-championship Show in question. Furthermore, Exco required input from the NIGPSC regarding the validity of the awards made on the day given that several Regulations were contravened by the Judge and Club.
The NIGPSC should also be urged to alert Clubs hosting Trials to the Regulations Schedule 03 Regulation 37.1, which requires any default or omission at or in connection with a Show to be reported to the KUSA Secretary within seven (7) days of the Show.

5.2.2 OTHER CLUB / SHOW MATTERS
5.2.2.1 Objection to shared show date – 10-11.04.2025
Baakens Valley Working & Herding Club have made an application to hold a second Dog Jumping & Agility Show on an existing Cluster weekend. One of the Clubs on those days, Madiba Bay Agility Club, has objected to sharing the date between 4 Clubs. Exhibitors have expressed concern about overworking their dogs and finances and adding this show to the weekend is likely to result in exhibitors choosing which rounds to enter, thereby taking entries away from the clubs whose traditional show dates are those of the weekend

GBR to refer matter to Eastern Cape & Border Provincial Council and provide feedback at the next Exco meeting.

5.2.2.2 Entry in Contravention of Schedule 03 Regulations
7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.
7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.
5.2.2.2.1A Junior Merit Application was received for Retriever (Labrador) Henme Return a Legacy to Kloofzight, ZA007600B23.The dog is registered in the name of the breeder.
All Awards Certificates reflect the dog’s owner as the registered owner. The owner has apologised for this error. She assumed that the dog had been transferred simultaneously at registration.
Decision – a R500 fine to be imposed for the submission of Official Show Entry Forms in contravention of the Regulations.

The Office has received a partial report regarding an incident of aggression that took place at the South Cape Non-championship Show IGP Trial on 02.11.2024. The Club has been granted an extension to submit the required documentation.
Preliminary TEO issued 13.11.2024.
The following documents have been received from the Club: a partially signed TEO Incident Report and a signed affidavit from the Judge. The Owner has submitted a statement of her version of events. (see attached).

5.2.5.2 Temporary Exclusion Order – Flat-coated Retriever – Sheadoes Sweet Talker – Reg No. ZA011488B20
It was reported that the abovementioned dog had acted and behaved aggressively by attacking another Exhibit at the TKC Kennel Club Championship Show held on 13.10.2024. Both the Club and the Registered Owner have submitted documents relating to this incident. A preliminary TEO was issued on 18.10.2024.
The dog is to complete a socialisation course (TEO Manual 12.2.1.3), provide KUSA with a letter of proof from the Training Club (TEO Manual 12.2.1.3.2 and 12.2.1.3.3) and then complete a CGC Silver (TEO Manual 12.2.1.4).
The Owner has submitted the following documents in support of the TEO being lifted:
- Unsigned letter from Club saying the dog had attended a training day and not shown any aggression
- Unsigned letter from an observer at the training day and on the day the dog completed its CGC
- Proof of CGC Silver
After discussion it was decided that the dog is to complete a 3-month dog training course and it was noted that the dog has been enrolled with the Dog Training Club of Bredell. Once a suitable socialisation course has been completed, a letter of clearance would need to be obtained from the relevant Club before the lifting of the TEO would be considered by Exco.
5.2.5.3 Temporary Exclusion Order – Australian Shepherd – Achante Get Your Groove On – Reg No. ZA007530B24
The Office has received a partial report regarding an incident of aggression that took place at the Jacaranda City Championship Show on 24.11.2024. The Club has been granted an extension to submit the required documentation.

5.2.6 Dispensation for additional Show Licences for the Agility League to be held in the Eastern Cape (East London)
The NAgSC has requested additional Show Licences be granted to the Provincial Agility Sub-Committees to include a total of 8 additional special Licences for Eastern Cape (Border), to be used in East London as per the motivation provided. This is in accordance with Schedule 05L (App F) Regulation 2.3 and 2.3.1 and Schedule 05L (App D) Regulation 3.1.3 and 3.1.4. (see attached).
Dispensation granted for Agility and Dog Jumping. As the need for additional licences was originally motivated for on a trial basis, the NAgSC to be encouraged to submit proposals for Regulation changes to negate the need for ongoing requests for dispensation as there appears to be a genuine need. Regulation changes to be submitted for inclusion on the Fedco 06-2025 Agenda.

10. GENERAL
10.1 MA advised on a pending TEO from the recent Western Cape Top Dog event.
10.2 MA reported that he and GR had discovered an omission in the Regulations with regard to Judges’ authority to withhold awards. A proposal for an amendment to the Regulations was in preparation for Exco to submit for the Fedco 06-2025 Agenda.
10.3 GBR enquired on whether there is an organogram on the reporting structures of KUSA. PM suggested that it might be advisable to host a Webinar featuring a question-and-answer session to clarify any misunderstandings regarding the reporting structures of KUSA.

5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Case 2024-01 – KUSA (Van Vliet) vs Brunner – Appeal
Ruling by the DSC:
Penalties:
1. In terms of Rule 11.1.2 of Schedule 01, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at any Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club for a period of six (6) months .
- In terms of Rule 11.5 of Schedule 01, the DSC ruled that the penalty be suspended in full for a period of three (3) years , on condition that, during the period of suspension, the Respondent does not contravene any of the provisions of Schedule 01 Rule 4, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint.
- The DSC ruled that the above penalty will take effect on 1July 2024.
The DSC’s Finding and Penalty imposition was appealed by Ms Brunner as permitted under Schedule 01 Rule 12.1, which appeal was heard by the Fedco-appointed Appeals Committee (FAC) on 5 September 2024.
Ruling of the FAC:
The FAC upheld the Finding of the DSC, but varied the Penalties imposed by the DSC as follows:
- The Penalty imposed by the DSC under Point 1. above remains unchanged , i.e. the Appellant (Ms Brunner) is excluded by the FAC from taking part in, or having any connection with, or attending or participating or handling a dog at any Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Clubfor a period of six (6) months.
- The period of full suspension of the Penalty imposed by the DSC as reflected under Point 2. above was reduced by the FAC to one (1) year, as sanctioned under Schedule 01 Rule 12.13.2, resulting in the following amended imposition:
In terms of Rule 11.5 of Schedule 01, the FAC ruled that the penalty be suspended in full for a period of one (1) year , on condition that, during the period of suspension, the Respondent does not contravene any of the provisions of Schedule 01 Rule 4, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint. - The effective date of 1 July 2024, set by the DSC, was confirmed by the FAC.
The above outcome is final and concludes Case 2024-01 – KUSA (Van Vliet) vs Brunner .
During the proceedings, the members of the FAC expressed certain concerns, which the Chairman of the FAC undertook to bring to the attention of the Executive Committee as obiter dicta, as set out below:
“ General Observations and Supplementary Commentary
The Members of the FAC would fail in their responsibilities towards the Kennel Union should they not bring to the attention of the Executive Committee their concerns relating to events which took place at the Baakens Valley Working and Herding & All Breeds Training School’s Non-championship Show held on 22 March 2024. These include:
a) The Judge on the day failing to adhere to Schedule 05B(02) App B Special Requirements in the FCI-IBGH 3 test with regard to the order in which exercises were to be carried out;
b) The Club failing to adhere to the Schedule 03 Regulation 37.1 which states (underline and bolding added for clarity): “ The Show Committee shall report, in writing, to the Secretary any case of alleged fraudulent or discreditable conduct, and any default or omission at or in connection with a Show which is brought to its notice. Every such report shall be submitted to the Secretary within seven (7) days of the show and shall be accompanied by all documents and information in connection therewith which is in its possession of power.”;
c) The Trial not meeting the requirements under Schedule 05B(02) App B which state, under Trial Participants, that: “The examination (trial) must have a minimum of 4 participants per trial day. The minimum number of participants per day may only be less if for FCI-BH/VT or BH/VT (NPO) examinations these dogs pass and try for a further examination (FCI-IGP-1, FCI-IFH 1) at the same event.”;
d) The Non-championship Show held on 22 March 2024 not being compliant with the stipulation for trial days as provided for in Schedule 05B(02) App B under Trial Days; and
e) The validity of qualifications awarded on the day.
The intention is to enable the Executive Committee to consider taking appropriate pre-emptive steps, either by way of regulation, or training, to hopefully avoid the recurrence of such disruptive events in future.
The Acting Secretary of KUSA is hereby requested to bring the abovementioned points to the attention of the Executive Committee. ”

5.2 SHOWS
5.2.1 Applications for Second Championship Show
5.2.1.1 Utility Breeds Club of Gauteng 22.06.2025
The above Club has made an application to hold a second Breed Championship Show on the day of their first Breed Show in order to increase entries. Motivation attached.

5.2.1.3 FRENCH BULLDOG CLUB OF THE WESTERN CAPE
An Exco round robin was issued on 11.09.2024 with the permission of the Chairman to consider the matter below:
Schedule 03:
2. Every application for a licence to hold a Championship Show shall be made not less than six (6) calendar months for Shows held from 1 January 2003 before the proposed date, on an official Kennel Union form, signed on behalf of the applicant Club by the Chairman, Treasurer and Secretary, who shall give their full addresses, setting out the information required therein, and such application shall be accompanied by the draft schedule of the Show, a letter of acceptance from each prospective Judge and the fee prescribed in terms of Schedule 07.
5.16.1 received by the KUSA Office later than six (6) months before the first day of the show, for any reason whatsoever, such Clubs shall pay Penalty Fees as specified for: 5.16.2 each week or part thereof the Draft Schedule is received late, and/or 5.16.3 each Judge who is not qualified to judge the Breeds/Groups/Events for which he has contracted himself.
5.17 Where a Club, for any reason whatsoever, has been unable to finalise its Draft Schedule twelve (12) weeks before the first day of the Show, no licence shall be issued for that event. If a licence has already been paid for, Licence Fees will be refunded to the Club, subject to the deduction of Penalty Fees incurred up to twelve (12) weeks and, should the Penalty Fees be in excess of the Licence Fees, the Club shall be responsible for payment of the shortfall.
The above Club was due to hold a Championship Show on Saturday, 14 September 2024.
The application date was 14 March 2024, and was submitted to the KUSA Office on 27 May 2024. (Penalties started accruing on 18 April).
The Judge was cleared and approved immediately by the Judges’ Administrator.
The Club was requested to submit its Show Schedule, and to capture the event on the Club Portal.
According to the Regulations, the event should have been cancelled 12 weeks prior to the Show (22 June).
The KUSA Office sent numerous reminders to the Club to which no response was received, which left the Office with no choice but to cancel the Show 12 days prior to the show date.
It came to the Shows Assistant’s notice that the Show was being advertised and an unapproved Show Schedule circulated, and she immediately wrote to the Club.
Finally, a response was received, and the Show Schedule was received on 11 September 2024.
The Executive Committee is requested to consider granting the Shows Department permission to complete formalities and issue the Licence, the alternative being that the Show status remains as “Cancelled”.
For consideration by the Executive Committee:
Schedule 03 Regulation 3.3
3.3 Notwithstanding, and in addition to the provisions of the Disciplinary Rules in Schedule 01, the Executive Committee shall have power to impose a fine upon any Club, the officers or members of which have, in the course of conducting a show, breached these Regulations.

The issuing of the licence was approved by all Exco members via e-mail and telephone, except CP who was out of the Country.

5.2.2 OTHER CLUB / SHOW MATTERS
5.2.2.1 Entry in contravention of the Regulations in Schedule 03
7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.
7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.
5.2.2.1.1 A Junior Merit Application was received for Spaniel (Cocker) Gelani Classic Panda to my Bear, ZA008316B23. The dog is in the dual ownership.
Both owners were declared on the Junior Merit application form submitted to the KUSA Office, however six of the nine Award Certificates submitted in support of the application only bore one owner’s name, the rest bore the name of both Registered Owners. The Award Certificates were hard copies and not electronic copies . The Office would like to know how to proceed.
Decision – a R500 fine to be imposed for the submission of Official Show Entry Forms in contravention of Schedule 03 Regulation 7.2.1. The KUSA Office may process the application once payment of the fine has been received.
5.2.2.1. 2Two Junior Merit Applications were received for Saint Bernards Von Gisero Amy ZA003218B23 and Von Gisero Lady ZA003215B23. The dogs are in the dual ownership.
All entries made into the relevant shows were in the name of one owner only. The owner explained that they had made an error on ShowAssist, and that it has since been corrected. E-mail attached.
The Office would like to know how to proceed.

5.2.2.1.37.4 No officer of the Show-holding Club shall complete any entry form, except his own nor shall he alter or amend any entry form after the entry has been made, nor shall he permit the alteration if or amendment of any entry form after the entry has been made save and except for the correction of bona fide errors by exhibitors in entries for the Baby Puppy, Minor Puppy, Puppy, Junior and Graduate Classes in respect of age determination where such errors are discovered by the officers of the Show-holding Club after acceptance of the entries.
The owner entered a dog under two different profiles on ShowAssist – Geliefderif Muhambi Sumarai was entered under ZA006744B2 and ZA006744B24. Awards were therefore issued to the two different profiles for the same dog.
The Office would like to know how to proceed

An invitation was sent to all Provincial Council Chairmen on 26.07.2024, calling for a representative to serve on the CGC Sub-Committee. The deadline for responses, or a request for extension, was 12.08.2024. The following nominations were received:

10. GENERAL
10.1 MA enquired on Regulations implemented by the KUSA office approved at the Fedco Special meeting which does not allow Clubs and Show organisers to change the order of Judging. Dispensation is currently not allowed. MA advised that he has put a proposal forward through the WCPC to revert to the previous standing and sought the opinion of the rest of the Exco members on whether they thought it feasible for the request for dispensation be adjudicated by Exco in advance. GR advised that a proposal has been put forward to the Fedco12-2024 Agenda for the pre-approval of the order of judging by Exco to be removed but, in the interim, the present Regulations stand.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES
3.1 Application for a once-off inter-variety mating of Dachshunds – Long-haired to Smooth-haired
The decision reached at Exco 06-2024 to permit the inter-variety mating of a Dachshund Smooth-haired female to a Dachshund Long-haired male, as applied for by Mr RB Jenkins (Waydack), although taken by Exco in terms of Schedule 2 Regulation 1.1.7, had failed to take into account the overarching Regulation 1.1, which stipulates:
1.1 The Kennel Union may also accept for registration, subject to such terms and conditions as the Federal Council may stipulate from time to time : ( emphasis added )
In consequence, at a Special Meeting convened for the purpose, Exco “decided to withdraw their approval for such a mating but, noted that the application could be resubmitted, provided it followed due process, namely that as the request required dispensation from Schedule 02 Regulation 1.1, it should be submitted to Fedco with all necessary supporting documentation.”
Following the publication of the Minutes of the Special Meeting, Mr Jenkins duly applied to the Federal Council for the required permission to proceed with the proposed inter-variety mating and the matter was tabled for discussion at the Fedco Discussion Forum (FDF) on Tuesday, 13 August 2024, where Mr Jenkins’s application and supporting documentation were considered, as well as the various submissions by members of the Dachshund community opposing the application. In the interest of transparency, and in an attempt to hopefully broker consensus on this issue, Fedco recommended that the members of the two Dachshund Clubs (SA Dachshund Club & Teckel Club of SA) should be invited to a consultation meeting with a Fedco-appointed Task team, comprised of Cllrs N Redtenbacher, NJ du Preez, L Thornhill and RD Juckes, acting as mediators. Cllr Redtenbacher undertook to arrange the envisaged consultation/mediation meeting, which duly took place on Wednesday, 21 August 2024.
At the subsequent FDF, held on Tuesday, 27 August 2024, Cllr Redtenbacher reported on the outcome of the consultation/mediation meeting, which Cllr RD Juckes was not to attend, and informed the Federal Council that the forum had, unfortunately, not been able to reach consensus on the issue. She alerted Fedco to a joint proposal submitted to the meeting by the two Dachshund Clubs, the merits of which were not discussed at the FDF. However, it was acknowledged that it was incumbent on Fedco to revert to Exco with a recommendation for the matter to be finalised and outcome to be communicated to the interested parties by way of the Minutes of an urgent Exco Special Meeting convened for the sole purpose of dealing with this matter exclusively.
Exco was thereafter duly informed of Fedco’s unanimous recommendation that:
The proposed once-off inter-variety mating contemplated by Mr RB Jenkins should be authorised by Exco, in accordance with Schedule 02 Regulation 1.1.7 – Cross-matings, and impose the following provisos should the mating go ahead and a litter be produced:
1. First-generation progeny from this proposed inter-variety mating should be registered reflecting the coat variety according to the dominant expression of the gene (in this case all progeny will be Smooth-haired).
2. The Second-generation progeny, are also to be registered as per expression of the dominant gene, which should be clear by the age of 8 (eight) weeks and any Second-generation puppies intended for breeding will be required to be DNA tested for coat inheritance prior to mating and may only be permitted to be mated to dogs of the same gene expression .
3. The progeny from the present inter-variety coat mating should only be registered once there is clarity on the coat-type. Should this only become clear after the expiration period of the KUSA-regulated registration period, reclassification according to coat variety may be permitted in accordance with Schedule 02 Regulation 1.1.8 – Reclassification of Recessives.
4. In this particular inter-variety mating, the coat-variety classifications, i.e. Long-haired (LH) and Smooth-haired (SH), will be added as bracketed suffixes to the registered names of the Dam and Sire and, subsequently, to the registered names of their progeny , which should make it clear on every “Certificate of Registration and Certified Pedigree” issued by KUSA, that the registered progeny had resulted from a past inter-variety mating and indicate which coat-varieties of the ancestors had produced the offspring.
In the interest of urgency, Fedco had requested Exco to convene the present Special Meeting in order to reach a decision based on Fedco’s recommendation and to reflect such decision in the Minutes of the Meeting to bring the desired finality to this matter.
Decision: Exco unanimously approved Fedco’s recommendations.
4. CLOSING
YJ thanked all for attending and closed meeting at 13h25. It was agreed that the decision would be disclosed to Mr RB Jenkins under strict confidentiality and noted that the Minutes of this Special Meeting needed to be adopted at the next meeting of the Executive Committee scheduled for 17.09.2024.

5. SUB-COMMITTEES
5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Case 01-2024 KUSA (Van Vliet) vs Brunner
Finding:
After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision, on a balance of probabilities, with regard to the Case 01-2024 before them:
1. The DSC found that the complaint was fully substantiated , and that, in humiliating and undermining the authority of the Mr van Vliet, the Respondent had wilfully engaged in conduct that was improper, disgraceful and disrespectful and prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith .
2.The DSC therefore found the Respondent guilty of contravening Schedule 01 Rules 4.1.1 and 4.1.1.4, and further of contraveningSchedule 04 Regulation 25, read with Schedule 03 Regulation 37.
3.The DSC further found the Respondent guilty of breachingRegulations 1.3, 1.4, 1.7, 5.1, 5.17 and 5.18 of Schedule 09 (Code of Ethics for Members of the Kennel Union of Southern Africa).
4.The DSC took note that Schedule 05B(02) Appendix B (International Utility Dogs Regulations (IGP)), under the section “Disciplinary Rights”, makes provision for an objection to be lodged against a Trial Judge’s method of assessment. It is stated under this section that in the section that: “Justifiable objections may be made in cases where the judge has violated the trial regulations but not against his assessments. Any such objections must be made in writing and addressed to the relevant authority and must be lodged with the show holding organization and signed by the complainant.” (emphasis added). It is further stated in the section that “Public criticism of a judge’s assessments may result in dismissal from the trial grounds and further disciplinary action may follow.”
Penalties:
In terms of Rule 11.1.2 of Schedule 01, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at any Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club for a period of six (6) months .
In terms of Rule 11.5 of Schedule 01, the DSC ruled that the penalty be suspended in full for a period of three (3) years , on condition that, during the period of suspension, the Respondent does not contravene any of the provisions of Schedule 01 Rule 4, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint.
The DSC ruled that the above penalty will take effect on the 1July 2024.
Ms Brunner subsequently lodged an Appeal and the Notice of Appeal was forwarded to the SCI to decide whether it had been been properly compiled (Schedule 01 Rule 12.3)
Note: Schedule 01 Rule 12.11 “An appeal may not operate as a stay of any penalty, order or condition imposed by the DSC.”
Having assessed the Appeal documentation submitted by the Appellant, the SCI found that it met requirements. In consequence, a Federal Council Appeals Committee (FAC) has to be appointed by the Federal Council Chairman to hear the Appeal.

5.2.2.1 Entry in contravention of the Regulations in Schedule 03
7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.
7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.
A Champion Application was received for Papillon Solposte Gemima of Achante ZA001598B23. The dog is in the dual ownership.
Both owners were declared on the Champion application form submitted to the KUSA Office, but all the Award Certificates submitted in support of the application only bore one owner’s name. The Award Certificates were hard copies and not electronic copies. The Office would like to know how to proceed.
Decision – a R500 fine to be imposed for the submission of Official Show Entry Forms in contravention of Schedule 03 Regulation 7.2.1. The KUSA Office may process the application once payment of the fine has been received.
5.2.3 KUSA Classic 2024

21-22 September – KUSA National Tracking Trial Event & KUSA Classic Championship Show.
5.2.4 KUSA Classic 2025 – Cape Town.
MA reported that arrangements were tracking well at the moment. The Judges had been contracted and fundraising events were in the planning to raise funds for any unexpected expenses that may arise.

5.2.5 KUSA Classic 2026 – Gauteng hosted by NAPC
CP reported that the 2026 Committee had started the processes of acquiring Judges for the event. A second look had been given to the budget which, in all likelihood, needs be increased by 15% due to rising costs. A revised budget will be presented in November 2024.

After discussion, it was agreed to appoint a Permanent Sub-Committee to deal with the training of CGC Evaluators. The Sub-Committee is to comprise a KUSA Staff Member and a representative from each Provincial Council. CPA was appointed as the KUSA Staff Member to serve on the Sub-Committee.
An invitation was sent to all Provincial Council Chairmen on 26.07.2024, calling for a representative to serve on the CGC Sub-Committee. The deadline for responses, or a request for extension, was 12.08.2024. The following nominations were received:

10. GENERAL
10.1 NS reported that the Shows department is being inundated with requests for Non-championship Show licences at short notice. Although the regulations state that Clubs are to apply three months in advance, this is not being adhered to as there is no penalty imposed as per the recent Fedco ruling. Clubs are applying at short notice without consequences, which is placing strain on the Shows Department that has to prioritise these Shows ahead of others that have applied well in advance. A report is being compiled for Non-championship Shows applied for during this year, detailing the date the Show was held and when it was applied for, to be presented to Fedco as a motivation for the reinstatement of penalties.
10.2 GR reported on an email received from EC & Border TT and WT Sub-Committee advising that there was a conflict with the 21-22.09.2024 KUSA National Tracking Trial Event & KUSA Classic Championship Show being held on the same dates as the KUSA Agility Championship Show. MA suggested mediation between the two organising Committees. After discussion, it was agreed that the Exco and Fedco representatives for the Eastern Cape are to mediate between the two parties.
NS to send an e-mail to all parties to secure their agreement.
10.3 GR reported on an undeclared Dual Sire Mating of Bull Terriers. GR requested permission for a Round Robin to be circulated on behalf of the Chairman of Exco, providing the necessary information and motivation for Exco to consider in order to approve the amendment of the KUSA Primary Register to reflect a different Sire for one of the two offspring (the registration of the sibling to remain suspended on the Register, pending DNA Parentage Verification). Permission was granted for a Round Robin to be circulated to the members of Exco by the KUSA Secretary on behalf of the Chairman of Exco.

5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Case 01-2024 KUSA (Van Vliet) vs Brunner
Finding:
After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision, on a balance of probabilities, with regard to the Case 01-2024 before them:
1. The DSC found that the complaint was fully substantiated , and that, in humiliating and undermining the authority of the Mr van Vliet, the Respondent had wilfully engaged in conduct that was improper, disgraceful and disrespectful and prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith .
2.The DSC therefore found the Respondent guilty of contravening Schedule 01 Rules 4.1.1 and 4.1.1.4, and further of contraveningSchedule 04 Regulation 25, read with Schedule 03 Regulation 37.
3.The DSC further found the Respondent guilty of breachingRegulations 1.3, 1.4, 1.7, 5.1, 5.17 and 5.18 of Schedule 09 (Code of Ethics for Members of the Kennel Union of Southern Africa).
4. The DSC took note that Schedule 05B(02) Appendix B (International Utility Dogs Regulations (IGP)), under the section “Disciplinary Rights”, makes provision for an objection to be lodged against a Trial Judge’s method of assessment. It is stated under this section that in the section that: “Justifiable objections may be made in cases where the judge has violated the trial regulations but not against his assessments. Any such objections must be made in writing and addressed to the relevant authority and must be lodged with the show holding organization and signed by the complainant.” (emphasis added). It is further stated in the section that “Public criticism of a judge’s assessments may result in dismissal from the trial grounds and further disciplinary action may follow. ”
Penalties:
In terms of Rule 11.1.2 of Schedule 01, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at any Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club for a period of six (6) months .
In terms of Rule 11.5 of Schedule 01, the DSC ruled that the penalty be suspended in full for a period of three (3) years , on condition that, during the period of suspension, the Respondent does not contravene any of the provisions of Schedule 01 Rule 4, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint.
The DSC ruled that the above penalty will take effect on the 1July 2024.
Ms Brunner has lodged an Appeal. Notice of Appeal to be forwarded to the SCI to decide whether the Notice of Appeal has been properly compiled (Schedule 01 Rule 12.3)
Note: Schedule 01 Rule 12.11 “An appeal may not operate as a stay of any penalty, order or condition imposed by the DSC.”

5.1.2 Case 02-2024 Venter vs Hall
After careful consideration of the evidence submitted by both the Complainant and the Defendant, the Sub-Committee of Inquiry (SCI) found that there were opposing and conflicting versions of what had occurred at the event in question and that the Defendant had presented an obviously acceptable explanation and corroborating sworn declarations in his defence, meeting the requirements of Schedule 01 Rule 8.2.5. This led the SCI to agree, unanimously, that there were insufficient evidence and grounds to proceed to a Disciplinary Hearing and obliged them to rule that the Complaint be dismissed under Schedule 1 Rule 8.4.1 and not be progressed further.
Case dismissed by SCI.

5.2.1.1 Free State Terrier Club 02.11.2024
The above Club is applying to hold their usual second show as part of a Terrier Cluster in the Free State, along with the Frankfort show weekend.

5.2.1.2 Cape Field Trials Club 14-16.09.2024
The above Club is applying to hold their usual second Field Trial as part of their double weekend of Trials. The second Licence is usually held by Kennel Association, but due to KA’s decision to no longer hold Dogsport events, the Cape Field Trial Club is applying for this Licence in order to offer the same Trials to exhibitors.

5.2.2 Application for FCI CACIT Event
5.2.2.1 K9 Sport Specialist GSD Club of Gauteng – 23-24.08.2025
The above Club would like to hold a CACIT event (International Utility Dog IGP event), the first in South Africa. Application procedures have been explained to the Club, and the Fedco Portfolio-holders for FCI and IGP have been informed. The KUSA Office is required, on behalf of the Club, to submit an application to host the event to the FCI by May 2025.

7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.
7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.
A Grand Champion Application was received for Dobermann Donnehaus Dollar Time ZA011404B21. The dog is in dual ownership.
On the application form submitted to the KUSA Office, only one of the Registered Owner’s names was declared as well as on all Award Certificates submitted in support of the application. The Office would like to know how to proceed.
Decision – a R500 fine to be imposed for the submission of Official Show Entry Forms in contravention of Schedule 03 Regulation 7.2.1. The KUSA Office may process the application once payment of the fine has been received.

5.22.1 CANINE GOOD CITIZEN Sub-Committee
A suggestion has been made for KUSA to consider adopting a CGC Platinum test, with initial thoughts being a dog achieving three CGC Gold certifications, but each in a different location, e.g. one at a training Club, one at a showground environment and one at a public space such as an expo. While there are merits to this suggestion, there is a more pressing need to design and run a training course for Evaluators.

The Sub-Committee is to comprise a KUSA Staff Member and a representative from each Provincial Council. CPA was appointed as the KUSA Staff Member to serve on the Sub-Committee. Exco to request that Fedco pass a Resolution to empower the Sub-Committee to host training events and courses in the interim period during which Schedule 11 Regulations are put in place to govern the training of CGC Evaluators. The Sub-Committee must provide progress reports to Exco on a regular basis.

5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Untamed Animal Health complaint
The KUSA Office was first contacted by Untamed Animal Health on 26.10.2023 alert KUSA to an alleged breach of its an agreement with Miss Christine Kneidinger, acting on behalf of Rotek GSD Club of Northern Areas (Rotek GSD). Since this matter has not been resolved, is hereby brought to the attention of Exco at the request of the Exco Chairman. His motivation is for Exco to consider whether or not the Acting KUSA Secretary should be requested to institute disciplinary proceedings against Miss Kneidinger and/or Rotek GSD in terms of Schedule 01.
After discussion, it was decided that CPA was to liaise with GR, BJ and PM regarding the steps to follow.
A letter to be drafted by Exco and sent to Miss Kneidinger advising that Licences would be withheld should the matter not be resolved.
Letter received from Rotek GSD Club of Northern Areas (see attached) and a follow up letter received from Untamed Animal Health (see attached).
After discussion it was PM suggested that BJ consults with KUSA’s Legal Adviser requesting guidance on the matter.

5.1.2 Case 2024-01 – KUSA (Van Vliet) vs Brunner
The above Disciplinary Case was heard by the Exco-appointed Disciplinary Sub-Committee on Wednesday, 12 June 2024, and the Minutes of the Hearing, containing the Finding and the Penalty, were circulated to the members of Exco in advance of the meeting to enable Exco to confirm the record of proceedings as required under Schedule 01 Regulation 10.14, read with Regulation 10.16.
The record of proceedings of Case 2024-01 were confirmed, unanimously, subject to a change of the date on which the Penalty will take effect to 1 July 2024, such powers of correction derived by Exco from Schedule 01 Rule 10.16.

Under cover of an email dated 9 June 2024, a letter of objection was received from the joint Committee of Liesbeek Kennel Club and Kennel Association to the show date changes approved by the KUSA Shows Department for Outeniqua Kennel Club and George Kennel Club in 2025. The authorisation permits Outeniqua and George Kennel Clubs to move their shows from Week 24 to Week 10 in 2025, joining Whale Coast and Overberg Kennel Clubs for a joint weekend of shows in Kleinmond. The reasons for the objection are fully set out in the letter.
Change of date and venue is approved for 2025 only. Shows must return to Oudtshoorn from 2026 onwards to be held on their traditional dates.

CGC continues to run well with a total of 472 successful results having been received to date for 2023. Clubs are encouraged to submit all outstanding results.
A suggestion has been made for KUSA to consider adopting a CGC Platinum test, with initial thoughts being a dog achieving three CGC Gold certifications, but each in a different location, e.g. one at a training Club, one at a showground environment and one at a public space such as an expo. While there are merits to this suggestion, there is a more pressing need to design and run a training course for Evaluators.

The Sub-Committee is to comprise a KUSA Staff Member and a representative from each Provincial Council. CPA was appointed as the KUSA Staff Member to serve on the Sub-Committee. Exco to request that Fedco pass a Resolution to empower the Sub-Committee to host training events and courses in the interim period whilst Schedule 11 Regulations are put in place to govern the training of CGC Evaluators. The Sub-Committee must provide progress reports to Exco on a regular basis.

10.1 MH reported on matters raised at the KUSA Nationals pertaining to Agility Trophies that were not updated/incorrectly labelled or missing with no clear indication on where the trophy should be awarded.
Unhappiness was also expressed that there were too many major Cluster Championship Shows being held too close together. It was requested that the Show Calendar be looked at and that the major Championship shows be spread out. PM requested that the complaints received be put in writing and submitted to the KUSA Office to be dealt with via the correct channels.

2. MINUTES
Following closer scrutiny, it was proposed by YJ that amendments be made to the Minutes of the Exco 05-2024 meeting held on 18.05.2024.
Item 9.8 Inter-Variety Breeding
Add the following:
BJ handed the Chair to the YJ (Vice-Chair). BJ remained available to answer questions raised during the discussion.
GR enquired whether counsel had been sought from the Dachshund Breed Council of the Royal Kennel Club, since KUSA had adopted the UK standard for the Dachshund. BJ advised that he had consulted with the Royal Kennel Club’s Dachshund Breed Council, but the feedback received was that inter-variety matings were not permissible in the UK.GR asked why the Dachshund Clubs would then not rather adopt the FCI standard for the Dachshund which allows certain varieties to be crossed, to which BJ replied that the Clubs do not want the FCI standard. GR said he thought it rather strange that the Dachshund fraternity should elect to have the UK Breed Standard, yet consider themselves at liberty to vary the UK’s breeding rules.
MA suggested that the mating be approved as a once off. After discussion the request was approved by the five (5) members of Exco (excluding BJ).
The proposed amendments to the minutes were approved unanimously.
3. ANY MATTERS ARISING FROM PREVIOUS MINUTES
3.1 Inter-Variety Breeding
Mr RB Jenkins (Kennel Name – Waydack) requests permission for the mating of a Dachshund (Smooth-haired) to a Dachshund (Long-haired).

Attached please also find the FCI list of permissible inter-variety crossings and the list of KUSA permissible inter-variety matings.
Following receipt of a letter from Jenny Hubbard (Fedco Chairman), seeking clarity from Exco with regards to the decision made by Exco to grant approval of the cross-mating, it was deemed necessary to call a meeting in order to respond to the letter.
Discussion ensued regarding the process that needed to be followed prior to submitting requests for such matings. The following Regulations were noted (emphasis added for clarity):
Schedule 02 Regulations 1.1 states:
1.1 The Kennel Union may also accept for registration, subject to such terms and conditions as the Federal Council may stipulate from time to time :
1.1.7 Cross-matings
Notwithstanding the provisions of Regulation 1.1.6 hereof the Executive Committee shall be empowered to establish provisos in order to permit matings of different categories of the same breeds where such cross mating is recommended by a Breed Council, where such exists or is considered desirable in the interests of improving a breed where similar arrangements have been permitted by the club in the country of origin or development of such breeds .
1.1.8 Reclassification of Recessives
Notwithstanding the provisions of Regulation 1.1.7 hereof the Executive Committee shall be empowered to instruct the Secretary to reclassify a recessive in the category of the breed of the parent which it most closely resembles, once only, on application from the owner accompanied by the fee prescribed in terms of Schedule 7.
Further, it was noted that the Federal Council’s policy is that it “will never unilaterally amend or alter a Breed Standard originating from a National Canine Organisation deemed to be the breed’s country of origin or country of development”.
It was also noted that whilst The Royal Kennel Club, whose Breed Standard has been adopted by KUSA, did not allow inter-variety matings for Dachshund, despite some inter-variety matings having apparently been approved in the past, the FCI did allow inter-variety matings to take place and it is likely that a number of dogs imported to the country are the result of such matings.
The request for dispensation was submitted to the KUSA Office and the item placed on the Exco agenda by the office as per other cross-mating requests received previously. Exco had thus taken the decision under the assumption that the correct procedure had been followed and that they were empowered to make such a decision.
Following extensive discussion on the process followed and merits of such a request, Exco decided to withdraw their approval for such a mating but noted that the application could be resubmitted providing it followed due process, namely that as the request required dispensation from Schedule 02 Regulation 1.1, it should be submitted to Fedco with all necessary supporting documentation.
Permission was granted to PM to immediately inform Mr B Jenkins and Mrs J Hubbard of Exco’s unanimous and collective decision.

5.1.1 Untamed Animal Health complaint
The KUSA Office was first contacted by Untamed Animal Health on 26.10.2023 alert KUSA to an alleged breach of its an agreement with Miss Christine Kneidinger, acting on behalf of Rotek GSD Club of Northern Areas (Rotek GSD). Since this matter has not been resolved, is hereby brought to the attention of Exco at the request of the Exco Chairman. His motivation is for Exco to consider whether or not the Acting KUSA Secretary should be requested to institute disciplinary proceedings against Miss Kneidinger and/or Rotek GSD in terms of Schedule 01.
After discussion, it was decided that CPA was to liaise with GR, BJ and PM regarding the steps to follow.
A letter to be drafted by Exco and sent to Miss Kneidinger advising that Licences would be withheld should the matter not be resolved.

5.2.3.1 Entry in contravention of the Regulations in Schedule 03:
7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.
7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.
The KUSA Office received an application for Champion title for a Beagle . The dog is registered in joint ownership, but was entered in two of the shows in the name of one owner only, where the relevant Challenge Certificates were won.
The owners apologised for the error and advised that a problem was experienced with the ShowAssist online entry platform, which they will have corrected.
It was decided that a R500 fine be imposed for the administrative error s on the Official Show Entry Form.

The Office received notice of an alleged incident of aggression that occurred at Hottentots Holland Kennel Club Non-championship Show on 04.06.2023, where the dog bit the Judge. The Club has submitted a copy of the Incident Report Form (Annex A) and a statement from the Judge (incorrect format) and Ring Steward (correct format). The Judge’s statement has since been submitted in the correct format (see attached). A statement has been received from the Owner (see attached).

CGC continues to run well with a total of 472 successful results having been received to date for 2023. Clubs are encouraged to submit all outstanding results.
A suggestion has been made for KUSA to consider adopting a CGC Platinum test, with initial thoughts being a dog achieving three CGC Gold certifications, but each in a different location, e.g. one at a training Club, one at a showground environment and one at a public space such as an expo. While there are merits to this suggestion, there is a more pressing need to design and run a training course for Evaluators.

The Sub-Committee is to comprise a KUSA Staff Member and a representative from each Provincial Council. CPA was appointed as the KUSA Staff Member to serve on the Sub-Committee. Exco to request that Fedco pass a Resolution to empower the Sub-Committee to host training events and courses in the interim period whilst Schedule 11 Regulations are put in place to govern the training of CGC Evaluators. The Sub-Committee must provide progress reports to Exco on a regular basis.

GR enquired whether counsel had been sought from the Dachshund Breed Council of the Royal Kennel Club, since KUSA had adopted the UK standard for the Dachshund. BJ advised that he had consulted with the Royal Kennel Club’s Dachshund Breed Council, but the feedback received was that inter-variety matings were not permissible in the UK.GR asked why the Dachshund Clubs would then not rather adopt the FCI standard for the Dachshund which allows certain varieties to be crossed, to which BJ replied that the Clubs do not want the FCI standard. GR said he thought it rather strange that the Dachshund fraternity should elect to have the UK Breed Standard, yet consider themselves at liberty to vary the UK’s breeding rules.
MA suggested that the mating be approved as a once off. After some discussion the request was approved.

5.1.1 Untamed Animal Health complaint
The KUSA Office was first contacted by Untamed Animal Health on 26.10.2023 alert KUSA to an alleged breach of its an agreement with Miss Christine Kneidinger, acting on behalf of Rotek GSD Club of Northern Areas (Rotek GSD). Since this matter has not been resolved, is hereby brought to the attention of Exco at the request of the Exco Chairman. His motivation is for Exco to consider whether or not the Acting KUSA Secretary should be requested to institute disciplinary proceedings against Miss Kneidinger and/or Rotek GSD in terms of Schedule 01.
After discussion, it was decided that CPA was to liaise with GR, BJ and PM regarding the steps to follow.
A letter to be drafted by Exco and sent to Miss Kneidinger advising that Licences would be withheld should the matter not be resolved.

The KUSA Office received an application for Champion title for Australian Shepherd ALLMARK THE SEQUEL (ZA001136C23). The dog is registered in joint ownership and was entered as if in sole ownership at all 4 shows where the relevant Challenge Certificates were won.
The member is appealing for leniency. As a newcomer to South Africa, she had been reliant on others to assist with paperwork which she found confusing and did not realise she was entering the dog incorrectly. She apologised for the inaccuracy of the entries.

5.2.3.2 Entry in contravention of the Regulations in Schedule 03:
The KUSA Office received an application for Champion title for Bearded Collie ASHVALE ETON MESS (ZA011810B20). The dog was entered in 3 of the shows at which she won CCs in the ownership of another member.
The Breeder is appealing for leniency as the dog was sold but never transferred. The new owner, a Dogsport exhibitor not familiar with Breed Show Regulations, had inadvertently entered the dog in her own name at the 3 breed shows.
R500 fine to be imposed for the administrative errors on the Official Show Entry Form. The dog must either be transferred in to the ownership of the new owner or be entered in the ownership of the Breeder going forward should transfer of ownership not be desired.

9.1. Declaration of Interests in terms of Article 12.5
12.5 Any member nominated to sit on the Federal Council, Executive Committee of the Kennel Union as well as the Executive members (Chairman, Vice-Chairman, Secretary, Treasurer) of any Provincial Council of the Kennel Union, shall declare within one (1) month of appointment to the Secretary in writing all their interests, of whatsoever nature, in dog related activities. Where the governing body of the Kennel Union, or such person or persons to whom the authority is delegated, determine that any interests are in conflict with those of the Kennel Union, such nominated members’ appointment shall ipso facto be terminated.
As part of the Declaration, it is required that all Affiliated Clubs, Breed Councils, Liaison Councils or Sub-Committees on which they currently serve and the offices they hold on those Clubs are declared.
The Chairmen of Provincial Councils are requested to ensure that Declarations of Interests are secured from the various Executive Members of the respective Provincial Councils and forwarded to the KUSA Secretary.

Schedule 03 Regulation 31 states:
Objections to Dogs & Disqualifications.
31.3 The grounds of objection made to a dog and immediate disqualification of such dog in terms of this
Regulation shall be any one or more of the following:
31.3.14 that it has been entered and/or exhibited at a Show when it is registered or recorded as owned by an officiating Judge within a period of four (4) months prior to the Show, when said officiating Judge is scheduled to judge any Class or Competition to which the dog may gain admission through its entry, except in the case of a dog owned by the officiating Judge appointed in an emergency, in which case the disqualification of the dog will be automatic without any liability incurred by the emergency appointed Judge.
Minutes of Exco 11-2023 state:
Dogs were exhibited at a Show when in the registered ownership of an officiating Judge thus as per the aforementioned Regulation, the dogs are automatically disqualified, and awards won on the day withdrawn.
The KUSA Office received a letter from the Chairman of the Club requesting that Exco review the decision taken at the Exco 11-2023 meeting.

Note: Regrettably, the applicable Regulations Schedule 03 Regulation 7.10.1; 7.10.2 and 7.15 were
inadvertently omitted from the previous meeting’s agenda and minute, giving the incorrect impression that the sanction applied was applied in accordance with Schedule 03 Regulations 31 instead of Schedule 03 Regulation 7. Entry for Exhibition which states:
7.10.1 A Judge may not enter a dog registered in his ownership in the same discipline on the same day at the same venue as he is officiating, save and except for Working Disciplines held under the licence of a different Club. Automatic disqualification of the dog(s) will apply and the Judge will be liable for disciplinary action under Schedule 1.
7.10.2 A Judge may not handle a dog in any discipline, save and except for Working Disciplines held under the licence of a different Club on the same day at the same venue, as he/she is officiating. Automatic disqualification of the dog(s) will apply and the Judge will be liable for disciplinary action under Schedule 1
7 .15 Any dog which has been exhibited contrary to these Regulations shall be liable to disqualification and cancellation of any awards gained, whether or not an objection has been lodged under Regulation 31.
The matter was reviewed under the appropriate Regulations governing such incidents i.e. Schedule 03 Regulation 7.10.1, in which it is unambiguously stated and constitutionally prescribed that automatic disqualification shall apply,
Letter received from Mr Ken Hull requesting that the decision reached at Exco 12-2023 on the above matter be reviewed.
After discussion it was decided that the Regulations in question be referred to Fedco for interpretation and the matter be accordingly adjudicated by Fedco.
At its Special Meeting on 15.02.2024, having analysed and interpreted the Schedule 03 Regulations 7.10.1 & 7.10.2, as comprehensively explained and motivated in the Minutes of the Special Meeting, the Federal Council upheld Exco’s finding. The Acting Secretary of KUSA has advised Breede Rivier Vallei Kennel Club of the outcome .

5.1.1 Untamed Animal Health complaint
The KUSA Office was first contacted by Untamed Animal Health on 26.10.2023 to alert KUSA to an alleged breach of an agreement entered with Miss Christine Kneidinger, acting on behalf of Rotek GSD Club of Northern Areas (Rotek GSD). Since this matter has not been resolved, it is hereby brought to the attention of Exco at the request of the Exco Chairman. Exco to consider whether, or not, the Acting KUSA Secretary should be requested to institute disciplinary proceedings against Miss Kneidinger and/or Rotek GSD in terms of Schedule 01.
After discussion, it was decided that CPA was to liaise with GR, BJ and PM regarding possible action to be taken.

5.2.3.1 Kennel Association Championship Show – 02.03.2024
The Secretary of the above Club reported an irregularity subsequent to the Bull Terrier judging at the Show. The Bitch awarded Best Junior in Breed, Avonjul Image Maker, allegedly failed to enter the ring to challenge for Best Junior in Group in contravention of Schedule 03 Regulation 18.1:
Once a dog has entered the ring to be exhibited in one of the Classes for which he had been entered in advance of the Show, the dog shall be exhibited in all subsequent Classes entered and in all the Challenges and Competitions as contemplated by Regulations 21, 22 and 24 for which it has qualified at that Show. Failure to enter the ring when required to compete in subsequent Classes or Challenges and Competitions as described above shall, at the discretion of the Executive Committee, render the dog liable for disqualification and the cancellation of any awards gained, irrespective of any objection having been lodged in terms of Regulation 31.
Having received a complaint from an exhibitor, the Club Secretary established from the Show Manager that no permission had been granted for the withdrawal of the bitch from further competition as required under Schedule 03 Regulation 18.6:
If a dog’s withdrawal from further competition is forced by an emergency, domestic or otherwise, formal permission shall be granted at the sole discretion of the Show Manager, once he is satisfied that sufficient cause has been shown why the dog should be withdrawn from further competition, after which the dog shall be marked as WITHDRAWN on the Judges’ and Ring Steward’s Sheets for the Class, Challenge or Competition from which the dog has been withdrawn.
Upon further investigation, it was confirmed that the Judge’s Sheet had not been endorsed “WITHDRAWN” as required under the above Regulation, but simply marked “A” for “ABSENT”, which appears to corroborate the Show Manager’s statement that permission had not been granted for the bitch to be withdrawn from further competition.
Subsequent to having alerted the Executive Committee to the transgression, the Club Secretary was requested by the Acting KUSA Secretary to inform the exhibitor that, since the alleged breach of a KUSA Regulation had been brought to her attention, she had no choice but to refer the matter to the Executive Committee for investigation and a ruling. She was also requested by the Acting KUSA Secretary to invite the exhibitor to submit a statement to explain his conduct, which would then be forwarded to the Executive Committee for consideration.
After discussion it was decided, with an objection from MA, that the CC award is to be withdrawn and awarded to the RC winner.

5.2.5 Dispensation for additional Show Licences for the Dog Jumping League to be held in Border (East London)
Members of Exco were asked to participate in a round robin on 22.02.2024. In December 2023, Exco considered a dispensation request put forward by the National Agility Sub-Committee who requested the extension of the trial special Licences granted to the Provincial Agility Sub-Committees to include a total of 8 additional special Licences for Eastern Cape (Border), to be used in East London as per the motivation provided.
The National Dog Jumping Sub-Committee (NDJSC) made a similar request on behalf of the Dog Jumping fraternity in East London (see attached).
All members of Exco agreed to:
1. Grant the East London Dog Jumping fraternity the right to hold the necessary rounds for the National Dog Jumping League.
2. Grant the East London Dog Jumping fraternity an additional six (6) show licences at no cost in order to run the rounds (as per Schedule 05E(16), Regulation 2.3).

5.2.6.1 Temporary Exclusion Order – German Shepherd Dog – Atari Dark Venoom of von Wohlstein – Reg No. ZA001091C22
It was reported that the above-mentioned dog had acted aggressively at the Rotek GSD Club of Northern Areas (Meisterschaft) held on 3-6.08.2023, where it reportedly attacked another dog (see attached and refer Item 5.2.6.5). The TEO was confirmed at Exco 09-23.

5.4.3 Dispensation for Mrs R Cook to judge Agility in Namibia
Members of Exco were asked to participate in a round robin on 05.03.2024. Mrs Cook had been invited to judge Agility, Obedience, Rally Dog and Canine Good Citizen in Namibia over the weekend of 8-10 March 2024. As one of the very few Judges who can judge multi-disciplines, it made financial sense for the Namibians to invite Mrs Cook to ensure ‘value-for-money’ on the flight costs incurred.
However, the Agility rules state in Schedule 05L, Regulation 7.3.1:
A Judge is required to attend an Agility Refresher Course at least once every two (2) years to maintain his judging status.
Although Mrs Cook was included in the invitation for the refresher course held late 2023, the mail was sent to an obsolete email address and Mrs Cook was unaware of the refresher course. Mrs Cook’s 2-year period for her refresher expired in February 2024 with the next refresher course only being scheduled for 14-15.03.2024.
The NAgSC requested dispensation for Mrs Cook to judge in Namibia over the weekend of 8-10.03.2024 on the proviso that:
- Mrs Cook must confirm that she has read the latest Schedule 05L and FCI Guidelines as supplied by Mr R Hall - confirmed.
- Mrs Cook must work with a senior Agility Judge with respect to approving her courses. Mr Hall has confirmed that this has been done .
- Mrs Cook must attend the refresher on 14-15.03 2024.
- Mrs Cook will need to do a supervised agility show upon her return from Namibia. This will likely take place towards the 2nd half of 2024 in Gauteng.
All members of Exco agreed to grant Mrs Cook the necessary dispensation but requested that Mr Hall confirm to Exco that the refresher course had indeed been attended.

5.4.4 Dispensation for Mr K Young to judge within the 3-month judging restriction.
Mr. Kevin Young contacted the KUSA office requesting dispensation to judge within the 3-month judging restriction. He is judging Bulldog Speciality in Johannesburg and wishes for dispensation to be given to him to judge Bulldogs at the Amatola Cluster Weekend Shows. It is 8 days short of the 3-month restriction. The KUSA office has informed Mr Young that there was no reason for this to be granted, he is able to judge all other breeds except Bulldogs. He then stated that he would write a letter of motivation and wants it to be added to the Exco Agenda. To date a letter of motivation has not been received from Mr Young. However, an email was received from Tanya Schultz of Amatola Cluster Clubs requesting dispensation for Mr Young to judge Bulldogs at their Show.

A suggestion has been made for KUSA to consider adopting a CGC Platinum test with initial thoughts being a dog achieving three CGC Gold certifications but each in a different location, e.g. one at a training Club, one at a showground environment and one at a public space such as an expo. While there are merits to this suggestion, there is a more pressing need to design and run a training course for Evaluators.

9.1. Criminal conviction – Cruelty to Animals and Tail-docking
According to the Minutes of the Rottweiler Breed Council held on 02.12.2023, the “1st criminal convictions of breeders for docking tails” have been handed down in the Springs Magistrate Court of the Ekurhuleni Magisterial District. Upon investigation by the Acting KUSA Secretary and the KUSA Legal Adviser, it was found that, on 23.11.2023, one Angelique Terblanche and one Angela Marx had been found guilty of contravening sections 2(1)(a) or 2(1)(b) or 2(1)q) of the Animals Protection Act 71 of 1962 and section 23(1) of the Veterinary and Para Veterinary Professions Act 19 of 1982. Copies of the respective sentences are attached.
As far as can be ascertained, neither of these two persons are KUSA members. In accordance with Article 10.3, which states “The Executive Committee may refuse to elect any applicant and refund any Entrance Fee and Subscription Fee tendered if, by majority vote, good cause can be shown for the rejection of such application. Any application received from any person who has been expelled from, or who has been suspended or disqualified from holding Membership of any Club, Association, Canine Breeders’ Society, Registering Authority or body concerned with animals, or who has been convicted in a Court of Law for an offence described in Schedule 1 Rule 4.1.4, or has been proved to be in violation of any provision of Schedule 9 - Code of Ethics for Members of the Kennel Union of Southern Africa, will be rejected automatically. The decision of the Executive Committee to reject any application for Membership of the Kennel Union shall be final”, should these persons apply for KUSA Membership at any stage in the future, membership must be refused. As they are not members their details are not recorded on the KUSA database. Their details will be added to the database as Non-Members with a Refer Management status.
Noted. PM confirmed that the persons in question have been added to the KUSA Admin System with a refer management status added as a warning, should they apply in future.
MA suggested that the information be shared with Clubs as a warning, especially those with breeds who traditionally still dock tails.

10.1 Namibian banking charges
As of 15.04.2023, Namibia will be charging forex on all transactions between South Africa and Namibia. This may negatively impact the Clubs and members KUSA has in Namibia.
CPA to liaise with Mr R Juckes and follow up with the Clubs as to the financial impact this will have on Namibian Clubs and members .
10.2 City of Ekurhuleni Metropolitan Municipality – Draft Dog By-laws
The City of Ekurhuleni (which covers most of the Johannesburg East Rand – Edenvale, Bedfordview, Kempton Park, Boksburg, Benoni, Springs etc.) has issued draft environmental health laws which include the keeping of dogs. These draft By-laws contain restrictions over the number of dogs that may be kept on a property (Reg 18.2), the keeping of unspayed bitches (Reg 18.2.g), the need to be a registered breeder (18.3.f), licences, need for a collar and/or microchip, impounding and/or destruction of dogs, sterilisation of dogs, removal of excrement etc. (see attached).
After discussion it was decided that the matter be referred to Fedco 06-24.
10.3 MA enquired on whether or not Show Clearance certificate may be extended and for what period of time may it be extended. PM advised that Show Clearances may be extended by a year.

The above Club held a Non-Championship IGP Trial on 25 June. The office noted a Judge change to the online portal on the day of the show by the Club. No documentation was submitted, no reason for the change, nor a new Judge’s contract was received. All pre-show documentation listed Christine Kneidinger as the judge, and she was approved. On receiving the Show Returns, the Judge was confirmed as Mr John Swartz.

CGC continues to run well with a total of 472 successful results having been received to date for 2023. Clubs are encouraged to submit all outstanding results.
A suggestion has been made for KUSA to consider adopting a CGC Platinum test with initial thoughts being a dog achieving three CGC Gold certifications but each in a different location, e.g. one at a training Club, one at a showground environment and one at a public space such as an expo. While there are merits to this suggestion, there is a more pressing need to design and run a training course for Evaluators.

10. GENERAL
10.1 MA enquired on whether there was a proactive way of warning members regarding the Schedule 02 Regulation 12 rules. PM suggested that the wording on the covering letter, sent to members when posting certificates, is amended to include a reminder of the Regulations.
10.2 GBR reported that a group of interested people in East London are trying to start up East London Kennel Club, Port Rex Kennel Club and Queenstown & Districts Kennel Club again and Show Licences will be applied for in due course.
