5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Case 2024-01 – KUSA (Van Vliet) vs Brunner – Appeal

“General Observations and Supplementary Commentary
The Members of the FAC would fail in their responsibilities towards the Kennel Union should they not bring to the attention of the Executive Committee their concerns relating to events which took place at the Baakens Valley Working and Herding & All Breeds Training School’s Non-championship Show held on 22 March 2024. These include:
a) The Judge on the day failing to adhere to Schedule 05B(02) App B Special Requirements in the FCI-IBGH 3 test with regard to the order in which exercises were to be carried out;
b) The Club failing to adhere to the Schedule 03 Regulation 37.1 which states (underline and bolding added for clarity): “The Show Committee shall report, in writing, to the Secretary any case of alleged fraudulent or discreditable conduct, and any default or omission at or in connection with a Show which is brought to its notice. Every such report shall be submitted to the Secretary within seven (7) days of the show and shall be accompanied by all documents and information in connection therewith which is in its possession of power.”;
c) The Trial not meeting the requirements under Schedule 05B(02) App B which state, under Trial Participants, that: “The examination (trial) must have a minimum of 4 participants per trial day. The minimum number of participants per day may only be less if for FCI-BH/VT or BH/VT (NPO) examinations these dogs pass and try for a further examination (FCI-IGP-1, FCI-IFH 1) at the same event.”;
d) The Non-championship Show held on 22 March 2024 not being compliant with the stipulation for trial days as provided for in Schedule 05B(02) App B under Trial Days; and
e) The validity of qualifications awarded on the day.
The intention is to enable the Executive Committee to consider taking appropriate pre-emptive steps, either by way of regulation, or training, to hopefully avoid the recurrence of such disruptive events in future.
At the request of the Fedco Appeals Committee, the KUSA Secretary appeals to the Executive Committee to decide on the actions to be taken so that these may be recorded in the Minutes for noting by the FAC and Fedco.

After discussion it was decided that CPA send a letter to the National IGP Sub-Committee (NIGPSC) bringing the concerns expressed by the FAC to their attention and urging them to take the necessary steps to improve IGP Judges’ knowledge of the FCI Regulations pertaining to the judging of Trials to avoid future incidents such as those which occurred at the Non-championship Show in question. Furthermore, Exco required input from the NIGPSC regarding the validity of the awards made on the day given that several Regulations were contravened by the Judge and Club.
The NIGPSC should also be urged to alert Clubs hosting Trials to the Regulations Schedule 03 Regulation 37.1, which requires any default or omission at or in connection with a Show to be reported to the KUSA Secretary within seven (7) days of the Show.

5.2.2 OTHER CLUB / SHOW MATTERS
5.2.2.1 Objection to shared show date – 10-11.04.2025
Baakens Valley Working & Herding Club have made an application to hold a second Dog Jumping & Agility show on an existing Cluster weekend. One of the Clubs on those days, Madiba Bay Agility Club, has objected to sharing the date between 4 clubs. Exhibitors have expressed concern about overworking their dogs and finances and adding this show to the weekend is likely to result in exhibitors choosing which rounds to enter, thereby taking entries from the existing clubs on the weekend.

GBR to refer matter to Eastern Cape & Border Provincial Council and provide feedback at the next Exco meeting.

5.2.2.2 Entry in Contravention of the Regulations
Dogs entered in contravention of Schedule 03 Regulation 37.3 and in violation of the Declaration by the Registered Owner/Authorised Agent signed as a condition of Show Entry, and subject to sanction under Schedule 03 Regulation 33.2

Schedule 03 Regulation 37.3:
37.3 Without limiting the extent and meaning thereof, discreditable conduct shall include inter alia wilfully, by word or letter, attempting to influence exhibitors to boycott a Show, wilfully speaking to or treating a Judge or any Show Official in a disrespectful or contemptuous manner, wilfully permitting his exhibit to be improperly attracted from outside the Judging Ring whilst within the ring to be judged; failing to pay entry fees or other dues in respect of the Show; wilfully acting or behaving in opposition to these Regulations; making any false declaration upon his Show entry form; failing to comply with any request properly made by a Show Official; any act of cruelty to or neglect of a dog; any disorderly or unseemly conduct at or within the precincts of a Show; making insulting or disparaging remarks of and about any dog, Exhibitor, handler, Show Official, Judge or KUSA Representative at a Show.
Show Entry Declaration:
By attaching my signature to this form, or where the form is submitted electronically, by inserting my full name and surname I, the Registered Owner of, or I, the Authorised Agent for, the dog hereby entered for exhibition, affirm that I have read and understood the full contents of this Entry Form and hereby declare that:
12. This Entry Form and the information recorded on it is complete, accurate and true and the document is entirely free of misstatement or any false declaration.
13. Should any information on this Entry Form be found to be inaccurate or fraudulent to any degree whatsoever, I am aware that I may be liable for disciplinary action in terms of Schedule 1 Rule 4, resulting in any awards and/or prizes won by the dog hereby entered being withdrawn and/or cancelled.
Schedule 03 regulation 33.2:
33.2 The Executive Committee shall have power to impose a fine upon any exhibitor who makes an error in his entry form or infringes any provision of these Regulations and withdraw any prizes awarded on the day.
Two Bull Terrier puppies, Reithsons Luca and Reithsons Nala, both in the Registered Ownership of a deceased estate, were entered on ShowAssist under the profile of another KUSA Member in the Championship Shows of Western Province Bull Terrier Club and Cape Terrier Club, held on 25 October 2024. The Show Entry Forms for both shows reflect CH BEORMA LUCYJORDAN OF REITHSONS as the Dam of the puppies. However, when the litter of four puppies, including Luca and Nala, was registered by KUSA on 14 October 2024, as per the Application for the Registration of a Complete Litter, the Dam of the litter was cited at CARRADICE ANA’S SONG AT REITHSONS which, accordingly, features as the Dam of all four the puppies on their Registration Certificates.

Given the above regulations, the KUSA Office requires Exco’s guidance on how to proceed.
Decision – a R500 fine x 2 to be imposed for the submission of Official Show Entry Forms in Contravention of the Regulations.
5.2.2.3 Imported Dogs issued with KUSA Registration Numbers for Show entry pending requisite DNA Profile
Cllr Alberts raised concerns pertaining to a practice that is deemed contrary to Schedule 02 Regulation 3.1.5 which states:
3.1.5 All imported dogs must be micro-chipped and have a standardised international marker DNA profile before acceptance for registration on any KUSA register.

Thank you for the detailed response Pascale. (Attached to agenda). I have full understanding that exhibitors do put a lot of pressure on the office with regards to registrations, especially for shows when a closing date is looming.
The regulations in this regard are however very clear in that there will be no acceptance for registration on any KUSA register without the required DNA profile. The procedure implemented by the office, as detailed by yourself below, is in direct contravention of this regulation.
Strictly speaking, the moment a dog is assigned a ZA number it is recorded on the applicable KUSA register as KUSA have now assigned the dog a KUSA registration number denoting its register number on the applicable KUSA register. The fact that the dog is allowed to be entered into a show further speaks to its registration status with KUSA. As I understand it, only dogs registered with KUSA on the Primary Breed Register or Breed Appendix Register or those that have a valid clearance certificate issued by KUSA are allowed to be entered in breed at Championship shows. With the office granting permission for the dog to be entered in shows it is effectively confirming the registration status.
A note on the system that additional information is required for complete registration does not change the registration status as outlined above. There is no provision in any regulation that allows for a partial or incomplete registration status. There are only two applicable statuses: registered or not registered.
In all other aspects where there is deviation from the regulations required by the office, EXCO is approached by the office for dispensation. I however am unaware of EXCO giving such dispensation, hence me continuing on raising my concern on the matter. It cannot be considered acceptable practice for the regulations to be strictly followed in some areas while being loosely applied in others.
The fact that this procedure has been in place for many years and that many have benefitted from it, still does not make it right. This has to be corrected by either the procedure being repealed or the regulations needing to be changed.
Background from the KUSA Office:
At a pre-Fedco 06-2015 meeting held on 26.06.2015, at which the budget for the financial year 2015-2016 was approved, it was decided to add a new fee to the Subscription & Fees List (Schedule 07), “Express Service- Imported Dog – Fast Track allocation of registration number per application”, to address complaints received from Members and Clubs in respect of the time it took for the KUSA Office to process applications for registration of imported dogs.
Regulation 3.1.5 came into effect in April in 2018 and the KUSA Office came under renewed pressure from Members and Clubs to issue Registration Numbers to imported dogs as quickly as possible after their arrival in South Africa, so that the dog could be entered in the puppy Classes at Shows whilst still eligible and age-appropriate. Having to obtain a DNA Profile locally prior to registration delayed the application process and resulted in the dogs not being able to be entered at shows for a few weeks after their arrival in South Africa, as at that time the KUSA Office took 15 working days or more to process applications from the time of receipt of all requisite documentation. After having paid the Express Service Fee and Members expecting to receive a KUSA Registration Number within two working days, then to be informed that a DNA Profile Number first needed to be obtained, which at that stage took up to two weeks or more, caused further dissatisfaction and complaints.
The problem was discussed at a Fedco Discussion Forum (previously referred to as a Fedco Informal Meeting) where it was decided that the KUSA Office should be permitted to issue registration numbers to imported dogs for which all registration requirements had been met, save and except for the requisite DNA Profile, but for which proof had been received confirming that DNA material had been submitted to an approved Laboratory for DNA profiling.
Although a KUSA Registration Number is issued, on the KUSA database (K9 Admin System) the registration status of the dog is considered as incomplete and flagged as “Incomplete – Need DNA Profile”, precluding any further activities or transactions pending receipt of the DNA Profile Certificate, after which the dog’s registration status is changed to “Registered”. The Certificate of Registration is withheld until such time that the DNA Profile Certificate and all other requisite documentation are received and only issued thereafter.

Note from the KUSA Office:
In view of the concerns raised, the General Manager informed the KUSA Office to immediately cease issuing KUSA Registration Numbers in advance of receiving DNA Profile Certificates until clarity has been obtained on the matter and the way forward has been decided.
After discussion, it was decided that the KUSA Office will no longer issue Registration Numbers in advance of all requirements set out in the Regulations having been met.

5.2.4 KUSA Classic 2026 – Gauteng hosted by NAPC
Week 22 – Gauteng.
CP advised that a provisional budget has been drafted but that prior to submission the organisers wished to gauge the level of entries of All-breeds Shows held in November 2024 and early 2025.
Budget to be submitted on the understanding that it is subject to revision.
5.2.5 Schedule 03 Reg. 14 & Reg. 19.8 – Exclusion of Dogs
5.2.5.1 Temporary Exclusion Order – Bull Terrier – Joche Sebastian Marlu – Reg No. ZA007785B23
It was reported that the abovementioned dog had acted and behaved aggressively by attacking another Exhibitor and their dog at the Northern Free State Kennel Club Championship Show held on 31.08.2024. The Club has submitted the Incident Report Form (Annex A).

5.2.5.2 Temporary Exclusion Order – Belgian Shepherd (Malinois) – Bolo – Reg No. ZA001698B20
The Office has received a partial report regarding an incident of aggression that took place at the South Cape Non-championship Show IGP Trial on 02.11.2024. The Club has been granted an extension to submit the required documentation.

5.2.5.3 Temporary Exclusion Order – Flat-coated Retriever – Sheadoes Sweet Talker – Reg No. ZA011488B20
It was reported that the abovementioned dog had acted and behaved aggressively by attacking another Exhibit at the TKC Kennel Club Championship Show held on 13.10.2024. Both the Club and the Registered Owner have submitted documents relating to this incident. A preliminary TEO was issued on 18.10.2024.
The dog is to complete a socialisation course (TEO Manual 12.2.1.3), provide KUSA with a letter of proof from the Training Club (TEO Manual 12.2.1.3.2 and 12.2.1.3.3) and then complete a CGC Silver (TEO Manual 12.2.1.4).

Accidental mating resulting in the Breeder submitting an application for pre-approval for the registration of a 6th litter (due date 25.11.2023) and 7th litter.
If dispensation for the registration of the 6th litter is not granted, the breeder reluctantly proposes that the 6th litter be aborted, and dispensation be granted for the registration of the next litter which is critical to her breeding programme.
After careful consideration approval for the registration of the 6th litter currently in gestation was approved and it was further agreed that a 7th litter would also be accepted for registration on the proviso that, prior to the mating for the 7th litter taking place, the Dam be subject to a thorough Vet examination and a detailed Vet Report be submitted together with the litter registration application.
Approval was granted on condition that the breeder understands and accepts that no further requests for dispensation for registration of any other litters out of any Dam registered in her name will be accepted or considered by Exco going forward.

10. GENERAL
GBR reported that she had been elected to serve for the ensuing four (4) years as the Exco representative for the EC & Border PC at the meeting held 17.11.2024, subject to acceptance of her appointment by the Provincial Council Chairmen of the Federal Council in accordance with Article 14.4 of the KUSA Constitution.
