2. MINUTES
2.1 The Minutes of the meeting held on 21.01.2025 were formally adopted, subject to amending item 5.2.5.1 to read: “…. The owner of the dog has provided evidence of the dog having been enrolled in two training Clubs. Signed copies of the two letters provided had since been submitted to the KUSA Office.”

A reprieve was granted by the Fedco-appointed Budget Committee for the Financial Reports for January and February 2025 to be presented at Exco 03-2025 due to BD’s preoccupation with converting the QuickBooks Desktop version to the Online version.

5. SUB-COMMITTEES
5.1 DISCIPLINARY SUB-COMMITTEE
5.1.1 Case 2024-01 – KUSA (Van Vliet) vs Brunner – Appeal
No further updates received. A reminder was sent to the NIGPSC on 15.01.2025.
CPA reported that a response had been received from Mr JQ Swartz that the relevant training is being provided. The validity of the awards was, however, still in question. After discussion, it was decided that the awards were to remain in place.
A further response had since been received from the National IGP Sub-Committee (see attached).
CPA to send a letter on behalf of the Exco Chairman to the National Convener, Mr JQ Swartz, alerting him to the fact that neither he, nor anybody else, had the authority to override Regulations for a Trial to continue when one dog had been withdrawn due to injury.
5.1.2 Case 2024-03 – KUSA vs Ingram
A DSC has been appointed, and the hearing has been scheduled for 23 January 2025.
The DCA convened on 23.01.2025. The record of proceedings has not yet been finalised and, in consequence, has not yet been sent to the Acting KUSA Secretary as required under Schedule 01 Rule 10.14. The DSC has notified the Acting KUSA Secretary that it needed to extend the date for the submission of the record of proceedings until 10.03.2025, which extension it is entitled to claim under Rule 1.16.

5.1.3 Case 2024-04 – KUSA vs Botes
A DSC has been appointed, and the hearing has been scheduled for 13 February 2025.
The DCA convened on 13.02.2025. The record of proceedings has not yet been finalised.

5.1.4 Case 2024-05 – KUSA (Austen & NFSKC) vs Pieterse, Van den Doel & Katts
Awaiting answering affidavits from Respondents, due by 7 February 2025.
Following an extension granted by the SCI, the Answering Affidavits of the three Respondents were received by the SCI on 10.02.2025. These documents are currently under consideration by the SCI.

5.1.5 Case 2024-06 – KUSA (TKC & Witwatersrand Kennel Clubs) vs Van Zyl

5.2 SHOWS
5.2.1 Applications for Second Championship Show
Article 29. Championship Shows – Frequency
29.1 No Club shall hold more than one (1) Championship Show in any calendar year, unless dispensation is granted by the Executive Committee.
5.2.1.1 Algoa Hound Club 20.09.2025
The above Club has made an application to hold a second Championship Dogsport Show on their regular weekend. The Dog Jumping & Agility fraternity are assisting the Club to get back on its feet.

5.2.1.2 Australian Shepherd Club of the Western Cape 25.10.2025
The above Club has made an application to hold a second Championship Show on the October Cluster weekend, and has offered an International Judge to the rest of the Clubs.

The above Club has made an application to hold a second Championship Show over the PetExpo Cluster weekend.

5.2.2 OTHER CLUB / SHOW MATTERS
5.2.2.1 Request for Dispensation – Amended Show Licence Fees 04-06.04.2025
The following Clubs on a Cluster Breed weekend request dispensation:

Schedule 03 Regulation 6 Show Schedule:
Reg. 6.1 The Schedule shall be treated as a contract between the Show Authorities and the Exhibitors. Once approved by the Executive Committee, no modification or amendment of any description may be made to the Show Schedule unless special dispensation is granted.
Schedule 03 Regulation 1.1:
The Executive Committee shall have the authority, delegated by the Federal Council to grant, withhold or cancel permission to hold any Show and to issue licences therefore in accordance with the Regulations relating thereto.
Schedule 07 Regulation 14.3.7:
Amendment or alteration to a Championship or Qualifying Show Licence already issued – 50% of Licence Fee.
The above Clubs each have two Shows over the Cluster weekend. They had a change in show venue and paid the Licence Amendment Fees as per Schedule 07. The Clubs are requesting dispensation from paying two Licence Amendment Fees each.

GBR explained that the venue change was out of the control of the Clubs, as the venue was no longer available and the Clubs were notified at short notice.
After discussion, it was accepted that neither Exco, nor Fedco, has the authority to grant dispensation.
MA suggested that a proposal be drafted for tabling to Fedco to have amendments to licences on account of circumstances beyond Clubs’ control regulated under Schedule 03.
5.2.2.2 Show Returns not received
The following Club is in contravention of Schedules 03, 07 and 08 with regard to Show Returns, and the Club is accumulating Penalties as a result.

5.2.2.3 Request for Dispensation to hold a Re-qualifying Show on the same day as Championship Show
– Highveld Whippet Club – 18.07.2025
The above Club has applied to hold a Re-qualifying Show over the Bumper PetExpo weekend. The organisers are assisting them in getting the Club up and running again. Due to the full weekend, the Club is requesting permission to share a day with an All-breeds Club that is offering classes for the same Group/breed.
Schedule 04A:
1. The Executive Committee shall have power delegated by the Federal Council to grant, withhold or cancel permission to hold any Show and to issue licences therefor in accordance with the Regulations relating thereto.
3.2 Unless dispensation is granted by the Federal Council, no Qualifying or Re-qualifying Show for any Breed, Group or Discipline shall exceed one (1) day’s duration, and no Qualifying Show or Re-qualifying Show shall be held on the same day as a Championship Show, where the same Breed, Group or Discipline is being exhibited, unless the venue is more than 160 kilometres from the venue of the Championship Show.

5.2.2.4 Change of Club Affiliation Status
The following Clubs have successfully held Qualifying or Re-qualifying Shows and would now like to apply for Championship Show licences:
Border Dog Training Club reinstatement as a Championship Show-holding Club
This Club hosted a Re-Qualifying Show on 18.01.25. The Club has paid the fees for a Championship Show-holding Club in accordance with Schedule 03, Regulation 1.2.3.4, “In those years where a Championship Show-holding Club elects not to hold a Championship Show, and in any year it holds a Qualifying Show, in terms of Regulation 1.2.3.2 or 1.2.3.3, it shall remit the Affiliation Fee of a Championship Show-holding Club.”

Wild Coast Dog Training Club change from a Non-championship Show-holding Club to Championship Show-holding Club
This Club hosted a Qualifying Show on 19.01.25. The Club has NOT paid the fees for a Championship Show-holding Club in accordance with Schedule 03, Regulation 1.2.3.4, “In those years where a Championship Show-holding Club elects not to hold a Championship Show, and in any year it holds a Qualifying Show, in terms of Regulation 1.2.3.2 or 1.2.3.3, it shall remit the Affiliation Fee of a Championship Show-holding Club.”
Approved,on the proviso that the outstanding fees are paid.
5.2.2.5 Late Submission of Show Documents – Western Cape Staffordshire Bull Terrier Club – 01.03.2025
The above Club is requesting that they be allowed to go ahead with their Show on 01 March 2025. Their documents were due on 1 September 2024, but were received on 16 January 2025.
Schedule 03:
2. Every application for a licence to hold a Championship Show shall be made not less than six (6) calendar months for Shows held from 1 January 2003 before the proposed date, on an official Kennel Union form, signed on behalf of the applicant Club by the Chairman, Treasurer and Secretary, who shall give their full addresses, setting out the information required therein, and such application shall be accompanied by the draft schedule of the Show, a letter of acceptance from each prospective Judge and the fee prescribed in terms of Schedule 07.
5.17 Where a Club, for any reason whatsoever, has been unable to finalise its Draft Schedule twelve (12) weeks before the first day of the Show, no licence shall be issued for that event. If a licence has already been paid for, Licence Fees will be refunded to the Club, subject to the deduction of Penalty Fees incurred up to twelve (12) weeks and, should the Penalty Fees be in excess of the Licence Fees, the Club shall be responsible for payment of the shortfall.
The 12-week cut-off for their Show to be cancelled was 07 December 2024.
They were also required to submit AGM documentation as well as Financials, and this has subsequently been received.
After discussion, there was doubt whether Exco had the authority to grant the request. BJ proposed that he should contact the Chairman of the Federal Council to request her to obtain permission from Fedco to grant the dispensation requested via a round robin resolution.
Although requested by the Chairman of Exco, the Chairman of Fedco declined to seek resolution via Fedco round robin but, instead, tabled the matter for discussion at the Fedco Discussion Forum (FDF) Session 2 on 28.01.2025. The majority of Fedco members concluded that, although Fedco was the only authority, under Article 43, to interpret the KUSA Constitution in instances of possible ambiguity, it was not empowered to override the Constitution in the normal course of events.

5.2.2.6 Objection to Field Trial Show Date – Walmer & Suburban Kennel Club – 30 May to 01 June 2025
An objection has been received by a Western Cape Exhibitor regarding the Retriever Field Trial being held in the Eastern Cape over the weekend of the KUSA Classic Breed weekend.
The organisers of the KUSA Classic Weekend have requested that Exco discuss the holding of other Dogsport Events over the Nationals Breed weekend.
The KUSA Office procedure regarding accepting Shows has always been to allow non-clashing events to go ahead, especially in different Provinces.

After a vote, it was agreed that the Club may proceed with the hosting of the Field Trial Show. One objection was recorded.

5.2.5.1 Temporary Exclusion Order – German Shepherd Dog Type – Inca von Blauklippen – Reg No. ZA001060Y22
Incident 1
It was reported that an incident involving the abovementioned dog took place at the Working & Herding Breeds of the Cape Championship Show (on loan to the Western Cape Working Trials Sub-Committee) held on 02.09.2023. The incident was discussed by the Judge and Show Secretary, and it was agreed to give the dog the benefit of the doubt and not declare it an Incident of Aggression (see attached).
Incident 2
It was reported that the abovementioned dog acted aggressively at the Cape Handlers Dog Club Non-Championship Show held on 02.08.2023 where it showed aggression towards the Learner Judge (see attached).
TEO confirmed 20.09.2023
The Registered Owner of the dog contacted the KUSA Office on 16.01.2025, asking how to proceed to have the TEO lifted. However, the Decision Letter provided to the Registered Owner on confirmation of the TEO, and the TEO Manual state (emphasis added for clarity):
14.5. The Owner of any Implicated Dog, which has been issued with a confirmed TEO, has a maximum period of 12 (twelve) months from the date of the TEO (the date the TEO was
confirmed by the Executive Committee) to successfully complete the requirements as provided for in Step 1, 2 and 3 of this Manual, failing which, the Executive Committee
will apply to the Federal Council to have the Implicated Dog permanently barred from entry to and exhibition at any future KUSA-licensed Shows/Events subject to compliance with the procedure as provided for in Clause 11.11 hereof.
CPA to prepare a proposal and compile a list of dogs that have exceeded the 12-month period to be tabled to Fedco at the next FDF. Fedco’s opinion to be solicited on whether Exco was able to grant an extension on the 12-month rule.
5.2.5.2 Temporary Exclusion Order – Spaniel (English Springer) – Tanjo War Lord – Reg No. ZA001466B18
The Office has received a report regarding an incident of aggression that took place at the Western Cape Top Dog Invitational Show on 07.12.2024. All relevant documentation was attached.

The matter was considered by Exco and it was decided that the decision made at Exco 01-2025 must stand.

10. GENERAL
10.1 On 15.01.2025, the KUSA Office reminded the National Sub-Committees that they needed to host their AGMs between 01.01.2025 and 31.03.2025 and that they needed to submit the Minutes thereof to the KUSA Office no later than thirty (30) days after the AGMs were held.

CP thanked the Exco members and KUSA staff for their cordiality and assistance during the time she had served on Exco.
MH enquired whether the issues raised in the report she had submitted after the hosting of the KUSA Nationals in KZN, pertaining to the lack of sufficient Agility and Dog Jumping Trophies, had been addressed. The KUSA Office to follow up.
