THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY 16 JULY 2024 VIA MS TEAMS

2. MINUTES

2.1 The Minutes of the meeting held on 18.06.2024 were formally adopted.

2.2 The Minutes of the Special Meeting held on 04.07.2024 were formally adopted. MA was concerned that the letter sent under the General Manager’s signature to the various stakeholders after the meeting might give the impression that the various issues raised were addressed, which was not the case, as was evident in the minutes of the meeting published thereafter.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2024 KUSA (Van Vliet) vs Brunner

Finding:

After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision, on a balance of probabilities, with regard to the Case 01-2024 before them:

1. The DSC found that the complaint was fully substantiated , and that, in humiliating and undermining the authority of the Mr van Vliet, the Respondent had wilfully engaged in conduct that was improper, disgraceful and disrespectful and prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith .

2.The DSC therefore found the Respondent guilty of contravening Schedule 01 Rules 4.1.1 and 4.1.1.4, and further of contraveningSchedule 04 Regulation 25, read with Schedule 03 Regulation 37.

3.The DSC further found the Respondent guilty of breachingRegulations 1.3, 1.4, 1.7, 5.1, 5.17 and 5.18 of Schedule 09 (Code of Ethics for Members of the Kennel Union of Southern Africa).

4. The DSC took note that Schedule 05B(02) Appendix B (International Utility Dogs Regulations (IGP)), under the section “Disciplinary Rights”, makes provision for an objection to be lodged against a Trial Judge’s method of assessment. It is stated under this section that in the section that: “Justifiable objections may be made in cases where the judge has violated the trial regulations but not against his assessments. Any such objections must be made in writing and addressed to the relevant authority and must be lodged with the show holding organization and signed by the complainant.” (emphasis added). It is further stated in the section that “Public criticism of a judge’s assessments may result in dismissal from the trial grounds and further disciplinary action may follow. 

Penalties:

In terms of Rule 11.1.2 of Schedule 01, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at any Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club for a period of six (6) months .

In terms of Rule 11.5 of Schedule 01, the DSC ruled that the penalty be suspended in full for a period of three (3) years , on condition that, during the period of suspension, the Respondent does not contravene any of the provisions of Schedule 01 Rule 4, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint.

The DSC ruled that the above penalty will take effect on the 1July 2024.

Ms Brunner has lodged an Appeal. Notice of Appeal to be forwarded to the SCI to decide whether the Notice of Appeal has been properly compiled (Schedule 01 Rule 12.3)

Note: Schedule 01 Rule 12.11 “An appeal may not operate as a stay of any penalty, order or condition imposed by the DSC.”

5.1.2 Case 02-2024 Venter vs Hall

After careful consideration of the evidence submitted by both the Complainant and the Defendant, the Sub-Committee of Inquiry (SCI) found that there were opposing and conflicting versions of what had occurred at the event in question and that the Defendant had presented an obviously acceptable explanation and corroborating sworn declarations in his defence, meeting the requirements of Schedule 01 Rule 8.2.5. This led the SCI to agree, unanimously, that there were insufficient evidence and grounds to proceed to a Disciplinary Hearing and obliged them to rule that the Complaint be dismissed under Schedule 1 Rule 8.4.1 and not be progressed further.

Case dismissed by SCI.

5.2 SHOWS

5.2.1 Applications for second Championship Show

5.2.1.1 Free State Terrier Club 02.11.2024

The above Club is applying to hold their usual second show as part of a Terrier Cluster in the Free State, along with the Frankfort show weekend.

5.2.1.2 Cape Field Trials Club 14-16.09.2024

The above Club is applying to hold their usual second Field Trial as part of their double weekend of Trials. The second Licence is usually held by Kennel Association, but due to KA’s decision to no longer hold Dogsport events, the Cape Field Trial Club is applying for this Licence in order to offer the same Trials to exhibitors.

5.2.2 Application for FCI CACIT Event

5.2.2.1 K9 Sport Specialist GSD Club of Gauteng – 23-24.08.2025

The above Club would like to hold a CACIT event (International Utility Dog IGP event), the first in South Africa. Application procedures have been explained to the Club, and the Fedco Portfolio-holders for FCI and IGP have been informed. The KUSA Office is required, on behalf of the Club, to submit an application to host the event to the FCI by May 2025.

5.2.3 OTHER CLUB / SHOW MATTERS

5.2.3.1 Entry in contravention of the Regulations in Schedule 03

7.2 In order to constitute a valid entry, the Registered Owner(s) or Authorised Agent of the dog shall submit a separate entry form for every dog entered by them, which shall be signed by the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.

7.2.1 In the case of a co-ownership, the full name of all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the Registered Owners of the dog for purposes of Show Entry.

A Grand Champion Application was received for Dobermann Donnehaus Dollar Time ZA011404B21. The dog is in dual ownership.

On the application form submitted to the KUSA Office, only one of the Registered Owner’s names was declared as well as on all Award Certificates submitted in support of the application. The Office would like to know how to proceed.

Decision – a R500 fine to be imposed for the submission of Official Show Entry Forms in contravention of Schedule 03 Regulation 7.2.1. The KUSA Office may process the application once payment of the fine has been received.

5.2.4 KUSA Classic 2024

5.21 TRICK DOG

5.21.1 Trick Dog is running its fourth Speciality this month with the theme being ‘Acts of Kindness’ (used to be 67 Minutes) in honour of Nelson Mandela. Dogs can do any trick of any level as long as it speaks to the theme of ‘kindness’. Specialities are non-titling events that are hugely popular amongst participants.

5.22 CANINE GOOD CITIZEN

5.22.1 CANINE GOOD CITIZEN Sub-Committee

A suggestion has been made for KUSA to consider adopting a CGC Platinum test, with initial thoughts being a dog achieving three CGC Gold certifications, but each in a different location, e.g. one at a training Club, one at a showground environment and one at a public space such as an expo. While there are merits to this suggestion, there is a more pressing need to design and run a training course for Evaluators.

CPA outlined the main points of the discussion between herself and KUSA’s Legal Adviser and presented a draft Companion Event management document for Exco’s consideration which was attached to the agenda.

After discussion, it was agreed to appoint a Permanent Sub-Committee to deal with the training of CGC Evaluators. The Sub-Committee is to comprise a KUSA Staff Member and a representative from each Provincial Council. CPA was appointed as the KUSA Staff Member to serve on the Sub-Committee. Exco to request that Fedco pass a Resolution to empower the Sub-Committee to host training events and courses in the interim period during which Schedule 11 Regulations are put in place to govern the training of CGC Evaluators. The Sub-Committee must provide progress reports to Exco on a regular basis.
