The Minutes of the meeting held on 22.03.2023 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Inconsistent Show Returns (Exco 03-23 Item 5.2.3)

Cape Handlers Dog Club – Flyball Event

Please see attached response received from the Club Chairman and from Doreen Powell.

The KUSA Office has not received copies of the Flyball cards, nor the mentioned Flyball scoresheet.

We were not notified that the event had been changed to a non-official event.

The appeal from the Club was considered and it was decided that the penalty be withdrawn.

3.2 Temporary Exclusion Orders (Exco 03-23 Item 10.2)

At the DOGSPC meeting (28.02.2023), the Obedience Sub-Committee reported that they did not feel that the CGC Bronze test was an appropriate test to prescribe for dogs that had been served with a Temporary Exclusion Order (TEO). The Councillor made the point that a test designed by IPO [sic] would be far more appropriate for the purpose. The IGP Sub-Committee expressed the belief that the IGP BH Test could conceivably be adapted for the purpose and undertook to discuss it with her IGP colleagues with a view to finding a solution.

A similar discussion took place at Fedco 12-2022 (Item 13.1):

“A discussion ensued on the suitability of the CGC Bronze Test for the assessment of the temperament/aptitude of dogs under a Temporary Exclusion Order (TEO). It was brought to Fedco’s attention that the appropriateness of using a CGC Test to get a TEO lifted has been the subject of heated debate in the dog world, with some CGC Evaluators openly stating their reluctance to “test” so-called “power breeds” currently under TEOs.

The Chairman cautioned Fedco that the suitability of a CGC Test for purposes of lifting TEOs required a dedicated discussion, once possible alternatives have been investigated. For the moment, Fedco was required to approve the regulatory framework for CGC, a test which served a multitude of useful purposes outside the ambit of the TEO.”

Informal discussion at Fedco were not favourable towards the BH to be used across the spectrum of breeds.

CPA to liaise with SM and MH regarding the matter and report back at the next meeting.

CPA circulated all relevant documents to SM and MH. A discussion took place on 12.04.2023 (see attached) where it was noted that the BH and CGC were actually quite similar in nature although the BH also contained exercises that were not relevant to TEO dogs. Questions were raised as to who would be eligible to judge / evaluate a modified BH or hybrid test. It was recommended that further discussions take place, but that further amendments to the TEO Manual should be put forward to Fedco 06-2023 (see attached).

CPA to liaise with MA to prepare a proposal to add to the Fedco Agenda.

4. KUSA OFFICE

4.1 Office Report

PM reported that there has been a concerning increase in the number of puppy sale scams reported to the KUSA office. MH offered to speak to her employer who is an Advocate to obtain a legal perspective on the matter.

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2023

In accordance with Rule 8.3 of the Disciplinary Rules, the Sub-Committee of Inquiry (SCI) called for further evidence to be submitted.

The Respondent was notified of the official complaint lodged against them on 5 April 2023.

5.2 SHOWS

5.2.1 Applications for Second Championship Show

5.2.1.1 Northern Boxer Club – 16.07.2023

The above Club is requesting to hold a second show on 16.07.2023 as part of the PetExpo.

Motivation: To showcase the breed, full motivation attached.

5.2.1.2 Working Deutsch Drahthaar Club – 20-27.08.2023

The above Club is requesting dispensation from the following Regulation in Schedule 4:

The Working Deutsch Drahthaar Club has invited judges from the Deutsch Kurzhaar Verband (DKV) to visit South Africa to align international standards regarding the German Testing System, and to assist in Judges’ Education and Club Mentorship.

The Club’s full motivation is attached.

5.2.1.3 K9 Sport Specialist GSD Club of Gauteng – 06.05.2023

The above Club is requesting dispensation from the following Regulation in Schedule 4:

5.2.3 Application for Qualifying Show

5.2.3.1 K9 Sport Specialist GSD Club of Gauteng

The above Club was affiliated in April 2022. They have held Non-Championship IGP events only, and have some coming up in 2023. They have applied for a Specialist GSD Breed Qualifying Show to be held on 04.06.2023, and a Qualifying IGP show on 12.11.2023.

Their new Schedule 05E(28) Regulations for German Shepherd Specialist Championship Shows is currently under discussion by the GSD Liaison Council.

Application attached.

The Club would have had two Non-Championship Shows (IGP) by the time they want to hold their Qualifying Show (BR). The Office needs clarity on the Club’s status, that this Qualifying Show will be sufficient to award Champion status (for both Breed and IGP), and that a further Qualifying show is not necessary for their disciplines. It is the norm for Breed clubs to become qualified for Championship status, with their disciplines being included by default, and not the other way around. Should Exco approve the June Qualifying Show, the November one will not be necessary.

5.2.4 Entry in contravention of the Regulations:

The KUSA Office received an application on 04.04.2023 for the title of Junior Merit for Kissaki’s Winning Edge (ZA007484B22). It was noted that the dog is still registered in the name of the Breeder, and not the Exhibitor as appears on all the certificates. The Exhibitor, has been asked to provide proof of a transfer request but, should this not be forthcoming, the Office seeks advice regarding the validity of the awards. 5.2.5 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.5.1 Temporary Exclusion Order – Dobermann – Smooth Criminal Wot a Thriller at Donnehaus (IMP France) – Reg No ZA001170C22

Incident 1 (unconfirmed)

Verbal reports received of an incident which took place at the Kennel Association Championship Show held 25.02.2023 where it was alleged that the above-mentioned dog had behaved aggressively by attacking another dog, Donnehaus Dollar Time, Reg No ZA011404B21.

The Club was approached for a statement in this regard – see attached. Following a decision at Exco 03-23, the Club was again asked for a statement but, as of 11.04.2023, had not replied.

Incident 2

Report received of an incident which took place at the Liesbeek Kennel Club Championship Show held 26.02.2023 where it was reported that the above-mentioned dog had behaved aggressively by attacking another dog, Donnehaus Dollar Time, Reg No ZA011404B21.

TEO issued 02.03.2023 and confirmed on 22.03.2023.

The Ring Steward was asked to provide her statement in the form of an affidavit (see attached).

The KUSA Office received a letter from Millar & Reardon Attorneys on behalf of Ms Lucas contesting the validity of the TEO. Following discussions with N du Preez, the Office responded to the attorneys stating that TEO stands (see attached).

TEO to be withdrawn.CPA to liaise with NdP and advise owner.

5.2.5.2 Temporary Exclusion Order – Border Collie – Eurofire Amazing Heart – Reg No ZA006923B22

Report received of an incident which took place at the Witwatersrand Corgi Club of Tramordwy Non-Championship Show held 26.02.2023 where it was reported that the above-mentioned dog had behaved aggressively by attacking the Ring Steward.

As instructed by the Chairman of Exco, a TEO was issued 06.03.2023

TEO confirmed by Exco.

Owner returned signed Indemnity Form 27.03.2023.

5.2.5.3 Temporary Exclusion Order – Dutch Shepherd – Von der Frilya Anouk – Reg No ZA001021A17

Incident 1

Report received of an incident which took place at the Walmer & Suburban Kennel Club Championship Show held 25.03.2023 where it was reported that the above-mentioned dog had possibly behaved aggressively towards a Border Collie. (See attached)

NO TEO ISSUED.

Incident 2

Report received of an incident which took place at the Port Elizabeth Kennel Club Championship Show held 26.03.2023 where it was reported that the above-mentioned dog had possibly behaved aggressively towards a Border Collie. (See attached)

NO TEO ISSUED.

A letter of caution has been sent to the owner of the dog encouraging her to take proactive steps to avoid any further incidents. (See attached).

5.2.5.4 Temporary Exclusion Order – Rhodesian Ridgeback – Kleinvalley Stalin – Reg No. ZA002674B20 – following an incident at the Whale Coast Kennel Club Championship Show on 05.03.2022 at which it was reported that the exhibit had behaved aggressively by attacking another exhibit - Noordbrook The Red Racer, Reg No ZA037332B14. The injured exhibit required medical attention from the Vet on call.

TEO issued 14/03/2022

The Owner is now demanding that the TEO be lifted through correspondence with her lawyer.

At Exco 03-2023, it was ruled that the Owner be granted a 3-month extension to comply with the requirements and that the TEO were to remain in place.

The Owner has contacted the Western Cape Provincial Council to have the dog assessed by two Hound Judges at the upcoming Malmesbury Shows to be held on 21-22.04.2023 and 23.04.2023.

5.2.5.5 Temporary Exclusion Order – American Akita – Zabush Zeus – Reg No ZA011567B19

Report received of an incident which took place at Goldfields Supporters Club of Northern Gauteng held 10.07.2022 where it was reported that the above-mentioned dog had behaved aggressively by attacking two French Bulldogs (“Trouvallia Storm at Edmondo” and “Edmondo Show Stopper”).

Letter of appeal submitted by the owner of the two American Akitas involved in the incident.

TEO issued.

The Owner, Ms Lindy Spencer, has provided a Certificate of Completion (all dogs in the mentioned class gain a mark of 100%)

TEO to be lifted.

5.2.6 OTHER CLUB / SHOW MATTERS

5.2.6.1 Fedco 12-2022

8.3 Proposed amendment to Schedule 1 Rules 1.14, 1.15, 7.1.1 and 10.14 – Provision of service of documents, notifications and decisions by electronic mail or another form of printable electronic submission.

Accepted Fedco Proposal:

To replace “registered mail” as a method of service of documents, notifications and decisions with electronic mail, or another form of printable electronic submission or, alternatively, another form of requested service, e.g. courier. Motivation: Given the unreliable service of the SAPO, despatching documents by registered mail was no longer a viable option.

The above was amended in Schedule 01 as per the Fedco 12-2022 minutes. The same will need to be updated accordingly in the following Schedules:

A letter under the Chairman’s signature is to be sent to the KZN Provincial Council requesting that a detailed plan and interim budget for the hosting of the KUSA Classic 2024 events be submitted in time to be placed on the Exco 05-2023 Agenda.

9.1.1 Notification of Club Closure

Natal Coast Kennel Club held their AGM on 15.02.2023 where it was agreed to close the Club. It was further agreed that remaining finances were to be donated to the Highway Kennel Club.

However, the office noted some apparent irregularities in the financial statements for Financial Years ending 2021 and 2022. These have been discussed with KZN Provincial Council Chairman, Mr Michael Vorster, who had agreed to investigate further.

MH to liaise Mr Vorster and report back at the next Exco meeting. See attached response from the Club.

10. GENERAL

10.1 SM reported that the Secretary running the East London Clubs for the past two years has resigned. The current Committee may have to shelve holding Shows in East London next year.

10.2 South African Rhodesian Ridgeback Club Pre-Show penalties.

The Club was not affiliated to KUSA in October 2022 when the Schedule and pre-Show documentation should have been submitted.

Motivation attached.

It was confirmed that Penalties were not applicable.
