THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON WEDNESDAY 22 MARCH 2023 VIA MS TEAMS - PUBLISHED ON THE WEBSITE 18.04.2023

2. MINUTES

The Minutes of the meeting held on 14.02.2023 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Entry in contravention of the Regulations:(Exco 12-2022 Item 5.2.2)

The office had sought the advice of Exco to determine whether a dog had been entered in

contravention of Schedule 7.1.1 and to determine the eligibility of the CC awarded to the dog, for

Champion status.

MA suggested that Regulation 7.1.1 be reviewed and reworded to make mention of the registered Owner opposed to the Exhibitor.

After discussion, the following amendments to Schedule 3 Regulations 7; 7.1.1; 7.2; 7.2.1 were unanimously agreed:

7.ENTRY FOR EXHIBITION

Except as otherwise provided in the By-Laws applicable to a particular Disciplineonly Members of the Kennel Union shall be entitled to enter and have dogs in their registered ownership compete in any

Championship Dog Show, Championship Obedience Class, Championship Working Trial, Field Trial Championship Open Stake or Field Qualifier or any other Championship event, licensed by the Kennel

Union, save for Breed Classes offered at Specialist Club and Specialist Multi-breed Club Championship Shows, where entries will also be open to non-members’ dogs, with the exception of dogs in the registered ownership of persons on whom persona non grata status has been imposed, such dogs not being eligible for exhibition at any KUSA-licensed event.

All entries shall be submitted on an Official Show [ KUSA] Entry Form (which includes the approved online electronic version thereof), fully completed and signed or, in the case of an online electronic entry, by acceptance of the Declaration. Any alteration or amendment to the Declaration on either version of the Official Show Entry Form shall invalidate the entry. The current Official Show Entry Forms shall be [that] those appended to this schedule as Appendix 3 and are the only valid forms for Show Entry purposes. [ Only the current forms shall be accepted as official] .

Entries must not close before [ at ] the [ time date indicated on the Show Schedule which shall not be less than [ five (5)] three (3) days and not more than thirty (30) days before the Show opens.

7.1 The Show Secretary shall be held responsible for reporting any known violation of Regulation 7, which may be dealt with under Rule 2, Schedule 1 Disciplinary Rules ([ Schedule] 1).

7.1.1 When an entry is submitted to a show-holding Club, [ a dog shall be solely and unconditionally the property of the Exhibitor and at the time of exhibition it shall be registered in the Exhibitor’s name] the Registered Owner(s) declared on the Official Show Entry Form, shall be the Registered Owner(s) of the dog as recorded at the Kennel Union, or [at] in a registry [ formally] recognised [ by] via an agreement, [ the Kennel Union in a written agreement] .

7.1.2 No dog shall be accepted for entry into a Championship Show where the Registration Number of the dog is omitted from the appropriate section of the Official Show Entry Form. Insertion of the [ letters] abbreviations “R.A.F.” or “T.A.F.” are not acceptable and will invalidate the entry.

7.2 In order to constitute a valid entry, the Registered Owner(s) or [ exhibitor] Authorised Agent of the dog shall [ complete in ink or typescript, in accordance with the provisions thereon and the Show Schedule] submit a separate - Official Show Entry Form for every dog entered by [ him] them , which shall be signed by[ him] the Registered Owner(s) or his/their Authorised Agent or, in the case of an online electronic entry, by insertion of full name and surname, and shall be accompanied by the correct and appropriate fees within the time limitation for the closing of entries.

7.2.1 In the case of a [ partnership] co-ownership , the full name of [ every partner all the Registered Owner(s) must be stated and in the case of a dog being owned by a Limited Company, the Directors of the Company will jointly be considered as the [ exhibitors] Registered Owners of the dog for t he purposes of t[he] Show Entry [ Regulations.]

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2023

Complaint lodged and the Respondent informed. SCI to evaluate the complaint and the Respondent’s response, in accordance with Schedule 1 Rule 8 and decide whether to proceed with a Disciplinary Hearing.

5.1.2 Case 02-2023

The Club submitted -its report and the Show Official’s Affidavits, which were evaluated by the SCI for administrative compliance. The SCI found the affidavits to be lacking and requested that the complaint documentation be resubmitted with all omissions and deficiencies addressed within 5 working days.

5.2 SHOWS

5.2.1. Applications for Second Championship Show

5.2.1.1 Goldfields Kennel Club – 19-21.08.2023

The above Club is requesting to hold a second Show on their regular weekend (19-21.08.2023).

Motivation: To be more cost effective for International Judges.

Approved.

5.2.1.2 Cape Hound Club – 20.10.2023

The above Club is requesting to hold a second Show on their existing show date (20.10.2023).

Motivation: To increase revenue and offer a more worthwhile weekend for Hound exhibitors.

Approved.

5.2.1.3 Northern Areas Terrier Club – 18.11.2023

The above Club is requesting to hold a second Show on their previously approved show date, sharing with Pretoria Kennel Club (18.11.2023).

Motivation: Hosting a second Championship Show in conjunction with two All Breeds Championship Shows would possibly increase entry numbers and would be beneficial to all Clubs involved as well as respective exhibitors in reducing travelling expenses and offering Terrier exhibitors 3 x CC opportunities.

5.2.2 Request to reduce Show Penalties

Schedule 7:

5.2.2.1 Natal Gundog Club – 05.03.2023

The above Club is requesting that their show penalties (R864) be waived/ reduced. The breakdown of penalties is attached, as well as the invoice from the Accounts Department & the Club’s motivation.

The Licence application, fee & schedule were 6 & 7 weeks late.

The Judge’s contracts were 2 & 6 weeks late.

The system generates the penalties according to Schedule 7 for each document.

Request to waive payment of Show penalties was denied. Instead, lenient payment terms offered. Payment of the invoice within 30-days is waived on the proviso the penalty is paid in full prior to the end of current financial year (31 August 2023)

5.2.2.2 SA Ladies Kennel Association – 12.02.2023

The above Club is requesting that their show penalties (R3714 + R6144) be waived/ reduced. The breakdown of penalties is attached, as well as the invoices from the Accounts Department & the Club’s motivation.

The Licence application, fee & schedule were 22, 16 & 9 weeks late.

The Judge’s contracts were 22, 18, 17 & 16 weeks late.

The system generates the penalties according to Schedule 7 for each document.

5.2.2.3 Northern Tshwane Kennel Club – 05.02.2023

The above Club is requesting that their show penalties (R1932 + R3057) be waived/ reduced. The breakdown of penalties is attached, as well as the invoices from the Accounts Department & the Club’s motivation.

The Licence application, fee & schedule were 10 & 11 weeks late.

The Judge’s contracts were 3, 6, 9, 10 & 11 weeks late.

The Show Returns were 1 week late.

The system generates the penalties according to Schedule 7 for each document.

5.2.3 Inconsistent Show Returns

Cape Handlers Dog Club

The above Club held an Open Show on 11 & 18.02.2023 comprising Dog Jumping, Agility, Carting, Rally Dog, Obedience, Flyball & CD.

The Club contracted Mr Barry Levitt to Judge the Flyball on the 18.02.2023, but he suffered a heart attack, and was hospitalised, and was not able to Judge.

The Club then contracted Mr Filip van Roey to Judge the Flyball event. He had already been in contact with the KUSA office as his membership renewal was due on 15.01.2023, and lapsed on 15.02.2023. He had asked for an extension on his membership so that he could Judge Flyball. He also informed the office that he was not renewing his membership as he was emigrating. The Office informed him that it was not possible to extend his Membership.

The Shows Department informed the Club that they need to either cancel the Flyball event, or supply another Judge (email attached), and marked the Flyball Judge as “to be advised” on the Club’s Show Portal. The Club never advised the Office of the new Judge, so the Portal remained as above (screenshot attached).

The event was held on 18.02.2023, and the Flyball went ahead. Photos and videos of the event were posted online by one of the competitors and Mr Filip van Roey can be seen Judging the Flyball (attached).

The Show Return Form was received on 08.03 2023 (attached), and it clearly states that the original Judge, Mr Levitt, was the Judge on the day.

The Shows Department wrote to Mr Levitt and asked if he had Judged the Flyball on this date. He responded that he had not, and that he was, in fact, in hospital. He also stated that he did not sign any Show paperwork (email attached).

The Shows Department requested the signed Judging sheets from the Club. They are yet to arrive.

The Office would like further instruction regarding:

a) The penalty to be imposed, if any, on the Club regarding falsifying the Show Return documents etc.

b) The handling of the Flyball awards that were given out on the day.

c) Any communication required to the lapsed Judge that officiated.

After discussion it was decided that the Club Secretary is to be sent a stern letter of reprimand as the submission of a Show Return Form containing false information is viewed in a very serious light and is considered as conduct that may be viewed as discreditable and dishonest. Further it was decided to impose a fine of R1 000 on the Club and to direct that all Awards granted be withdrawn.

5.2.4 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.4.1 Temporary Exclusion Order – Dobermann – Smooth Criminal Wot a Thriller at Donnehaus (IMP France) – Reg No ZA001170C22

Incident 1 (unconfirmed)

Verbal reports received of an incident which took place at the Kennel Association Championship Show held 25.02.2023 where it was alleged that the above-mentioned dog behaved aggressively by attacking another dog, Donnehaus Dollar Time, Reg No ZA011404B21.

Note: The dog was entered as “Sweet Criminal….” whereas it is registered as “Smooth Criminal….”. The Export pedigree from France also states “Smooth Criminal….”.

The Club was approached for a statement in this regard – see attached.

A visitor from the USA emailed the KUSA office on 09.03.2023 stating they had witnessed the incident and asking about KUSA’s approach to such incidences – see attached (3 documents).

Exco requested the office to contact the Club for further input.

Incident 2

Report received of an incident which took place at the Liesbeek Kennel Club Championship Show held 26.02.2023 where it was reported that the above-mentioned dog behaved aggressively by attacking another dog, Donnehaus Dollar Time, Reg No ZA011404B21.

Note: The dog was entered as “Sweet Criminal….” whereas it is registered as “Smooth Criminal….”. The Export pedigree from France also states “Smooth Criminal….”.

As instructed by the Chairman of Exco a TEO was issued 02.03.2023.

5.2.4.2 Temporary Exclusion Order – Border Collie – Eurofire Amazing Heart – Reg No ZA006923B22

Report received of an incident which took place at the Witwatersrand Corgi Club of Tramordwy Non-Championship Show held 26.02.2023 where it was reported that the above-mentioned dog behaved aggressively by attacking the Ring Steward.

As instructed by the Chairman of Exco, a TEO was issued 06.03.2023

Response received from owner 17.03.2023 and attached to agenda .

TEO confirmed by Exco.

5.2.4.3 Temporary Exclusion Order – Rhodesian Ridgeback – Kleinvalley Stalin – Reg No. ZA002674B20 – following an incident at the Whale Coast Kennel Club Championship Show on 05.03.2022 at which it was reported that the exhibit behaved aggressively by attacking another exhibit - Noordbrook The Red Racer, Reg No ZA037332B14. The injured exhibit required medical attention from the Vet on call.

TEO issued 14/03/2022

A report was received of 2nd incident which took place at Cape Gundog Club (under licence of Liesbeek Kennel Club) Non-Championship Show held 21.05.2022. Letter sent to Miss Zabolotnaya on 02.06.2022 (dated 31.05.2022) informing her of the need to complete Step 1, Step 2 (CGC Silver) and Step 3.

Letter received regarding Step 1. MA to look into whether training as presented in the letter received for Step 1 is sufficient and report back at the next meeting.

MA, having observed the training classes referred to by Mrs Zabolotnaya in her response to Step 1, provided feedback to the rest of the Executive Committee and after discussion it was decided that the training was not sufficient. CPA informed Mrs Zabolotnaya that a 6-week course is to be completed in respect of Step 1 from the list of KUSA approved Clubs.

Mrs Zabolotnaya is now demanding that the TEO be lifted and has contacted her lawyer believing that ‘far too many mistakes have been made’. (see attached.)

Please note that it is over a year since the first TEO was issued. The TEO Manual, clause 14.5 states:

“The Owner of any Implicated Dog, which has been issued with a confirmed TEO, has a maximum period of 12 (twelve) months from the date of the TEO (the date the TEO was confirmed by the Executive Committee) to successfully complete the requirements as provided for in Step 1, 2 and 3 of this Manual, failing which, the Executive Committee will apply to the Federal Council to have the Implicated Dog permanently barred from entry to and exhibition at any future KUSA-licensed Shows/Events subject to compliance with the procedure as provided for in Clause 11.11 hereof.”

Owner to be granted a 3-month extension to comply with the requirements. TEO to remain in place until then.

5. REQUIREMENTS FOR APPLICATION TO HOST

5.1 Any Province applying to host the KUSA Meisterschaft IGP Trial must meet the following requirements:

5.1.1 Proposed Dates: Dates proposed must be between 01.05. and 30.06 of each year.

The above Club is requesting to host the IGP Meisterschaft in August this year. An overseas Judge has been approved. Motivation attached.

5.21 TRICK DOG

February 2023 saw a year since this test was launched and we celebrated by offering our first Speciality title – Birthday. This is a non-titling class which will be offered every 2-3 months with a particular theme; handlers participate for fun. To earn the title, dogs had to perform 10 tricks from any level but the trick had to include a birthday prop and/or theme. We had 38 entries (our biggest class to date) and we were amazed by the creativity of the handlers with some even dressing up for the occasion. We are posting the videos of those that agreed to share on the KUSA Trick Dog Facebook page.

Further to Item 8.2 of the Exco 02-2023 Minutes, the office received a complaint from an additional puppy buyer on 04.03.2023. The couple had previously purchased a dog from Ms Wearne so went back to her when their old dog passed on. They have paid for a puppy and various travel costs but have yet to receive the puppy or any form of refund. They are intending to take legal action .

9.1 Applications for Club Affiliation/Notification of Closure

9.1.1 The South African Mastiff Club of Gauteng has applied for affiliation to KUSA under the DOGS Provincial

Council. The “SAMS” Club has submitted the following documentation in accordance with the Articles:

  • Letter of Sponsorship
  • Proof of bank account

The Club’s affiliation was tabled for acceptance at the DOGSPC Ordinary Meeting held 28.02.2023 where the motion was passed.

9.1.2 Notification of Club Closure

Natal Coast Kennel Club held their AGM on 15.02.2023 where it was agreed to close the Club. It was further agreed that remaining finances were to be donated to the Highway Kennel Club.

10. GENERAL

10.1 Complaint from Chairman of Golden Retriever Club KZN

After discussion it was decided that until such time as sufficient evidence is provided, the Executive Committee considers the matter closed.

10.2 Temporary Exclusion Orders

At the DOGSPC meeting (28.02.2023), the Obedience Sub-Committee reported that they did not feel that the CGC Bronze test was an appropriate test to prescribe for dogs that had been served with a Temporary Exclusion Order (TEO). The Councillor made the point that a test designed by IPO (sic) would be far more appropriate for the purpose. The IGP Sub-Committee expressed the belief that the IGP BH Test could conceivably be adapted for the purpose and undertook to discuss it with her IGP colleagues with a view to finding a solution.

A similar discussion took place at Fedco 12-2022 (Item 13.1):

“A discussion ensued on the suitability of the CGC Bronze Test for the assessment of the temperament/aptitude of dogs under a Temporary Exclusion Order (TEO). It was brought to Fedco’s attention that the appropriateness of using a CGC Test to get a TEO lifted has been the subject of heated debate in the dog world, with some CGC Evaluators openly stating their reluctance to “test” so-called “power breeds” currently under TEOs.

The Chairman cautioned Fedco that the suitability of a CGC Test for purposes of lifting TEOs required a dedicated discussion, once possible alternatives have been investigated. For the moment, Fedco was required to approve the regulatory framework for CGC, a test which served a multitude of useful purposes outside the ambit of the TEO.”

CPA to liaise with SM and MH regarding the matter and report back at the next meeting.
