5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2023

Disciplinary Hearing held on 11.05.2023.

Respondent, Complainants, Clubs and Provincial Councils informed of finding and penalties.

Respondent has until 9 June 2023 to lodge an appeal.

5.1.2 Case 02-2023

Disciplinary Hearing scheduled to be held on 01.06.2023.

5.2.1 Applications for Second Championship Show

5.2.1.1 KZN Staffordshire Bull Terrier Club – 20.10.2023

The above Club is requesting to hold a second Discipline Show on 20.10.2023 in order to join a KZN Bumper weekend for Dogsport.

5.2.1.2 Victory Toy Dog Club – 20.10.2023

The above Club is requesting to hold a second Breed Show on the same day as their Championship Breed Show as per previous years, in order to create a fuller weekend for Toys .

5.2.1.3 Northern Free State Bull Terrier Club – 09.09.2023

The above Club is requesting to hold a second Breed Show as per previous years.

5.2.2 Show Return Penalties (Schedule 08)

5.2.2.1 Eastern Cape Obedience Sub-Committee – 25-26.03.2023

The Sub-Committee is seeking a review and audit on Judges’ contract dates for their joint weekend

(4 clubs).

All documentation attached.

Extenuating circumstances came to light and were taken into account. Penalties pertaining to the Judges’ contracts only were withdrawn .

5.2.2.2 Western Province Boxer Club – 12.03.2023

The Club is requesting that their Non-Championship Show Return Penalties (R1356) be waived.

E-mail attached.

Request to waive payment of Show penalties was denied. Instead, lenient payment terms were offered. Payment of the invoice within 30-days is waived on the proviso the penalty is paid in full prior to the end of current financial year (31 August 2023).

5.2.2.3 Northern Free State Bull Terrier Club – 08.04.2023

The Club is requesting that their Championship Show Return Penalties (R1668) be waived.

5.2.2.4 TT Ad hoc Sub-Committee of the NAPC – 26.03.2023 & 02.02.2023

5.2.4 Entry in contravention of the Regulations:

5.2.4.1 The KUSA Office received an application on 04.04.2023 for the title of Junior Merit for Kissaki’s Winning Edge (ZA007484B22). It was noted that the dog is still registered in the name of the Breeder, and not the Exhibitor as appears on all the certificates. The Exhibitor has been asked to provide proof of a transfer request, but should this not be forthcoming, the Office seeks advice regarding the validity of the awards won at the following Shows:

A Transfer of Ownership Application was submitted to the KUSA Office and the Transfer of Ownership processed on 20.04.2023.

It was decided that all awards won before 20.04.2023 are to be withdrawn NS to inform the relevant Clubs.

5.2.4.2 The Office received a Champion application for Kincora Puff (Reg No. ZA005588B15) which is owned by a Registered Owner / Non-Member. The dog has been correctly entered in the name of the Owner, but the owner is not a Member of KUSA. The member has stated that they were unaware of the Regulation and would be willing to pay retrospective membership. (See attached)

The Office seeks input regarding the validity of the awards and whether or not the Champion title can be awarded.

The Registered Owner of the dog paid the membership fees due. Awards to stand and count towards Champion application.

5.2.4.3 The Office received a Champion and Junior Merit application for Zena Bupepe Iz Moskovskoy Bemty of Boupeep (ZA001097C22).

The Office seeks input regarding the validity of the awards and whether or not either title can be awarded .

After discussionit was decided that all awards won are to be withdrawn NS to inform the relevant Clubs.

5.2.5 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.5.1 Temporary Exclusion Order – Dobermann – Smooth Criminal Wot a Thriller at Donnehaus (IMP France) – Reg No ZA001170C22

Incident 1 (unconfirmed)

Verbal reports received of an incident which took place at the Kennel Association Championship Show held 25.02.2023 where it was alleged that the above-mentioned dog behaved aggressively by attacking another dog, Donnehaus Dollar Time, Reg No ZA011404B21.

The Club was approached for a statement in this regard – see attached. Following a decision at Exco 03-23, the Club was again asked for a statement but as of 11.04.2023, had not received a reply.

Incident 2

Report received of an incident which took place at the Liesbeek Kennel Club Championship Show held 26.02.2023 where it was reported that the above-mentioned dog behaved aggressively by attacking another dog, Donnehaus Dollar Time, Reg No ZA011404B21.

TEO issued 02.03.2023 and confirmed on 22.03.2023.

The Ring Steward was asked to provide her statement in the form of an affidavit (see attached).

The KUSA Office received a letter from Millar & Reardon Attorneys on behalf of the owner contesting the validity of the TEO. Following discussions with N du Preez, the Office responded to the attorneys stating that TEO would stand.

TEO lifted 18.04.2023 and the Owner informed together with all KUSA-affiliated Clubs.

Noted.

5.2.5.2 Temporary Exclusion Order – Rhodesian Ridgeback – Kleinvalley Stalin – Reg No. ZA002674B20 – following an incident at the Whale Coast Kennel Club Championship Show on 05.03.2022 at which it was reported that the exhibit behaved aggressively by attacking another exhibit - Noordbrook The Red Racer, Reg No ZA037332B14. The injured exhibit required medical attention from the Vet on call.

TEO issued 14.03.20.

At Exco 03-23, it was ruled that the Owner be granted a 3-month extension to comply with the requirements and that the TEO remain in place.

The Owner contacted the Western Cape Provincial Council to have the dog assessed by two Hound Judges at the Malmesbury Shows held on 21-22.04.2023 and 23.04.2023.

Having fulfilled the Exco requirements placed on the dog, application is now sought for the lifting of the TEO. (See attached)

TEO lifted 18.04.2023 and the Owner informed together with all KUSA-affiliated Clubs.

5.2.5.3 Temporary Exclusion Order – American Akita – Zabush Zeus – Reg No ZA011567B19

Report received of an incident which took place at Goldfields Supporters Club of Northern Gauteng held 10.07.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking two French Bulldogs (“Trouvallia Storm at Edmondo” and “Edmondo Show Stopper”).

TEO issued.

The Owner has provided a certificate of completion (all dogs in the mentioned class gain a mark of 100%)

TEO lifted 18.04.2023 and the Owner informed together with all KUSA-affiliated Clubs.

Noted.

5.2.5.4 Swartland and West Coast Kennel Clubs Championship Show held 21-23.04.2023.

An alleged Incident of aggression took place at the abovementioned Show(s) where it was reported that a Bullmastiff acted aggressively towards a Bearded Collie – it is not clear at which of the Shows the incident took place. The Club(s) contacted the Chairman of Exco to request an extension on 01.05.2023 (within time) for the submission of the requisite report. An extension was granted until 08.05.2023. The Exco Chairman was cc’d on an email dated 05.05.2023 from the Club Chairman to the owner of the aggressor stating that the Club would like to withdraw the report. This decision has been questioned by the owner of the Bearded Collie. (See attached).

TEO to be issued. CPA to request the relevant documentation from the Club.

5.2.5.5 Herding Club of the Eastern Cape Non-Championship Show held 06.05.2023.

When submitting their Show Returns, the Club reported that an Incident had taken place at the Show involving a Border Collie. The Show Manager, Judge (and Chairman of the Club) and Vice-Chairman agreed that in terms of clause 8.3 of the TEO Manual, there was “insufficient cause to declare the occurrence as an incident”. The Club reported the Incident should the same dog be involved in a transgression at a later stage. (See attached)

5.2.5.6 Temporary Exclusion Order – Australian Shepherd – Limited Kascaro of Modailene – Reg No. ZA001023C22

The Office received a report of an alleged incident of aggression that occurred at Swartland Kennel Club Championship Show on 21.04.2023. The Club has submitted the relevant information but the Office is following up to secure the documentation in the correct format.

The application for the WT and WUD KUSA National event has been received and is being processed.

5.2.7.6 Agility and Dog Jumping Nationals 2024

The NAPC would like to apply for the Agility and Dog Jumping Nationals for 2024 to be held in conjunction with the NAPC Bumper Weekend on the weekend of the 27– 30.04.2024.

5.4.1 Article 25.2 Judges shall maintain continuous and unbroken membership of the Kennel Union from the time their formal studies or activities towards a judging qualification commence until their voluntary retirement from judging, advised in writing to the Executive Committee, or their incapacitation (at the discretion of the Executive Committee), or their death.

April 2023 will see a new ‘first’ for Trick Dog – a litter of 7 Border Collie pups have all submitted videos for the Trick Dog Elementary title. We are eagerly waiting for the feedback on their performances.

The total number of classes entered to date is 501. While Border Collies still dominate in terms of levels completed, other breeds, e.g. Shetland Sheepdogs, GSDss, Labradors etc. outnumber Border Collies.

Of the dogs that have taken part, 56% are registered with KUSA and 48% of the handlers are KUSA members. This number has grown from only 40% of handlers being KUSA members during the first few months of Trick Dog starting.

9.1 Applications for Club Affiliation/Notification of Closure

9.1.1 Notification of Club Closure

Natal Coast Kennel Club held their AGM on 15.02.2023 where it was agreed to close the Club. It was further agreed that remaining finances were to be donated to the Highway Kennel Club.

However, the office noted some apparent irregularities in the financial statements for financial years ending 2021 and 2022. These have been discussed with KZN Provincial Council Chairman Michael Vorster who has agreed to investigate further.

MH to liaise with KZN Provincial Council Chairman – Mr M Vorster and report back at the next Exco meeting. See attached response from the Club.

Natal Coast Kennel Club have submitted revised financials for 2021 and 2022. (See attached)

The revised Financials submitted did not meet requirements.

9.1.2 Bearded Collie Club of Gauteng will be hosting their AGM on 28.05.2023 and have included an item to dissolve the Club. (See attached)

MA reported that the reason for the decision to dissolve the club was due to lack of support at KUSA Events. BJ proposed that MA suggest that the Club be changed to a Herding Club. MA to propose this suggestion at the next AGM and report back on the final decision.

9.1.3 Club Affiliation

Objection to new Club - Working Weimaraner Club

The KUSA Office received notification of a possible new Club forming on 28.03.2023. The Club provided details of their new Committee and a Letter of Support and requested a Constitution be drafted for them. The Club had consulted with DOGSPC regarding the process to form a Club and had also been in touch with the Field Trial Liaison Council.

Subsequently, objections were received from The Weimaraner Klub on 20.04.2023 and 10.05.2023. (See attached)

CPA to draft a letter offering that BJ act as intermediary to mediate between the two parties .

9.1.4 Club Disaffiliations

Central Field Trial Club

The KUSA Office received a letter from the Central Field Trial Club on 14.04.2023 stating their intention to disaffiliate with immediate effect. No reason was given, and no response has been received to an email enquiring why. (See attached )

Noted. CP to request NdP follows up on the reasons for the decision to disaffiliate.

9.4.1 The Breeder petitions the Executive Committee to rule on the registration of an additional puppy to a litter already registered in terms of Schedule 4.10.

The Breeder submitted the registration application on which only one (1) puppy was recorded. Request to register two additional puppies to the one pup litter already registered.

Not approved. DNA comparison to the registered litter mate to be done to confirm parentage. Fees set at puppies older than 12 months including Rottweiler levy.

9.7.4 Regulation 12.5. Litters whelped by Dam older than 8 years of age– Nil.

10. GENERAL

10.1 Wrong dog taken into ring.

The Office was informed of an incident that took place at the Eastern Districts Kennel Club Championship Show (Show 2) on Sunday 30.04.2023 in respect of the judging of the Utility Veteran Group.

An exhibit (Catalogue 223) was awarded RBOB and Best Veteran in Breed. When the Utility Group Veteran Class was judged, the Handler took the incorrect dog into the ring but displayed the correct catalogue number. The ‘incorrect’ dog was awarded Best Veteran in Group. Upon noticing the error (it is not clear how the error was discovered), the Class was rejudged with the actual exhibit in the ring. Best Veteran in Group was then awarded to the replacement dog. Only one placing was made.

The process that was followed has been queried  by a fellow exhibitor as to whether or notthe Class can be rejudged and if should there be any penalty for the Handler taking the incorrect dog into the ring for Judging? (See attached). Schedule 03 is silent on this matter.

After discussion it was agreed that the awards are to remain in place as this was a bona fide error.

Schedule 3 Regulations are silent on what procedure to follow in such an instance. Exco to review the Regulations and submit a proposal for consideration at the Fedco 12-2023 meeting if deemed necessary.

10.2 MH provided some feedback on the use KUSA logo on Scam sites. MH to forward a letter to PM for possible posting on the KUSA website.

10.3 CPA advised that she was contacted by Fourpaws who are wanting to take action against a scam site called Doggieshome who are using the Fourpaws and KUSA logo and wanted to know whether KUSA would consider taking joint action.

CPA to ask Fourpaws to forward their proposal for Exco to consider.
