THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY, 27 SEPTEMBER 2022, VIA MS TEAMS

1. ATTENDANCE, APOLOGIES & ANNOUNCEMENTS

Due to technical difficulties Mr RB Jenkins (Exco Chairman) was unable to Chair the full meeting. Mrs YC Jeffries (Vice-Chairman) was called on to Chair the meeting from item 5.2.4.3 onwards.

Th e Minutes of the meeting held on 16.08.2022 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Entry in contravention of the regulations (Exco 08-22 Item 5.2.2)

Member no 123803 was sent a letter requesting him to renew his membership – 17.08.2022

As of 12.09.2022, his membership had not been renewed. His renewal date was 15.02.2022. The member has since renewed his membership.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 06-2021 de Haaff v Lucas.

Disciplinary Hearing took place 28.04.2022.

Complainant & Respondent were informed of the Finding – 25.05.2022.

Defendant requested one month extension to lodge appeal.

Extension was granted by SCI until 15.07.2022.

Appeal was lodged by Appellant on 15.07.2022.

Respondent (de Haaff) given 14 working days to respond.

Fedco Appeals Committee (FAC) considered the Appeal on 07.09.2022.

Chairman of the FAC has 14 working days to submit the Minutes, after which the KUSA Secretary must inform Fedco, the Appellant, the Respondent and Exco of the outcome .

5.1.2 Case 02-2022 KUSA(Africa) vs AM Pillay

Disciplinary Hearing took place 17.08.2022

Exco considered the record of proceedings via round robin vote on 01.09.2022

Complainant & Respondent were informed of the Finding on 02.09.2022

Finding:

After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision, on a balance of probabilities, with regards to the case before them:

The DSC found that the complaint was fully substantiated and found that the Respondent wilfully engaged in conduct of discreditable and/or improper and/or dishonourable and/or disgraceful conduct at a KUSA Show which conduct was prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith and subsequently found the Respondent guilty .

Penalties:

The DSC imposed the following on the Respondent as per Rule 11.1.1 and Rule 11.1.2 of Schedule 1:

Rule 11.1.1 of Schedule 1, “Permanent or periodic expulsion, or exclusion or suspension, from membership of KUSA and of any Club”.

Rule 11.1.2 of Schedule 1, “taking part in, or having any connection with, or attending or participating or handling a dog at, a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence…”.

The Respondent, Mr Pillay, will be excluded from taking part in, or having any connecting with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence for a period of six (6) months, commencing on 01.09.2022.

This sentence will be suspended for a period of three (3) years.

The three (3) year suspension will end on 31.08.2025, provided the Respondent does not contravene any of the provisions as provided for in Rule 4 of Schedule 1 or any other provision in the KUSA Constitution, Rules and Regulations that would form the basis for a valid complaint in terms thereof during the period of suspension.

The Respondent has 15 working days within which to lodge an Appeal (by 23.09.2022)

5.1.3 Case 03-22 KUSA (Agility Committees) vs K Livingstone.

The SCI have ruled that there are sufficient grounds to lodge a Complaint.

The Respondent has been given an extension of time until the 15 September 2022 to submit her responding Affidavit and supporting evidence.

The SCI is thereafter to determine if there are sufficient grounds to proceed to a Disciplinary Hearing.

5.2 SHOWS

5.2.1. Applications for Second Championship Show

5.2.1.1 George & Outeniqua Kennel Clubs – 09-11 June 2023

The above clubs are requesting to hold their second Championship Shows on the weekend of 09 - 11.06 2023.

Motivation: This supports at least another 4 CCs or Grand Championship points for Exhibitors and allows us the affordability to offer 2 overseas Judges over the weekend and 2 local All-Breeds Judges.

5.2.1.2 Western Province Bull Terrier Club – 15.10 2022.

Approved by Round robin.

Ratified.

5.2.1.3 Limpopo Bull Terrier Club – 22 July 2023

The above club is requesting to hold their second Championship Show on 22 July 2023, along with their usual Championship Show.

Motivation: The club prefers to hold 2 shows on the same day, to make the event worthwhile for exhibitors travelling from other provinces. Holding 2 back-to-back shows also means that the committee only needs to organize 1 event for the year, as opposed to 2 individual events throughout the year.

5.2.1.4 Australian Shepherd Club of the WC – 23.10.2022

The above club is requesting to hold their second Championship Show on 23 October 2022, together with the Cape Town Cluster of shows. This was their original date.

Motivation: We would like to have a second championship show for the Australian Shepherd Club Western Cape, We have great news to have an international Judge, Jeff Horswell. Having a second show in Cape Town does promote our breed and we hope with the international Judge to draw more entries. The show is held on the same weekend as Western Province and Hottentots Holland Kennel Club Shows which we also hope will assist in drawing more entries from other provinces as the exhibitors will have more shows to travel for.

5.2.2 Show held contrary to the regulations

5.2.2.1 Boxer Club – Gold Reef – 14.08.2022

The above club held a Non-Championship show on 14 August without a licence. The office was alerted to this fact when the club submitted their show returns after the Show. This seems to be a misunderstanding on the part of the Club while changing Club Committees. The applications and payment for all their 2022 shows were made in 2021, but no Show documents, contracts, schedule, etc. were received by the KUSA office.

The following regulations were not adhered to:

Schedule 4

2.1 Every application for a licence to hold a Non-Championship Show or Match Meeting shall be made not less than three (3) calendar months before the proposed date, on an official Kennel Union form, signed on behalf of the applicant by the Chairman, Treasurer and Secretary, who shall give their full addresses, setting out the information required therein, and such application shall be accompanied by a draft schedule of the show, signed contracts from each prospective Judge and the fee prescribed in terms of Schedule 7.

2.4 No Club shall be permitted to hold a Non-Championship show without having obtained a Kennel Union Licence therefor.

3.4 Notwithstanding and in addition to the provisions of the Disciplinary Rules in Schedule 1, the Executive Committee shall have power to impose a fine upon any Club, the officers or members of which have in the course of conducting a show breached these Regulations

6. Show Schedule:

It shall be obligatory to provide a Show Schedule, which shall display the KUSA logo in a format, version and size specified by the Kennel Union Office for any Licensed Non-Championship Show.

4. NON-CHAMPIONSHIP SHOWS LATEST TIME REQUIRED

4.1 Application for Non-Championship Show Licence, 3 months before Show date

Draft Schedule and signed contracts from proposed Show Judge/s.

4.2 Non-Championship Show Licence fee as per Schedule 7 3 months before Show date

4.3 Return of Non-Championship Show Judges, giving names and addresses of each Judge and Breeds/Groups/Events and numbers of exhibits15 working days after completion of Show judged by each Judge and entry fees for each dog entered as per Schedule 7.

The KUSA Office requires a decision regarding the Club’s penalty/fine.

KUSA Office to send the Club a letter of warning.

5.2.2.2 Entry in contravention of the Regulations:

East London Kennel Club – 30.06.2022

It came to our attention that a dog that was owned by a Judge was entered on the same day, at the same venue, that the Judge was officiating.

The registered owner was judging at the same time for Queenstown & Districts Kennel Club (1) on the same grounds in Stutterheim.

Schedule 3:

7.10.1 A Judge may not enter a dog registered in his ownership in the same discipline on the same day at the same venue as he is officiating, save and except for Working Disciplines held under the licence of a

different Club. Automatic disqualification of the dog(s) will apply and the Judge will be liable for disciplinary action under Schedule 1.

33. FINE AND PENALTIES

33.1 If a dog is entered in a class for which it is ineligible and it is not withdrawn from competition therein, or rectified by the Show Office before such class is judged, such dog shall be disqualified and the exhibitor may be fined at the discretion of the Executive Committee.

It is to be noted that these shows were originally over 3 days, and the club reduced the duration of the weekend to 2 days.

The dog was awarded Best Veteran, dog CC, and Best of Breed. Only one other Collie was shown, a bitch that was awarded bitch CC and Reserve Best of Breed.

Complaint from the owner of the Collie bitch attached.

The KUSA Office requires a decision regarding the removal of awards and any penalty for the Judge.

Awards to be withdrawn.

5.2.3 Show Calendar

The 2022 & 2023 Show calendars continue to be updated daily, and uploaded weekly.

5.2.4 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.4.1 Temporary Exclusion Order – American Akita – Zabush Zeus – Reg No ZA011567B19

Report received of an incident which took place at Goldfields Supporters Club of Northern Gauteng held 10.07.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking two French Bulldogs (“Trouvallia Storm at Edmondo” and “Edmondo Show Stopper”).

Letter of appeal submitted by the owner of the two American Akitas involved in the incident.

TEO issued. The owners to liaise with each other regarding remuneration of Vet Bills.

Documents not legible and must be reissued.

No further documents received from the owner

NdP to provide the office with his report on the incident. Legible copies of documents to be requested again.

5.2.4.2 Temporary Exclusion Order – American Akita – Undercover Lover del Casa di Coniglio – Reg No ZA001150C21

Report received of an incident which took place at Working & Herding Breeds Association Golden Reef held 14.08.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking a Giant Schnauzer (“Ch Gently Born Take My Heart, JM”).

The Club has submitted its report but are waiting for affidavits from the witnesses.

5.2.4.3 Temporary Exclusion Order – Bulldog – Imfires Im’ Bismark – Reg No ZA010738B20.

Report received of an incident that took place at Northern Free State Kennel Club Championship Show held 26.08.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking another Bulldog (“Kimoya Raise Me Up at Touromosso”).

The Club has submitted its report (see attached) and the owner and handler of the Bulldog have submitted statements (see attached).

TEO issued NdP to provide clarity on whether the CC award is to be withdrawn.

5.2.4.4 Temporary Exclusion Order – American Akita – Lalisa Manoban Iz Alekona of Zabush – Reg No ZA001078C21

9.1 Applications for Club Affiliation/Notification of Closure

9.1.1 SA Rhodesian Ridgeback Club

There is interest in reviving this club following its disaffiliation by Fedco 06-2022. A draft Constitution has been sent to them for consideration.

Noted . CPA advised that consideration is being given to either reinstating the Club or started a new Club.

No update received.

9.1.2 North Star GSD Club

This Club initiated affiliation in late 2020. An affiliation meeting was held on 21.11.2020 with a view “To constitute a German Shepherd Dog (GSD) training club affiliated to KUSA, that will promote the breed and training of the German Shepherd Dog, but that will also welcome all other breeds.”

A Constitution was drafted at the time listing the Club as belonging to the Western Cape Provincial Council.

The Club enquired about the payment of affiliation fees on 23.08.22 but nothing has been received as yet.

Carried forward. MA advised that the club would need to be approved by the WC Provincial Council. CPA to forward all information to the WCPC.

9.1.3 Kaffrarian Hound Association

A decision was taken at a Special General Meeting held on 30.08.2022 that the club would be closed as it was running at a loss. The Club will advise shortly regarding the distribution of funds. See attached Minutes of SGM.

Noted. It was agreed that the closing down of the Club is approved, as per the minutes of the SGM. No funds exist as the Club has been running at a loss

9.1.4 Quinera Working & Herding Breeds Club

A decision was taken at a Special General Meeting held on 30.08 2022 that the club would be closed as it was running at a loss. The Club will advise shortly regarding the distribution of funds. See attached Minutes of SGM.

9.1.5 Queenstown & Districts Kennel Club

A suggestion was made at the Special General Meeting held on 30.08.2022 to rename Queenstown & Districts Kennel Club as Kaffrarian & Quinera Kennel Club. See attached Minutes of SGM.

9.1.6 East Coast Hound Club

The office was informed in an email on 20.09.2022 that the Club would not be paying its affiliation fees and intended to close and transfer their funds to Natal Sporting Hound Association. The office has informed them that, in terms of their Constitution, they need to call a Special General Meeting to formalise such a decision. This is now underway.

10. GENERAL

10.1 Puppy Scams

Neither Joyful Corner, nor Akim Bulldogs, have removed the KUSA logo from their website as yet. Nico du Preez has advised that:

“As KUSA have no legitimate investigative powers or any mechanism to regulate the use of our registered logos, the only way to deal with such is to submit a formal criminal complaint with the SAPS.

In order to proceed with this, the matter needs to be placed on the EXCO agenda for discussion and a possible decision to registered a formal complaint with SAPS.”

MA suggested that a procedure be put in place for Clubs who do not report incidents of aggression at Shows. After discussion it was felt that the Clubs found the procedure to be a laborious task. YJ suggested that the forms be completed and submitted to BJ for approval. All parties to complete a legible report and have the report correctly certified by a Commissioner of Oaths and submit to the Club thereafter. BJ advised that Exco members to report back on their thoughts on the matter at the Exco 09 meeting.

CPA brought raised the matter on the validity of a Sworn affidavit and what is deemed acceptable. CPA suggested that a template be drafted on what is acceptable as a Sworn affidavit.

Draft affidavit prepared for circulation to Clubs. Also available on the website under Secretarial documents.

KUSA Office to send both websites another cease and desist letter.

On the matter on dog aggression, it was suggested that all Exco members provide suggestions at the Exco 10-22 meeting for discussion. MA suggested that the procedure the report incidents of aggression be simplified.

10.2 Member advert – Burenwag Golden Retrievers

A complaint was received from Arnel Sauer on 26.07.2022 asking why members who register with other registries are allowed to advertise on the Member Advert section of the website. Upon investigation, it was found that Burenwag kennels were listed as advertising under Golden Retrievers. This advert had inadvertently slipped through and was unpublished on 08.09.22.

Advertisements for Burenwag kennels were discussed at Exco 02-2020 where it was noted that:

We bring to the attention of Exco an advert published on the KUSA website in October 2019 and linked to the member’s personal website on which it is advertised that they register their litters with other dissident registries.

Breeds bred and sold:

Golden Retrievers which are KUSA registered

Yorkshire Terriers which are registered with GEAR (Global Exotic Animal Registry)

French Bulldogs which we suspect are registered with SACBR (South African Canine Breed Registry)

After discussion it was agreed that the member be advised that, as she is acting in contravention of the Code of Ethics, the advertisement will be withdrawn.

Mrs van Buuren stopped advertising but then in June 2022 re-applied and paid for a 6-month period. Following the complaint by Ms Sauer, the advert was unpublished on 08.09.22.

In addition, complaints were received from members of the public on the following dates:

  • 27.07.2022 – Person bought a Golden Retriever puppy from Mrs van Buuren; contract signed and paid R15000. Was first told pup available then the litter died and they must wait for next litter. New owner signed contract but breeder did not sign; advised to initiate legal proceedings.
  • 23.06.2022 – Mrs van Buuren does not want to register Golden Retriever; told new owner to register her dog with SA Canine Registry and pay for it herself. New owner really wants dog registered with KUSA. Advised her to discuss this with breeder.

After discussion it has been advised that the advert is to be removed.

10.3 Dotsure

Dotsure is planning on holding regular (possibly quarterly) webinars that are of interest to our members. The first webinar is planned for 19 October and the speaker is currently being secured.
