THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY, 16 AUGUST 2022, VIA MS TEAMS

3.2 Miss Zabolotnaya was informed of suitable training clubs for her TEO dog. (Exco 07-22 Item 5.2.5.1)

3.3 A cease and desist letter was sent to Akim Bulldogs on 05.08.2022 but the logo has not yet been removed from their website. (Exco 07-22 Item 10.1)

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

 5.1.1 Case 06-2021 de Haaff v Lucas.

Disciplinary Hearing took place 28.04.2022.

Complainant & Respondent were informed of the Finding – 25.05.2022.

Defendant requested one month extension to lodge appeal.

Extension was granted by SCI until 15.07.2022.

Appeal was lodged by Appellant on 15.07.2022.

Respondent (de Haaff) given 14 working days to respond.

Fedco Chairman has been requested to appoint a Fedco Appeals Committee (FAC).

5.1.2 Case 01-2022 KUSA(Gallant) vs Myburgh & Kneidinger

Case has been finalised.

Disciplinary Hearing took place on 29.06.2022.

Exco round robin vote – Exco confirmation of record of proceedings – 13.07.2022.

Finding letter sent to Complainant & Respondents – 14.07.2022.

Exco confirmation of record of proceedings – Exco 07-2022 on 19.07.2022.

Respondent had 15 working days to lodge an Appeal.

No Appeal was lodged.

Findings:

The DSC considered all the evidence presented on the papers, including the said admission of Ms Kneidinger. The DSC found the following in terms of the Respondents:

The Respondent Kneidinger made an admission to the Complaint levelled against her in her response in explanation of her conduct. In the absence of evidence to the contrary, it is accepted that these admissions were made freely and voluntarily.

1) Mr F Myburgh

Mr Myburgh was charged with infringements in terms of Schedule 1 Rules 2.3 read with Rule 3.1, Schedule 3 Regulation 37.1 and 37.3, Schedule 9 Regulations 1.2, 1.3, 5.1, 5.3, 5.16, 5.17, 5.18, and 5.22, Schedule 1 Rules 4.1.1, 4.1.1.4, 4.1.6 and Schedule 05 B(02) Regulations 2.3.2 and 3.1, and was found not guilty.

2) Miss C Kneidinger

Miss Kneidinger was charged with infringements in terms of Schedule 1 Rules 2.3 read with Rule 3.1, Schedule 3 Regulation 37.1 and 37.3, Schedule 9 Regulations 1.2, 1.3, 5.1, 5.3 , 5.16, 5.17, 5.18, and 5.22, Schedule 1 Rules 4.1.1, 4.1.1.4, 4.1.3, 4.1.6, Schedule 3 Regulation 37.3 and Schedule 05 B(02) Regulations 2.3.2, 3.1 and 3.7 and was found guilty.

Penalties:

The DSC imposed the following on the Respondent.

In terms of Rule 11.1.7 of Schedule 1 the Respondent Miss Kneidinger will be provided a reprimand and warning.

5.1.3 Case 02-2022 KUSA(Africa) vs AM Pillay

The SCI of inquiry is of the opinion that there are sufficient grounds to proceed to a Disciplinary Hearing.

The Chairman of Exco has appointed members of a Disciplinary Sub-Committee to hear the Complaint.

The Disciplinary Hearing is scheduled to take place on 17.08.2022 .

5.1.4 Case 03-2022

Complaint lodged 11 July 2022.

SCI to evaluate the Complaint and decide whether there are grounds to proceed.

5.2 SHOWS

5.2.1. Applications for Second Championship Show

5.2.1.1  Witwatersrand Corgi Club Tramordwy – 19 November 2022

The above club is requesting to hold a second Championship Show on 19 November.

Motivation: There has been much debate in prior years as what would be the best time of year to host the club’s Championship Show. The only way to properly address this issue would be to host a show during the summer months and then to compare the results. A further matter to consider when hosting a speciality show is funding and sponsorship. The club has been offered assistance in both funding and sponsorship which has prompted this request. Motivation attached .

5.2.1.2  Western Gauteng Kennel Club – 14 July 2023

The above club is requesting to hold a second Championship Show on 14.07.2023, on the same weekend as their Championship Show (1), at the PetExpo.

Motivation: The organisers of the PetExpo want to increase the size of the event and have requested that more shows be held. The club has submitted an application and payment for the second show. Motivation attached.

5.2.1.3  Swartland Kennel Club – 21 April 2023

The above club is requesting to hold a second Championship Show on 21 April next year on their usual cluster show weekend date.

Motivation: The Swartland /West Coast KCs have gained a reputation for presenting well-organised, enjoyable shows in Malmesbury and, by being permitted to hold an FCI International Show plus three Championship Shows, makes our show weekend a viable option for travelling exhibitors and also offers an opportunity for infrequent-travelling Cape exhibitors to make up International Champions. As a country show, we would be unable to sustain our shows without outside entries, so we are sure that you will appreciate how valuable this allowance is for us. Motivation attached.

5.2.1.4  Northern Areas Terrier Club – 19 November 2022

The above club is requesting to hold a second Championship Show on 19 November 2022 in conjunction with Pretoria Kennel Club.

Motivation: Hosting a second Championship Show in conjunction with two All-breeds Championship Shows would possibly increase entry numbers and would be beneficial to all Clubs involved, as well as to respective exhibitors in reducing travelling expenses and offering Terrier exhibitors 3 CC opportunities.

Motivation attached, as well as approval from Pretoria Kennel Club.

Approved.

5.2.2.1 Dog entered contrary to the Regulations

The owner applied for Champion status for her American Staffordshire Bull Terrier Aztrazar Helen of Troy (ZA007561B20). The owner submitted proof of nine Challenge Certificates earned between 20.03.2021 to 13.02.2022. However, the dog was entered under the name of owner and not the name of the breeder. Transfer into the owner’s name only took place on 23.06.2022.

The owner is appealing for leniency in this matter given that she is new to the Show world (qualifications and letter attached).

Awards to be withdrawn.

5.2.1.2 Entry in contravention of the Regulations:

It has come to the attention of the KUSA Office that lapsed Member No 123803 entered a dog (Staffordshire Bull Terrier) in his registered ownership into the two aforementioned Championship Shows.

7. ENTRY FOR EXHIBITION

Except as otherwise provided in the By-Laws applicable to a particular Discipline, only Members of the Kennel Union shall be entitled to enter and have dogs in their registered ownership compete in any Championship Dog Show, Championship Obedience Class, Championship Working Trial, Field Trial Championship Open Stake or Field Qualifier or any other Championship event, licensed by the Kennel Union, save for Breed Classes offered at Specialist Club Championship Shows, where entries will also be open to non-members’ dogs, with the exception of dogs in the registered ownership of persons on whom persona non grata status has been imposed, such dogs not being eligible for exhibition at any KUSA-licensed event

This member’s membership lapsed on 15 February 2022.

He had been notified of the regulations at a previous membership lapse on 26 February 2021.

He did not win any awards at the above Shows.

KUSA Office to send a letter advising the member of the transgression and that membership is to be reinstated before entering dogs in future.

5.2.3 Show Calendar

The 2022 Show Calendar continues to be updated daily, and uploaded weekly. The 2023 Show Calendar has been added to the KUSA site, and is being updated & uploaded weekly as well.

5.2.4 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.4.1 Temporary Exclusion Order – Rhodesian Ridgeback – Kleinvalley Stalin – Reg No. ZA002674B20 – Report received of 2nd incident which took place at Cape Gundog Club (under licence of Liesbeek Kennel Club) Non-Championship Show held 21.05.2022. Letter sent to Miss Zabolotnaya on 02.06.2022 (dated 31.05.2022) informing her of the need to complete Step 1, Step 2 (CGC Silver) and Step 3.

Letter received regarding Step 1. MA to look into whether training as presented in the letter received for Step 1 is sufficient and report back at the next meeting.

MA, having observed the training classes referred to by Mrs Zabolotnaya in her response to Step 1, provided feedback to the rest of the Executive Committee and, after discussion, it was decided that the training proved was not sufficient. CPA informed Mrs Zabolotnaya that a six-week course needs to be completed in respect of Step 1 from the list of KUSA-approved clubs.

5.2.4.2 Temporary Exclusion Order – American Akita – Zabush Zeus – Reg No ZA011567B19

Report received of an incident which took place at Goldfields Supporters Club of Northern Gauteng held 10.07.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking two French Bulldogs (“Trouvallia Storm at Edmondo” and “Edmondo Show Stopper”).

Letter of appeal submitted by the owner of the two American Akitas involved in the incident.

TEO issued. The owners to liaise with each other regarding remuneration of Vet Bills.

Documents not legible and must be reissued .

5.2.4.3 Temporary Exclusion Order – American Akita – Undercover Lover del Casa di Coniglio – Reg No ZA001150C21

Report received of an incident which took place at Working & Herding Breeds Association Golden Reef held 14.08.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking a Giant Schnauzer (“Ch Gently Born Take My Heart, JM”).

The club has submitted its report, but were waiting for affidavits from the witnesses.

There is interest in reviving this club following its disaffiliation by Fedco 06-2022. A draft Constitution has been sent for Club members’ consideration.

Below please find an extract from the Fedco 06-21 Minutes in respect to the above:

Inter-variety Breeding of Belgian Shepherd Dogs (Fedco 12-2020 item 8.4 )

Note: Carried forward from Fedco 12-2020. The following ruling was made at Fedco 12-2020: Given the fact that Inter-variety Breeding of Belgian Shepherd Dogs was permissible in a number of FCI member-countries under certain circumstances, the Highveld Belgian Shepherd Dog Club had requested Fedco to explore the possibility of permitting it in South Africa between those varieties identified by the FCI, under strict conditions. The latter would include an assessment and adjudication of the intended breeding on submission of pedigrees and motivations, as well as compliance with Health and temperament requirements. After interrogation, Fedco concluded that the shortage of bloodlines in South Africa, across all four varieties, made Inter-variety Breeding an appealing option, but that the onerous requirements currently envisaged by the Belgian Shepherd Dog fraternity might defeat viability. Moreover, with the required Health requirements for an Advanced Registration Certificate still to be identified, it would be difficult for Fedco to consent to Inter-variety Breeding at this stage. Fedco invited the Belgian Shepherd Dog fraternity to revert with a formal proposal for Fedco 06-2021 which was not only simplified, but also vastly improved in practicability, with the Health Test requirements covered. Proposed RJ, seconded CI Approved, unanimously.

To assist Fedco in considering this proposal and reaching a sensible conclusion, CI had distributed an extremely useful article, Changes to Inter-variety Breeding of the Belgian Shepherd Dog in Australia, by Kathryn Winton, which not only focussed on the Australian experience in implementing inter-variety breeding of Belgian Shepherd Dogs, but also on the established practices in several foreign countries.

In the South African context, this article lent a fresh perspective to the salutary objectives of inter-variety breeding of Belgian Shepherd Dogs and how these objectives might be successfully accomplished through collaboration with the Specialist Breed Clubs, and KUSA. It was accordingly resolved, unanimously, that the South African breeders of Belgian Shepherd Dogs, in conjunction with their Clubs, should be given the opportunity to implement inter-variety breeding in accordance with their tabled proposal.

10. GENERAL

10.1 Akim Bulldogs

The office received notification by a member of the public who had attempted to purchase a puppy from this website that they had been scammed. The website bears the KUSA logo. A cease and desist letter was sent on 05.08.2022.

KUSA Office to liaise with NdP on the next step should a response not be received and actioned. BJ requested that CPA write to the Fedco Chairman for feedback on the matter.

10.2 MA suggested that a procedure be put in place for Clubs that do not report incidents of aggression at Shows. After discussion, it was felt that the Clubs found the procedure to be a laborious task. YJ suggested that the forms be completed and submitted to BJ for approval. All parties to complete a legible report and have the report correctly certified by a Commissioner of Oaths and submit to the Club thereafter. BJ advised that Exco members to report back on their thoughts on the matter at the Exco 09 meeting .

10.3 CPA raised the matter on the validity of an affidavit and what is deemed acceptable. CPA suggested that a template be drafted on what is acceptable as an affidavit .
