THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY, 19 JULY 2022, VIA MS TEAMS

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

Below please find the status of Disciplinary Cases:

Case 2021-06 de Haaff v Lucas .

Disciplinary Hearing took place 28.04.2022.

Complainant & Respondent informed of the Finding.

Defendant requested one month extension to lodge appeal.

Extension was granted by SCI until 15.07.2022

Case 01-2022 KUSA(Gallant) vs Myburgh & Kneidinger

Disciplinary Hearing took place on 29.06.2022.

Exco round robin vote – Exco confirmation of record of proceedings – 13.07.2022

Finding letter sent to Complainant & Respondents – Date 14.07.22

Respondent has 15 working days thereafter to lodge an Appeal .

Case 02-2022 KUSA(Africa) vs AM Pillay

72 Page Affidavit received from Respondent.

Acting KUSA Secretary required to submit an answering Affidavit to the Respondent.

The SCI have granted the Acting KUSA Secretary an extension of time to acquire further information relevant to the complaint in order to prepare the answering Affidavit as permitted by

Schedule 1 Rule 6,2.

Respondent will be given 5 working days thereafter to submit a rebuttal.

SCI have determined that there are grounds to proceed to a DSC Hearing.

Two other Complaints were lodged with the Acting KUSA Secretary - the SCI determined there was insufficient evidence and insufficient grounds to accept the Complaints and the Complaints were dismissed.

Case 03-2022

Complaint lodged 11 July 2022.

SCI to evaluate the Complaint and decide whether there are grounds to proceed.

5.2 SHOWS

5.2.1. Applications for Second Championship Show

5.2.1.1 Victory Toy Dog Club – 21 October 2022

The above Club is requesting to hold a second Championship Show on 21 October.

Motivation: An overseas Judge is willing to officiate (attached).

Approved.

5.2.1.2 Free State Terrier Club – 29 October 2022

The above Club is requesting to hold a second Championship Show on 29 October. The show is part of the Frankfort weekend.

Motivation: A second Show in order to offer more events in the Free State. The clubs are working together for a fuller weekend.

Approved.

5.2.1.3 Herding Club of the Eastern Cape – 05 November 2022

The above Club is requesting to hold a second Discipline Championship Show on 05 November.

Motivation: Due to the very low numbers of Championship Shows in PE, the Committees are encouraging some clubs to try and hold more events. The Herding Club has an opportunity to utilise an out-of-town Judge as well as hold a workshop on the same weekend (attached).

5.2.2 Request for dispensation for finals Judge – 25 February 2023

The Kennel Association requests dispensation from Schedule 3 regulation 24.2.6 for their 25 February 2023 Championship Show.

24.2.6 The various Best in Show Challenges, whether at a Group, multiple Group or All-Breeds Championship Show, shall be Judged by the same Judge.

Motivation : The finals will all be Judged by Mr M Vorster, except for Best Puppy in Show. The Club would like Mr Vorster to Judge the Kennel Association Supreme Puppy Competition immediately following the Show. They are requesting dispensation to utilise Mr M Anderson for Best Puppy in Show. Judges list & Draft Schedule attached.

5.2.3 KUSA Nationals – Field Trials (RTR) – 03-04 September 2022 – KZN (Natal Gundog Club)

An application was received by the Field Trial Liaison Council and Natal Gundog Club to host the Retriever trials over the above weekend in Natal. A proposed budget will be sent to the KCC for some assistance (attached).

The matter was referred to the KCCT Team for further action .

5.2.4 Dog entered contrary to the regulations (see attached catalogue extractions):

DEFINITION OF CLASSES

It is compulsory for every Championship Show-holding Club holding Breed Classes to include the following Classes in the Show Schedule:

MINOR PUPPY (MP): For dogs of six (6) and under nine (9) months of age on the first day of the Show.

PUPPY (PU): For dogs of nine (9) and under twelve (12) months of age on the first day of the Show.

JUNIOR (JU): For dogs of twelve (12) and under eighteen (18) months of age on the first day of the Show.

GRADUATE (GR): For dogs of eighteen (18) and under twenty-four (24) months of age on the first day of the Show.

OPEN (OP): For dogs of any Breed therein provided for.

7.15 Any dog which has been exhibited contrary to these Regulations shall be liable to disqualification and cancellation of any awards gained, whether or not an objection has been lodged under Regulation 31.

The KUSA office was notified by an exhibitor of the following discretion:

BASSANOVA DEEP IMPACT – Boxer – ZA005341B21

The dog, born 22.11.2020 appeared as a Junior in three Oudtshoorn Shows, when in fact the age puts the dog almost 3 weeks into the Graduate class.

The applicable shows:

Outeniqua Kennel Club (2) – 11.06.2022

George Kennel Club (1) – 11.06.2022

George Kennel Club (2) – 12.06.2022

The Club incorrectly captured the dog as one month younger in all three Shows (22.12.2020), allowing the system to accept it into the Junior class. The owner incorrectly listed the class as “Junior” on the entry forms (attached), but the date of birth on the entry forms was correct.

The following awards were won by the dog at these shows:

Outeniqua Kennel Club (2) – Best Junior in Breed

George Kennel Club (1) – Best Junior in Breed, CC & Best of Breed

George Kennel Club (2) – RCC

The office requires instruction to act on the above.

In addition to the above complaint, a further transgression was uncovered. The owner of the Boxer does not appear to be a KUSA member.

7. ENTRY FOR EXHIBITION

Except as otherwise provided in the By-Laws applicable to a particular Discipline, only Members of the Kennel Union shall be entitled to enter and have dogs in their registered ownership compete in any Championship Dog Show, Championship Obedience Class, Championship Working Trial, Field Trial Championship Open Stake or Field Qualifier or any other Championship event, licensed by the Kennel Union, save for Breed Classes offered at Specialist Club Championship Shows, where entries will also be open to non-members’ dogs, with the exception of dogs in the registered ownership of persons on whom persona non grata status has been imposed, such dogs not being eligible for exhibition at any KUSA-licensed event. All entries shall be submitted on an official KUSA entry form, fully completed and signed. Any alteration or amendment to the Declaration thereon shall invalidate the entry. The current form shall be that appended to this schedule as Appendix 3. Only the current form or that immediately preceding it shall be accepted as official.

The office checked back to some previous shows in her area, and found that she had entered the dog in The Swartland Kennel Club Shows 15-16 April 2022. A CC was won at one of these Shows.

The Office requires instruction to act on the above.

After discussion it was decided that the awards are to be withdrawn.

5.2.5 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.5.1 Temporary Exclusion Order – Rhodesian Ridgeback – Kleinvalley Stalin – Reg No. ZA002674B20 – Report received of 2nd incident which took place at Cape Gundog Club (under license of Liesbeek Kennel Club) Non-Championship Show held 21.05.2022. Letter sent to Miss Zabolotnaya on 02.06.2022 (dated 31.05.2022) informing her of the need to complete Step 1, Step 2 (CGC Silver) and Step 3.

Letter received regarding Step 1. MA to look into whether training as presented in the letter received for Step 1 is sufficient and report back at the next meeting.

MA, having observed the training classes referred to by Mrs Zabolotnaya in her response to Step 1, provided feedback to the rest of the Executive Committee and after discussion it was decided that the training provided was not sufficient. CPA to inform Mrs Zabolotnaya that a 6-week course is to be completed in respect of Step 1 from the list of KUSA approved clubs.

5.2.5.2 Temporary Exclusion Order – American Akita – Zabush Zeus – Reg No ZA011567B19 - Report received of an incident which took place at Goldfields Supporters Club of Northern Gauteng held 10.07.2022 where it was reported that the above mentioned dog behaved aggressively by attacking two French Bulldogs (“Trouvallia Storm at Edmondo” and “Edmondo Show Stopper”).

TEO to be issued. The owners to liaise with each other regarding remuneration of vet bills.

10. GENERAL

10.1 Puppy Scams

The office received two complaints, one on 6 July and another on 8 July regarding what appear to be puppy scams by Joyful Corner. Both parties spoke to a Mr Charles Olsen who is not linked to KUSA in any way. However, the invoices provided by Joyful Corner and the website of Joyful Corner both bear the KUSA logo. Both parties said that they bought puppies from Joyful Corner because they saw our logo. The office would like clarity on what to do. Documents attached .

After discussion it was agreed that a letter be sent to the owners of the Joyful Corner Website to remove the KUSA logo with a warning that KUSA will proceed with legal action should the KUSA logo not be removed.

10.2 MA advised that the Working and Herding Breeds Club of the Cape is holding its 38th Annual Open Show but does not have an Open Class in the Show and enquired on how this was approved as there are compulsory classes for all Shows. NS to check and revert.

10.2 MA enquired on whether KUSA is able to allow Club Administrators, who are the POPI Information Officers, to access information on dogs and owners per region in order to have access to the information of Qualifiers for Invitational events. CPA advised that with the introduction of the New K9 admin system this could be a possibility but that she would discuss to matter with PM.

10.3 CP, NS and CPA reported that the KUSA Stand at the PetExpo was a great success.

There were a great number of people visiting the KUSA stand, lots of intertest was shown in what we offer.

The KUSA Team fielded many questions regarding the registration of dogs. There were quite a few queries on the Dog Sports offered, with the new pamphlets being very well received.

Overall, a busy weekend, and a positive response received from visitors.
