THE KENNEL UNION OF SOUTHERN AFRICA MINUTES A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY, 22 FEBRUARY 2022, VIA MS TEAMS

The Chairman opened the meeting and welcomed CPA and BD to the Exco meeting. As this was the last meeting KF would attend, he thanked KF for all his hard work and wished him well in his future endeavours.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

Below please find the status of Disciplinary Cases

Case 2021 -04 KUSA & Theunissen Vs. Jooste – Completed

After careful consideration of all the submitted evidence, documents and affidavits on December 21 2021, the DSC unanimously reached the following decisions on a balance of probabilities:

Careful analysis of the evidence, especially the contents of the representations submitted in her defence by the Respondent, indicated that she did not act in wilful breach of the KUSA Rules and Regulations and found that the complaints were not sufficiently substantiated and subsequently found the Respondent Not Guilty.

The awards made to the said three dogs at the Swartland and West Coast Kennel Clubs Championship Shows of 18 April 2021, remain valid and intact.

The DSC, however, noted that the actions of the Respondent towards the involved KUSA staff member was disturbing and cause for alarm and duly instructed the Acting KUSA Secretary to formally caution the Respondent to in future act in strict observance of the KUSA Code of Ethics for Members (Schedule 9) Regulation 1.2 and 2.1 and of the KUSA Constitution, when dealing with KUSA members of staff.

The DSC further instructed that the KUSA database be rectified with the correct date of transfer of ownership in accordance with the KUSA Office policy on the registration documents of the three dogs. The registration certificates that were previously issued, reflecting the incorrect transfer of ownership dates, must be destroyed and proof thereof provided by the Respondent to the satisfaction of the Acting KUSA Secretary. After receipt of satisfactory proof of destruction, the KUSA office is instructed to re-issue the registration certificates reflecting the correct dates of transfer of ownership of all three of the affected dogs.

Case 2021 -05 KUSA Vs. Gresty - Completed

After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision on a balance of probabilities:

The DSC found that the Respondent had made an admission to the complaint levelled against him in his response in explanation of his conduct and defence. In the absence of corroborative evidence to the contrary, it is accepted that these admissions were made freely and voluntarily.

The DSC found that the complaint was fully substantiated and found that the Respondent wilfully engaged in conduct of discreditable and/or improper and/or dishonourable and/or disgraceful conduct at a KUSA Show which conduct was prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith and subsequently found the Respondent guilty.

The DSC imposed the following penalty on the Respondent:

In terms of Schedule 1 Rule 11.1.2 read with Rule 11.4 of the KUSA Constitution, the Respondent is suspended and excluded from taking part in, or having any connection with, or attending or participating, or handling any dog at any KUSA Show or event, or from acting as an officer of any KUSA affiliated Club, for a period of 6 (Six) months starting from 1 March 2022 and ending on 31 August 2022.

Accepted unanimously via round robin vote on 08/02/2022 – For ratification.

5.2 SHOWS

5.2.1. Applications for Second Championship Show

5.2.1.1 Mpumalanga Bulldog Club – 08 October 2022

The above club is requesting to hold a second Championship Show on the weekend of 08 October 2022.

Motivation: To generate additional funds for the Club due to the loss of income during COVID-19 and to hopefully gain more entries for the weekend’s Events when hosting our second show in a cluster weekend.

Email received from TKC stating their acceptance to have an additional show in their weekend .

5.2.1.2 Limpopo Bull Terrier Club – 23 July 2022

The above club is holding a Championship show on 23 July 2022, and they are requesting a second show on the same date.

Motivation: Limpopo Bull Terrier Club prefers to hold 2 Championship Shows on one day, to make it worthwhile for the exhibitors coming from other provinces. It is also more effective to plan for 2 shows on one day, as opposed to hold 2 shows on separate occasions.

5.2.1.3 Application for change of show date

Northern Boxer Club

The Northern Boxer Club requested dispensation to change their Championship Show to a Non-Championship Show on 12 February 2022. This show shared a date with Roodepoort & Districts Kennel Club who put in an objection. They later withdrew their objection and the above was approved by Round Robin Vote on 07 February 2022.

5.2.1.4 Show Calendar 2022

The 2022 provisional Events Calendar is updated weekly and is available on the KUSA website. This document is subject to frequent changes and should be reviewed frequently.

5.2.2 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

Temporary Exclusion Order (TEO) for discussion – Neapolitan Mastiff – Lozzerio Romano of DelPicasso

– Reg. No. ZA007822B20 following an incident that occurred at the Roodepoort and Districts KC Championship Show 12.02.2022, at which it was reported that the exhibit had behaved aggressively by attacking a Judge

Temporary TEO to be issued.

5.3 JUDGES EDUCATION COUNCIL (JEC) – Nil.

5.4 JUDGES

5.4.1 Article 25.2 Judges shall maintain continuous and unbroken membership of the Kennel Union from the time their formal studies or activities towards a judging qualification commence until their voluntary retirement from judging, advised in writing to the Executive Committee, or their incapacitation (at the discretion of the Executive Committee), or their death.

5.4.2 Request for dispensation for Mr J de Abreu Marques to judge German Shepherds within the restricted timeframe.

Background;

Due to an error in the KUSA office, both clubs were issued with licences (in the same province, within the 3-month restriction)

• Whale Coast Kennel Club Championship Show – 05 March

• Bellville GSD Club Qualifying Show – 27 March

Schedule 10 Regulation 3.5. Between two Championship and Qualifying Shows in any province: a period of 3 months must pass between judging the same Breed, Group or Group Final.

Mrs Jetty Botes-Erasmus (Whale Coast KC) was approached to exclude GSDs from the Working appointment, but no other Judge officiating on the weekend was able to take on the GSDs.

She also did not want to fly another Judge in for only GSDs.

Clara Ferreira (Bellville) did not want to give up the Judge as he was able to award gradings as well, which few Judges were able to.

It was worth noting that Mr J de Abreu Marques would not be awarding CCs at the Bellville Show as it was a qualifying Show. No Show Awards would be given at this Show.

He would only be giving Gradings (which were not on offer at the All-Breeds Show)

5.10.1 Confirmed Minutes of the National Dog Jumping AGM held 11 January 2022 via MS Teams.

5.10.2 Request from the Convenor of the National Dog Jumping Sub-Committee for consideration & deliberation. Below please find e-mail received as motivation:

Dear KUSA Executives,

On behalf of the National Dog Jumping Sub-Committee, we would like to submit a similar request to that submitted recently by the National Dog Agility Committee. We would like to request an amendment on the number of licences allocated to Provincial Dog Jumping Sub-Committees for the National Dog Jumping League which is run under Schedules 5E(16) and 5D.

Currently the Provincial Dog Jumping Sub-Committees have a total of 2 open show licences available for leagues or shows in each province (5D 1.2).

This request is particularly relevant in the provinces that have a limited number of shows in their calendars (most notably EP and WP), and therefore limited opportunities for lower grade handlers (Grade 2) to gain qualifications to move up the grades, as well as the inability to run League rounds under licences.

Our request is that 5D 1.2 is amended to include:

• A total of 6 x "Dog Jumping League” licences (that are free as no income will be generated by the Sub-Committee). As the Dog Jumping league is only open to Grade 1 (advanced) dogs, these League shows can also include Grade 2 rounds allowing opportunity for Grade 2 (novice) dogs to gain qualifications

• The current 2 Non-Championship show licences available to the Dog Jumping Sub-Committee, is increased to four (4), and are specifically limited to Non-Championship show licences, i.e. these must be used for income (and KUSA levy) generating open shows going forward and will not be used for free, non-income generating national leagues.

The proposed amendment to the second paragraph of Regulation 1.2 Schedule 5D will then read as follows:

Any Provincial Dog Jumping Sub-Committee may apply for not more than six (6) Non-Championship Show licences in any calendar year, which may be used for National Dog Jumping League. These licences may also not be used for the South African Dog Championships. In addition, any Provincial Dog Jumping Sub[1]Committee may apply for not more than four (4) Dog Jumping League licences in any calendar year, which may only be used for the completion of non-income generating League rounds.

By doing so we believe there can be growth in the sport of dog jumping in EP and WP, and is in line with the change recently submitted by the National Agility Committee, although they have more rounds required and have therefore applied for eight (8).

Some key points from the EP/WP agility sub-committees: The current 2 Dog Jumping licences are not sufficient for the 6 league rounds that are required to be run the National Dog Jumping League. Their clubs struggle to find judges when they put a league in a show, as they don’t have many judges, and these judges are competing handlers as well, therefore they do not want to judge the shows as they want to compete in the league, therefore clubs are struggling to find judges. Learner judges need to judge the Non-Championship shows, but are not yet qualified, so that excludes them from judging league rounds.

9.4.1 Invalid Litter gap (Less than 5 months)

When application was first submitted with accompanying Vet Report the following was sent to the Vet requesting further explanation:-

According to our records, the last litter registered whelped out of Simaxdal Amberre was born on 14/10/2019

An application has now been received for the registration of a litter born on 08/03/2020, where according to Mrs Brown, the first 1 st mating took place on 06/01/2020 and the 2nd mating on 07/01/2020

This means that this dam came on heat, one week short of three months from the date of birth of the previous litter whelped and that she was mated approximately 6 weeks after having weaned the previous litter.

Vet response attached to agenda.

Carried forward. DNA parentage verification to be submitted

Concern was expressed at the high number of similar applications received for other litters from the

same Breeder, bringing into question the accuracy of records kept and record keeping practices.

Exco directed that going forward, all further litter registration applications submitted by the Member must be accompanied by DNA parentage verification Certificates for the entire litter.

A letter was e-mailed to Mrs Brown informing her of the Exco directive and informing her that DNA parentage verification would be required for this specific litter. Attached please find the response received from Mrs Brown.

Not approved. It was unanimously decided that DNA parentage verification must be provided in order to accept the registration of this litter.

Mrs Brown was informed of the decision made by the Executive Committee. The KUSA Office then received correspondence that the dam of the litter is deceased and therefore DNA parentage verification would not be possible. Attached please find a Sworn Affidavit received from Mrs P Tait who the dam was rehomed to. A Vet report was requested by the KUSA office but a reply was received that this was not possible.

Not approved. Definitive proof by means of a Vet Report or any other means is required to confirm that the Dam is deceased. This can be attained telephonically and via email.

10.1 GENERAL

MA queried whether the Free State Hound Club who had changed to an All-Breeds Club is authorised to host an All-Breeds Championship Show. It was suggested that a KUSA Representative be appointed in view of the fact that it would be the first time the Club runs a Show involving all 7 Groups.
