2. MINUTES

The Minutes of the meeting held on 12.06.2018 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Schedule 3 Regulation 33 Fines and Penalties (Exco 11-17 item 3.3, Exco 01-18 item 3.3, Exco 02- 2018 item 3.3, Exco 04-2018 item 3.3, Exco 05-2017 item 3.2)

Under item 3.4 of the Fedco Minutes it is recorded that Fedco unanimously agreed to a cap of R10000.00 on all fines imposed by Exco.

The following is also recorded in the Fedco Minutes:

That Exco is mandated to consider, investigate and propose changes to the Articles and Schedules in order to rectify contradictions. Exco has, for instance, identified Schedule 3 Regulations 31, 33 and 38 as requisite of alignment with Regulation 37 and for harmonisations with the content of Schedule 1.

3.2 Breed Assessments – Appeal Process (Exco 03-2018 item 9.8, Exco 04-2018 item 3.6, Exco 05-2018 item 3.3)

3.3 Mandatory Membership of KUSA for Dog Owners Entering Championship Shows – Dogs in Joint Ownership (Exco 03-2018 item 9.7, Exco 05-2018 item 3.5)

Fedco has reiterated that all owners need to be members of KUSA.

3.4 Schedule 3 Entry for Exhibition - Regulation 7.11 (Exco 04-2018 item 9.7.1, Exco 05-2018 item 3.6)

“No steward may handle a dog on the same day as he/she is officiating before a Judge for whom he was stewarding unless requested by the Judge to exhibit the entry.”

Discussed at Exco 04-2018 as there is no consequence to contravening this regulation.

At Fedco 06-18 (item 7.22), it is recorded that Exco sought guidance on dealing with contraventions of the Regulations.

Fedco confirmed that Exco had the discretionary powers to issue letters of warning, remove awards and impose fines, depending on the seriousness of the transgression. Exco had used its discretionary powers advisedly and judiciously in the past and Fedco believed it should continue to do so.

3.5 Schedule 3 – Regulation 16.5 (Exco 04-2018 item 9.7.4, Exco 05-2018 item 3.7)

"No dog shall be allowed into the judging ring after having been called three (3) times by the Ring Steward and marked absent."

Discussed at Exco 04-2018 as there is no consequence to contravening this regulation.

See item 3.4 above.

3.6 Schedule 3 – Regulation 3.4 – Show Manager (Exco 04-2018 – item 5.1.3, Exco 05-2018 item 3.8)

It was agreed at Exco 04-2018 that the Show Manager should be a member of KUSA. The following amendment to Schedule 3 Regulation 3.4 is suggested:

“The management of a Breed Show shall be the responsibility of the Show Manager who shall be a member in good standing of the Kennel Union and shall be appointed by the Committee of the Show holding Club.”

Amendment agreed at Fedco 06-2018. Also to be applied to Schedules 4, 4A and Working Discipline Schedules, if appropriate.

3.7 Deceased Estate – Mr Adrian Austen (Exco 06-2018 item 4.8)

PM reported on the progress made thus far in that all of the transfers submitted had been processed and the affix transferred into Mrs Austen’s name. A further report will be given at the next meeting.

3.8 Holding of Shows outside of Centres (Exco 06-2018 item 4.5)

Discussed at Fedco 06-2018.

The following is recorded in the Fedco 06-18 Minutes (item 7.16):

“The opinion of Fedco had been sought on the possibility of Specialist Clubs, especially those with a national reach, applying for a licence to hold a Championship Show outside their traditional Centres as a concession to members based in other parts of the country who find it difficult, or impracticable, to travel to the Club’s base Centre. 

Fedco confirmed that Exco had the powers to grant a Club permission to hold a show outside its traditional Centre but, in assessing an application for a Specialist Club wanting to move its show to different parts of the country, recommended that all the circumstances be thoroughly interrogated by Exco and that Exco applied the utmost discretion before granting such licence on a one-off basis.”

4. KUSA OFFICE

4.1 Office Report

After discussion the Office Report was approved.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2018

The DSC will convene on 31.07.2018 by teleconference.

Note: When the Secretary, or his or her duly appointed deputy, lodges a complaint in terms of Rule 3.1 of Schedule 1, the Chairman of Exco is required in terms of Rule 5.4 to deal with the Complaint as if he or she were the Secretary.

As the Chairman of Exco was, due to unforeseen circumstances, unavailable to be in attendance at the above teleconference, it was resolved that the General Manager, Mrs Pascale Midgley, be appointed as Deputy Secretary on her behalf for this purpose.

5.2 SHOWS

5.2.1 Applications for Second Championship Shows

5.2.1.1 Northern Tshwane Kennel Club - Sunday 19th May 2019 (Br,DJ,Ag,Fly,Hcl)

The above Club is requesting to host a 2nd Championship Show as above. (See attached motivation)

AGMs, Financials, Show Returns and any Penalties are up to date. The Club hosts Non-Championship shows during the year.

Approved.

5.2.1.2 Walmer & Suburban Kennel Club - 5 April 2019 (Br, Hcl)

The above Club is requesting to host a 2nd Championship Show (motivation letter attached to agenda).

On the Port Elizabeth Championship Show weekend in April 2017, Uitenhage KC held a second show. In 2018 PEKC held a second show, and in 2019 it will be the turn of Walmer and Suburban KC, viz each year the Clubs take a turn to host a second Championship Show.

AGMs, Financials, Show Returns and any Penalties are up to date. The Club hosts Non-Championship Shows during the year.

5.2.2 Other Club Matters

5.2.2.1 Schedule 3 Reg 14 – Exclusion of Dogs & Reg 19.8

The form for reporting incidents to KUSA has been adjusted to include the Show Entry Form as one of the documents to be submitted to KUSA

5.2.2.1.2 Temporary Exclusion Order - Apollo Prince of Stjephanic House of Torbrit Reg No ZA001028C16

Arrangements were made for the dog to be examined by suitably qualified Judges on 01.07.2018. Although all concerned had been contacted, the owner failed to attend.

Another date would have to be arranged for examination of the dog, however, as no explanation or apology has been received from Miss Theunissen regarding her non-attendance on 01.07.2018, it was agreed to wait until she made contact.

5.2.2.1.3 Temporary Exclusion Order - Rottweiler Vombladysnee Ava Reg No ZA007137B16

The above Rottweiler bitch in the registered ownership of Dr VJ Palmer was excused from the ring at the KUSA Championship Show in Bloemfontein on 02.06.2018 for showing aggression towards the Judge. A temporary exclusion order was issued.

The bitch is in the physical ownership of the handler, Mrs M Muller, and her letter was circulated on 18.07.2018.

The contents of the letter were noted and it was understood that Mrs Muller had already made enquiries about CGC (bronze) in her area.

5.2.3 DOGSPC Best of the Best Competition – Schedule 5E(17)

Best of the Best Organisers are requesting to host a Fair Play Best of the Best 1st & 2nd December 2018

The email dated 9 July 2018 from Mr Duane Riley to LW was tabled together with the accompanying examples of marketing material. After discussion, the following was decided without dissent:

That, in principle, Exco was in agreement that the D.O.G.S. Best of the Best event be presented under revised Rules on a two-year trial basis (2018 & 2019) before an amended Schedule 5E(17) was finalised;

That Mr Riley should be sent a MS Word version of the latest Schedule 5E (17) with a request to amend Rules 3, 5, 6, 7, 8 (or the appropriate subsections thereof) in accordance with the convention applied by KUSA for amendments to Schedules, viz. deletions in [ struckthrough square brackets ] and insertions underlined;

That the appropriately amended document should be returned to the KUSA Secretary for tabling at the next (August) meeting of Exco where the revised Regulations would be considered;

That the proposed date for the event as 1 December 2018 should be confirmed with Mr Riley (the DOGSPC Minutes of its meeting of 19 June 2018 reflect the date as 15 December 2018);

That it should be impressed upon Mr Riley that D.O.G.S. Best of the Best was a KUSA Schedule 5E event which needed to be hosted by a DOGSPC Club;

That, although D.O.G.S. Best of the Best might be held on the same date and at the same venue as Mr Riley’s “Fair Play” venture, it was not to be deemed part of Fair Play and the event should not be named to suggest that; and

That, as per Regulation 13, the name D.O.G.S. Best of the Best may only be preceded by the name of an authorised (by Fedco and DOGSPC) sponsor, to be provided for in a sponsorship agreement between DOGSPC and the sponsor.

5.2.4 Terrier Club Eastern Cape

A report on this Club’s finances was circulated on 19.07.2018.

DS to liaise with the Chairman of the EC&PC regarding the action recommended.

5.2.3 KUSA CLASSIC

5.2.3.1 2018 – Free State & N Cape – Breed 2&3 June 2018, Working Disciplines 4-6 August 2018

Finances for the Breed Shows were not yet finalised. It was anticipated that these would be ready by the end of August.

5.2.3.2 2018 – KUSA National Working Trials (Classic), TT & WUD – 14-15 July 2018

Successfully completed and results posted on FB and website.

5.2.3.3 KUSA National Retriever Champion Stake – 25/26 August 2018

Documents received and processed.

5.2.3.4 2019 – Gauteng

Budget to be requested.

5.2.3.5 Gauteng 2020

A request has been received for Exco to consider an application for the KUSA CLASSIC 2020 to be held in Gauteng, hosted by a joint committee of the Districts of Gauteng & Surrounds Provincial Council (DOGSPC) and the Northern Areas Provincial Council (NAPC). It is the intention of the Chairmen of both these Provincial Councils to collaborate in the appointment of a committee of people with a broad range of competencies, thereby to ensure meticulous attention to every aspect of this prestigious event.

The application includes holding the following shows:

1. FCI International (Africa) CACIB Show

2. KUSA Championship Show

3. KUSA Nationals – Breed and Handling

4. KUSA Winners Show

5. KUSA Disciplines Championship Show

6. KUSA Disciplines Nationals – Excluding Agility/ Jumping and Flyball, which will be held at the NAPC Bumper Disciplines weekend shows.

7. To be considered: FCI International (Africa) CACIAG Show (Agility & Dog Jumping)

It is proposed that these shows be hosted at one venue over the traditional dates for the KUSA CLASSIC in 2020.

9.2 Amendments to Club Constitutions

9.2.1 Cape Terrier Club

The above Club approved the following amendment to its Constitution at an Annual General Meeting which was held 19th May 2018.

Clause 21

21.1.1 Annual or Special Meetings shall be [fifteen(15)] ten (10) members with voting rights.

(Management Committee is no less than 6 nor more than 12 and falls within allowed parameters)

9.2.2 Kennel Association

The above Club approved the following amendments to its Constitution at a Special General Meeting held 19 June 2018.

Clause 18 D - AUDITOR

i) At each Annual General Meeting an auditor who may not necessarily be a member, but shall hold adequate experience to discharge his duties, shall be elected and he shall audit the books of account, verify the assets of the Club, audit the annual accounts and balance sheet and report thereon prior to the Annual General meeting.]

ii) No member of the Committee shall be eligible for appointment as auditor.]

Replace with:

i) At each Annual General Meeting an Independent Financial Practitioner shall be appointed for purposes of verification of the Club's assets and for the audit of the Club's accounts and its Statement of Financial position (balance sheet). The Independent Financial Practitioner, who need not be a member of the Club, shall prepare a report, or statement on the financial position of the Club prior to the Annual General Meeting and such report, or statement, shall accompany the financial statements presented at the Annual General Meeting.

ii) The "Independent Financial Practitioner" means a person with trusted and proven experience in the examination of accounts and financial records and in the statement of financial results, but who does not necessarily hold the formal qualifications required of an auditor.

9.2.2 Central Free State Bull Terrier Club

The above Club approved the following amendments to its Constitution at a Special General Meeting held 01 July 2018.

Clause 4 - Headquarters and address of Club

The headquarters of the Club shall be as determined from time to time by the Committee, but shall be in [BLOEMFONTEIN] SASOLBURG and the Club's shows shall take place within that area.

Clause 14 - Subscriptions

(c) Renewal subscriptions shall be due and payable on: (i)[1 September] 1 January each year.

Clause 16 - Management Committee

(a) The management and the control of the Club shall be vested in a Committee consisting of [six (6)] five (5) Committee members all of whom shall be…

Clause 19 - Financial Year

The financial year of the club shall run from [1 September]1 January each year to [30 August] 31 December each year.

Clause 23 - Amendment of the Constitution

(a) A proposal to alter, amend or add to this Constitution may be submitted only:

(i) By the Committee, or

(ii) By a requisition signed by not less than [ten (10)] five (5) members addressed to the Secretary.

Approved, subject to a recommendation that the Club changes its Headquarters to “Free State”.

9.3 Schedule 2 Reg. 4.6 & 4.7 - Dispensation for Registration

American Staffordshire Terrier (Reg. 4.7 Late Registration)

Regulation 4.6:

 Notwithstanding the provisions of Regulation 4.3 the Executive Committee shall be empowered, at its discretion, to grant dispensation on good cause shown to permit the registration of a single eligible dog or litter. In the case of application for the registration of an additional puppy to a litter already registered, KUSA reserves the right to request DNA parentage verification for that dog. DNA parentage verification certificates must have the microchip number of the dam, sire(s) and each of the progeny recorded on the certificate.”

9.4 Schedule 2 Reg. 9 – Amendment to Registers

Incorrect details of Sire and Dam recorded on application for registration of complete litter.

Litter whelped 17 May 2018 nine (9) puppies: Staffordshire Bull Terrier.

The Breeder, Mr JC Loots, inadvertently inserted the incorrect details for the Sire and Dam on the litter application form.

Sworn Affidavit received. Application form with the correct Sire and Dam details received.

Fee for the rectification of our records received.

Original certificates of registration have been returned.

The breeder will have the DNA Parentage Verification done.

Date the litter was registered: 03 July 2018.

Date of birth of previous litter registered by breeder: 23 March 2018 (nine puppies).

Approval is subject to DNA Parentage Verification.

9.5 Schedule 3 Regulations 38.3.2 and 38.4 Veterinary Certificates - nil

9.7 Staffordshire Bull Terrier (Schedule 2 Reg.12.2 Refusal or Cancellation of Registration)

Breeder Mrs A Senekal - Litter of three Staffordshire Bull Terriers - date of birth 25.10.2017

The breeder submitted an application form on which the mating dates were not recorded. A declaration that the mating was witnessed was signed by the breeder.

The KUSA Office contacted the breeder to attain the mating dates and were then informed that the mating had not been witnessed and the litter arose out of an accidental mating.

Further to this, at the time of mating, the Dam was under 12 months of age (11 months old).

As this was an accidental mating of an underage bitch the office informed the Breeder that a Vet Report would be required in respect of the underage bitch and that DNA Parentage Verification would be required to register the litter.

The response from the breeder indicates that she lives in a security complex where her dogs are locked and could not have had contact with other dogs. A Vet report was provided in respect of the bitch.

The Breeder has requested EXCO to consider waiving the need for DNA Parentage Verification.

After discussion it was resolved that approval will be subject to DNA Parentage Verification.
