THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY 12 DECEMBER 2023 VIA MS TEAMS

1. ATTENDANCE, APOLOGIES & ANNOUNCEMENTS

2. MINUTES

The Minutes of the meeting held on 21.11.2023 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1K9 Sport Specialist GSD Club (under Mpumalanga GSD Club licence) – 25.06.2023

The above Club held a Non-Championship IGP Trial on 25 June. The office noted a Judge change to the online portal on the day of the show by the Club. No documentation was submitted, no reason for the change, nor a new Judge’s contract was received. All pre-show documentation listed Christine Kneidinger as the judge, and she was approved. On receiving the Show Returns, the Judge was confirmed as Mr John Swartz.

3.2 Cape Town Kennel Club – 15.10.2023

The above Club reported that there were some irregularities ringside during the Jack Russell Terrier judging. An exhibitor swopped her dogs’ classes, and the dogs won awards.

Letter to be sent to the Exhibitor and Ring Steward detailing the procedure that should have been followed.

Exco to draft a proposed new Regulation to govern such incidents for tabling at Fedco 06-2024.

3.3 Breede Rivier Vallei Kennel Club – 14.10.2023

A Judge for the above Club (Jill Peak, UK) was unable to judge some of her contracted classes (Junior Showmanship & Best Junior in Show). Two local judges stepped in – Ms Joy McFarlane (Best Junior in Show) & Mrs Jetty Botes-Erasmus (Junior Showmanship). Both had dogs in their registered ownership entered in the show and were awarded the following:

Schedule 03 Regulation 31 states:

Objections to Dogs & Disqualifications.

31.3 The grounds of objection made to a dog and immediate disqualification of such dog in terms of this

Regulation shall be any one or more of the following:

31.3.14 that it has been entered and/or exhibited at a Show when it is registered or recorded as owned by an officiating Judge within a period of four (4) months prior to the Show, when said officiating Judge is scheduled to judge any Class or Competition to which the dog may gain admission through its entry, except in the case of a dog owned by the officiating Judge appointed in an emergency, in which case the disqualification of the dog will be automatic without any liability incurred by the emergency appointed Judge.

Minutes of Exco 11-2023 state:

Dogs were exhibited at a Show when in the registered ownership of an officiating Judge thus as per the aforementioned Regulation, the dogs are automatically disqualified, and awards won on the day withdrawn.

The KUSA Office received a letter from the Chairman of the Club requesting that Exco review the decision taken at the Exco 11-2023 meeting.

Note: Regrettably, the applicable Regulations Schedule 03 Regulation 7.10.1; 7.10.2 and 7.15 were

inadvertently omitted from the previous meeting’s agenda and minute, giving the incorrect impression that the sanction applied was applied in accordance with Schedule 03 Regulations 31 instead of Schedule 03 Regulation 7. Entry for Exhibition which states:

7.10.1 A Judge may not enter a dog registered in his ownership in the same discipline on the same day at the same venue as he is officiating, save and except for Working Disciplines held under the licence of a different Club. Automatic disqualification of the dog(s) will apply and the Judge will be liable for disciplinary action under Schedule 1.

7.10.2A Judge may not handle a dog in any discipline, save and except for Working Disciplines held under the licence of a different Club on the same day at the same venue, as he/she is officiating. Automatic disqualification of the dog(s) will apply and the Judge will be liable for disciplinary action under Schedule 1

.15 Any dog which has been exhibited contrary to these Regulations shall be liable to disqualification and cancellation of any awards gained, whether or not an objection has been lodged under Regulation 31.

The matter was reviewed under the appropriate Regulations governing such incidents i.e. Schedule 03 Regulation 7.10.1, in which it is unambiguously stated and constitutionally prescribed that automatic disqualification shall apply.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.2 SHOWS

5.2.1 Applications for Second Championship Show – Nil.

5.2.2 Dispensation Request

5.2.2. Hochland Dog Club

Hochland Dog Club have requested dispensation for their Championship Show scheduled for July 2024 in respect of deadline dates for the submission of application documents. Their motivation includes a limited number of Committee members being available. A decision will be made as to whether or not to hold the Show at their AGM which is scheduled for January 2024. (see attached).

Carry forward to the next meeting pending decision from Fedco via round robin.

5.2.2.2 National Agility Sub-Committee (NAgSC)

The NAgSC request the extension of the trial special Licences be granted to the Provincial Agility Sub-Committees to include a total of 8 additional special Licences for EC, to be used in East London as per the attached motivation. The NAgSC confirmed their support for this request:

We, the NAgSC, would like to request a special dispensation from KUSA for East London Agility to hold their SA Agility Championship Trial and National Agility League rounds separate from the Eastern Cape Agility Sub-Committee due to the substantial distances to travel. Currently East London only has two Working Discipline Clubs for show licences, as the three Breed Clubs are currently not in good standing with KUSA, which seriously limits the number of shows that can be held.

We request that eight (8) Agility League Licences, which may only be used for the completion of any non-income generating rounds of the KUSA NAL and the KUSA SAAC Trials (as per Schedule 5(L) Appendix D & F), be issued for 2024. Any licence fees to be paid for are as per the KUSA requirements.

Approved on trial basis for 2024. Decision to be reviewed at end of year.

5.2.3 OTHER CLUB / SHOW MATTERS

5.2.3.1 Entry in contravention of the Regulations in Schedule 03

The KUSA Office received an application for Champion status for Zabush Rafferty Lancelot (ZA002534B22). The dog is co-owned. At the time of application, the membership of one of the Registered Owners had lapsed but has since been renewed. However, the CCs submitted in support of the Champion application were all in the name of only one Registered Owner,not both. The Registered Owners are Mr P Santilhano (Membership No. 163397) and Mrs J Santilhano (Membership No. 1007547). The Office would like to know how to proceed regarding the administrative error made on the Entry Forms .

Letter of reprimand and R500 fine to be imposed for the administrative errors made on the Official Show Entry Form.

5.2.6. Schedule 03 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.6.1 Temporary Exclusion Order – Border Collie – Eurofire Amazing Heart – Reg No ZA006923B22

Report received of an incident which took place at the Witwatersrand Corgi Club Tramordwy Non-Championship Show held on 26.02.2023, where it was reported that the above-mentioned dog behaved aggressively by attacking the Ring Steward.

As instructed by the Chairman of Exco, a TEO was issued 06.03.2023

TEO confirmed by Exco.

Owner returned signed Indemnity Form 27.03.2023.

The Owner has submitted a letter from Birch Acres Dog Training Club regarding the successful completion of a training/socialising course in partial fulfilment of the stipulated steps to have the TEO lifted.

This dog attempted to gain its CGC at Goldfields Kennel Club Championship Show on 19.09.2023, but a further incident reportedly took place (see attached).

The dog was awarded its Canine Good Citizen Bronze on 19.11.2023. The dog has met the requirements for Exco to consider lifting the TEO.

5.2.6.2 Temporary Exclusion Order – Miniature Schnauzer – Francesca's White King Watson-B – Reg No. ZA001076C23

It was reported that the abovementioned dog may have acted aggressively at the Free State Kennel Club Championship Show held on 29.10.2023, where it reportedly snapped at the Judge. The Office is waiting for the remainder of the statements.

Exco recommended that a CGC be completed by the dog.

5.4.1 Article 25.2 Judges shall maintain continuous and unbroken membership of the Kennel Union from the time their formal studies or activities towards a judging qualification commence until their voluntary retirement from judging, advised in writing to the Executive Committee, or their incapacitation (at the discretion of the Executive Committee), or their death.

Request received to register the puppy in question under the correct dam.

As there being no further business, the Meeting closed at 14h13 with a vote of thanks to the Chair.
