THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY 21 NOVEMBER 2023 VIA MS TEAMS

9.1.1 Schedule 2 Appendix E - Imported Retriever (Labrador) – mandatory D-Locus Test

The following was approved by the Federal Council with effective date 01.10.2021.

Schedule 02 “Regulations for the Classification, Registration and Transfer of the Registered Ownership of Dogs” Appendix E Breed Specific Requirements for Imported and Exported Dogs

8. Retriever (Labrador) – Imported

8.1 An imported Retriever (Labrador) may only be placed on the KUSA Breed Register upon presentation of a clear test result for the dilute colour gene for the dog in question, from a recognised genetic laboratory in the country of origin or South Africa, or by being proven hereditarily clear, of either carrying the Dilute gene (“Dd”), or of being affected by the Dilute gene (“dd”). For the avoidance of doubt, the test result must reflect a result for the D Locus of “DD” for the dog, or for both its parents, to be eligible for Breed Registration.

8.2 No offspring from imported Retriever (Labrador) semen, collected on or after 1 October 2021, may be placed on the KUSA Breed Register, unless a clear test result for the dilute colour gene for the dog in question can be produced, either from a recognised genetic laboratory in the country of origin or South Africa; or, the semen donor can be proven to be hereditarily clear of either carrying the Dilute gene (“Dd”), or of being affected by the Dilute gene (“dd”). For the avoidance of doubt, the importer must furnish the KUSA with proof of a Dilute gene result of “DD” for the semen donor, or for both his parents, in order for the litters sired by the donor to be eligible for Breed Registration.

Between 1.10.2021 and 31.12.2022, four (4) imported Retriever (Labrador) were registered on the Primary Breed Register by the KUSA Office without the requisite D-Locus Certificate or proof that both parents were hereditary clear.

After discussion it was agreed that the four dogs in question are to be tested at cost to KUSA.

Upon review, it was established that 3 imported Labradors and not 4 as previously reported were placed on the Breed Register without the mandatory D-Locus dilute gene test declaring the dogs as not carrying the dilute gene.

The owners of the 3 dogs were contacted by the KUSA Office, two of which made immediate arrangements for DNA material to be sent to ZooOmics, whereas the third owner had no intention of breeding with the dog and requested that the Primary Breed Registration for the dog be cancelled.

Test results were received from ZooOmics on 7 November 2023 and confirmed that neither of the two imported dogs tested, carry the dilute gene.

Test result for both dogs was D-Locus DD.

The above Club is requesting a second show on the same day as their Championship Show.

5.2.2.1 Cape Town Kennel Club – 15.10.2023

The above Club reported that there were some irregularities ringside during the Jack Russell Terrier judging. An exhibitor swopped her dogs’ classes, and the dogs won awards.

5.2.2.2 Breede Rivier Vallei Kennel Club– 14.10.2023

A judge for the above Club (Jill Peak, UK) was unable to judge some of her contracted classes (Junior Showmanship & Best Junior in Show). Two local judges stepped in – Ms Joy McFarlane (Best Junior in Show) & Mrs Jetty Botes-Erasmus (Junior Showmanship). Both had dogs in their registered ownership entered in the show and were awarded the following:

Schedule 03 Regulation 31 states:

Objections to Dogs & Disqualifications.

31.3 The grounds of objection made to a dog and immediate disqualification of such dog in terms of this

Regulation shall be any one or more of the following:

31.3.14 that it has been entered and/or exhibited at a Show when it is registered or recorded as owned by an officiating Judge within a period of four (4) months prior to the Show, when said officiating Judge is scheduled to judge any Class or Competition to which the dog may gain admission through its entry, except in the case of a dog owned by the officiating Judge appointed in an emergency, in which case the disqualification of the dog will be automatic without any liability incurred by the emergency appointed Judge.

Dogs were exhibited at a Show when in the registered ownership of an officiating Judge, thus, as per Regulations, the dogs are automatically disqualified, and awards won on the day withdrawn.

5.2.2.3 K9 Sport Specialist GSD Club (under Mpumalanga GSD Club licence) – 25.06.2023

The above Club held a Non-Championship IGP Trial on 25 June. The office noted a Judge change to the online portal on the day of the show by the Club. No documentation was submitted, no reason for the change, nor a new Judge’s contract was received. All pre-show documentation listed Christine Kneidinger as the judge, and she was approved. On receiving the Show Returns, the Judge was confirmed as Mr John Swartz.

Documents attached. No response from the Club regarding the change.

Schedule 04 Regulations for Non-Championship Shows

Regulation 3.1 The Show Licence application, signed by the officers of the applicant Club, shall constitute an undertaking given by each of them, binding themselves jointly and severally to hold and conduct the Show under and in accordance with the Regulations of the Kennel Union

Regulation 3.4 Notwithstanding and in addition to the provisions of the Disciplinary Rules in Schedule 1, the Executive Committee shall have power to impose a fine upon any Club, the officers or members of which have in the course of conducting a show breached these Regulations.

Regulation 15.4 In the event of a Judge, having accepted an appointment, not fulfilling such engagement to judge, he shall be required to give reasons in writing within 7 days to the Club Committee with whom he has been contracted and if such reason is considered to be unsatisfactory or if no such reason is submitted, the Club Committee shall request the Club Secretary or any other appointed member of the Club who is a member of the KUSA to submit a complaint with the KUSA in terms of Schedule 1 of the KUSA Constitution.

NS to request reports from both Judges as to why one Judge was replaced by the other. A Letter of reprimand to be sent to the Club.

5.2.3 OTHER CLUB / SHOW MATTERS

5.2.3.1 Entry in contravention of the Regulations

Eastern Transvaal Bull Terrier Club– 16.09.2023

Schedule 03 Regulation 7.10.1 states:

A Judge may not enter a dog registered in his ownership in the same discipline on the same day at the same venue as he is officiating, save and except for Working Disciplines held under the licence of a different Club. Automatic disqualification of the dog(s) will apply and the Judge will be liable for disciplinary action under Schedule 1.

`Wilbod Magnum Opus - Reg no ZA008243B23 - Baby Puppy Class

It was brought to the attention of the Office that the above-mentioned dog, in co-ownership , was exhibited at the Eastern Transvaal Bull Terrier Club Championship Show on 16 September 2023. One of the owners was the officiating Judge for the Northern Transvaal Bull Terrier Club Championship Show held on the same day at the same venue. Awards won: Best Baby Puppy in Show

Schedule 03 Regulation 7.15 states :

Any dog which has been exhibited contrary to these Regulations shall be liable to disqualification and cancellation of any awards gained, whether or not an objection has been lodged under Regulation 31.

Schedule 03 Regulation 31.12 states :

Notwithstanding the provisions of this Regulation hereinbefore set forth, in consequence of any decision made under this Regulation, the Executive Committee may instruct the Secretary to make a complaint under Rule 2 of the Disciplinary Rules (Schedule 1), where after it shall be dealt with in accordance with the procedure set forth in the Disciplinary Rules (Schedule 1).

Judge is to be sent a letter of reprimand pointing out that, as a Judge, she should be aware of the Regulations and is required to adhere to them and be reminded of the possible consequences should this occur again .

5.2.3.2 Limpopo Bull Terrier Club Show 1 – 22.07.2023

Schedule 03 Regulation 7.10.1 states:

CH Jimnah Pablo of Russel of Rion - Reg no ZA001452B19 - Champion Class

It was brought to the attention of the Office that the above-mentioned dog, in co-ownership was exhibited at the Limpopo Bull Terrier Club Championship Show 1 on 22 July 2023. One of the owners was the officiating Judge for the Limpopo Bull Terrier Club Championship Show 2 held on the same day at the same venue. Awards won: none.

Schedule 03 Regulation 7.15 states:

7. ENTRY FOR EXHIBITION

Except as otherwise provided in the By-Laws applicable to a particular Discipline,only Members of the Kennel Union shall be entitled to enter and have dogs in their registered ownership compete in any Championship Dog Show, Championship Obedience Class, Championship Working Trial, Field Trial Championship Open Stake or Field Qualifier or any other Championship event, licensed by the Kennel Union, save for Breed Classes offered at Specialist Club and Specialist Multi-breed Club Championship Shows, where entries will also be open to non-members’ dogs, with the exception of dogs in the registered ownership of persons on whom persona non grata status has been imposed, such dogs not being eligible for exhibition at any KUSA-licensed event.

All entries shall be submitted on an Official Show Entry Form (which includes the approved online electronic version thereof), fully completed and signed or, in the case of an online electronic entry, by acceptance of the Declaration.

5.2.4 Show Return Penalties

5.2.4.1 Northern Tshwane Kennel Club – 13-14.05.2023

The abovementioned club is requesting to have the balance of their penalty waived. The total Penalty amount was R10782 (R2514, R2982, R3342, R1944 in four events). They have made payment for R5000, but still owe R5782.

The penalty breakdowns are attached, as well as their letter of motivation .

As per Fedco directive, the outstanding fees are due and payable by 31.12.2023

5.2.4.2 Natal Gundog Club – 05.03.2023 & 30.06.2023

The above club is requesting to have their penalties waived. The total penalty amount is R864 + R681.

5.2.7. Schedule 03 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.7.1 Temporary Exclusion Order – German Shepherd Dog Type – Inca von Blauklippen – Reg No.

Incident 1

It was reported that an incident involving the abovementioned dog took place at the Working & Herding Breeds of the Cape Championship Show (on loan to the Western Cape Working Trials Sub-Committee) held on 02.09.2023. The incident was discussed by the Judge and Show Secretary, and it was agreed to give the dog the benefit of the doubt and not declare it an Incident of Aggression (see attached).

It was reported that the abovementioned dog acted aggressively at the Cape Handlers Dog Club Non-Championship Show held on 02.08.2023, where it showed aggression towards the Learner Judge (see attached).

Preliminary TEO issued 07.09.2023.

Noted. TEO confirmed. The dog is to continue its training with a behaviourist, complete a CGC and be assessed by a Class C Obedience Judge.

Report from behaviourist attached.

CPA advised that the owner is finding it difficult to find a Club able to assist with completing a CGC. BJ suggested that MA, with the help of CPA, assist the owner with finding a Club willing to perform the CGC.

5.2.7.2 Temporary Exclusion Order – Miniature Schnauzer – Francesca's White King Watson-B – Reg No. ZA001076C23

It was reported that the abovementioned dog may have acted aggressively at the Free State Kennel Club Championship Show held on 29.10.2023, where it reportedly snapped at the Judge. The Office is waiting for the remainder of the statements.

Noted. It is recommended that a CGC be completed by the dog.

5.2.7.3 Temporary Exclusion Order

An enquiry was received in connection with the TEOs issued in respect of three German Shepherd Dogs at the Meisterschaft held 3-5.08.2023. In order to have the TEO lifted, the dogs are required to fulfil the steps as laid out in the TEO Manual, as well as successfully complete a BH as per Schedule 05B(02) App B – International Utility Dog Regulations (IGP). One of the dogs has apparently completed his BH, but the query was raised as to how this dog could have entered a Show in order to undertake the test as none of the other requirements for lifting the TEO had been completed. Neither the TEO Manual, Schedule 05B App B, nor Schedule 03, speaks to at what stage the BH may be undertaken.

The Office seeks clarity as to whether the BH may be undertaken before the remaining steps of the TEO lifting process are completed.

After discussion it was decided that the TEO procedure is to be completed before the BH may be undertaken.

Provisional acceptance was granted to Ms Scholtz who has subsequently added this Kennel Name to two dogs transferred into her name.

Schedule 02 Regulation 8. AFFIX (KENNEL NAME)

An Affix is a registered description of a Kennel Name which may be used as a prefix to the dog's common name by a breeder or as a Suffix by a first subsequent owner.

8.1 Every application to register an Affix shall be made on an official Kennel Union form signed by the applicant and setting out all the information

required therein and shall be accompanied by the application fee prescribed in terms of Schedule 7.

8.2 Four (4) alternative names, in addition to the Affix desired, shall be given by the applicant, provided that a number and descriptive word shall not be registerable. The names of countries, provinces, towns or titles, a letter or number or numeral, an adjective or noun appropriate to the name of a dog or a colour definition appropriate to a breed of dog will not be granted as Kennel Names. The "Name" applied for should not be a "First Name" (e.g. Gisela), a common name for a dog (e.g. Fido, King, etc), include a surname, be that of a registered company, patented product, be indicative of the quality of the applicant's dogs (e.g. Champion, Superb) or include anything indicative of any breed or its temperament. The word "Kennel/s" may not be included as part of the Affix. Acceptance of an Affix shall be at the sole discretion of the Executive Committee.

8.3 Every Affix provisionally accepted by the Secretary shall be published once in the official Kennel Union journal and any objections thereto shall be lodged with the Secretary within thirty (30) days of publication.

8.4.1 After publication of the Affix, every application and objection shall be considered by the Executive Committee, which may grant such application, with or without amend­ment, whereupon the Affix shall be registered, giving the grantee, during the con­tinuance of such grant, the sole and exclusive right to use such Affix as part of a name when registering or changing the name of a dog on transfer of ownership. The grantee may not cede, assign, bequeath, sell or dispose of a registered Affix without the con­sent of the Executive Committee.

Ms Scholtz informed the KUSA Office on 16 November 2023 that in the best interest of all parties involved she would apply for an alternate Kennel Name to Terrediseena.

9.1.2 Mpumalanga Bulldog Club reported that their Treasurer had sadly passed away and, despite their best efforts, they cannot recover the accounts for the 2022 financial year. They have presented audited financials for 2021 and 2023 showing a profit over the 2022 period. They are asking leniency for not submitting accounts for the 2022 financial year. (See attached)
