THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY, 22 NOVEMBER 2022 VIA MS TEAMS

1. ATTENDANCE, APOLOGIES & ANNOUNCEMENTS

2. MINUTES

The Minutes of the meeting held on 25.10.2022 was formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Entry in contravention of the Regulations:

Jabbari Red Velvet (ZA009224B18) Boston Terrier (Exco 10-22 Item 5.2.2)

Upon receipt of the Champion application for the abovementioned bitch, the office noted that the dog was entered in another person’s name instead of that of the registered owner This is in contravention to Schedule 3, Regulation 7.1.1:

7.1.1 When an entry is submitted to a show holding club, a dog shall be solely and unconditionally the property of the Exhibitor and at the time of exhibition it shall be registered in the Exhibitor’s name at the Kennel Union, or at a registry formally recognised by the Kennel Union in a written agreement.

According to the registered owner they had posted the transfer application to the office in mid to late-2018 but this document did not reach the office and the transfer was not processed. The new owner of the dog entered the shows not realising that the dog was not registered in her name and is appealing to Exco for leniency on the above regulation having only just become aware of the problem.

The previous registered owner confirmed that they had signed the transfer document and was also under the impression that the dog was registered in the new owner’s name.

Explanation accepted - Awards not to be withdrawn.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 03-22 KUSA (Agility Committees) vs K Livingstone.

Disciplinary Hearing took place on 26 October 2022.

Findings:

After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision, on a balance of probabilities, with regards to the case before them:

The DSC found that the complaint was fully substantiated and found that the Respondent wilfully engaged in conduct of discreditable and/or improper and/or dishonourable and/or disgraceful conduct which was prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith. They therefore found the Respondent guilty of contravening Schedule 1

Rules 4.1.1, 4.1.1.4, 4.1.4.2, of the KUSA Constitution, read with KUSA’s Best Practice Guidelines for

Members in the Use of Social Media

Penalties:

In terms of Rule 11.1.2 of Schedule 1, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial

or Field Trial or other event held under KUSA licence for a period of twelve (12) months.

The first six (6) months of the sentence is to be enforced in its entirety. In terms of Rule 11.5 of Schedule 1, the DSC ruled that the remainder of the sentence is to be suspended for a period of three (3) years on condition that the Respondent does not contravene any of the provisions provided for in Rule 4 of Schedule 1, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint during the period of suspension.

The Respondent is not disqualified from registration, recording, transfer, exhibition or competition or evaluation of a dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee, or of the progeny of such a dog.

The DSC ruled that the above penalty will take effect on the 15 th of November 2022.

The Respondent was notified of her right of appeal as per Rule 12 of Schedule 1 and has until the

29 November to do so.

5.2 SHOWS

5.2.1. Applications for Second Championship Show

5.2.1.1 Dobermann Club of KZN & Highway Agility Club – 06-07.05.2023

The above clubs are requesting to hold their usual joint weekend, run by Highway Agility Club. This was approved for their 2022 shows.

Motivation: The club wishes to offer maximum events to KZN competitors

Approved.

5.2.2. Validity of Awards

Schedule 05F(9.1.11) Regulations for Bullmastiff CBA refers

The Character and Breed Assessment (CBA) qualifications for Bullmastiffs obtained at the Cape Rottweiler Show (16.05.2022) have been questioned by the Cape Bullmastiff Club (CBC). Since then, the office has received two applications for Champion status accompanied by a request to add CBA to the dog’s name. Prior to adding these awards, the office seeks clarification on the matter.

After discussion it was decided that all awards granted are legitimate and was to be accepted. On the matter on the incorrect forms used, it was suggested that there be a review of all of the forms relating to CBA and that the clubs work together to update the necessary forms. A KUSA Character Breed Assessment Certificate also needs to be designed.

5.2.3 Show Calendar

The 2022 & 2023 Show calendars continue to be updated daily, and uploaded weekly.

5.2.4 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs 

5.2.4.1 Temporary Exclusion Order – German Shepherd Dog – I-One Del Camino Duro of Laybadene – Reg No ZA001011C19

Report received of an incident which took place at Rotek Endurance Trial held 23.10.2022 where it was reported that the above-mentioned dog behaved aggressively by biting his handler, Helen Gibbings.

Reports were submitted by the Judge and her assistant/witness (see attached). The handler declined to submit a report.

No TEO was issued.

Noted.

5.2.4.2 Temporary Exclusion Order – Dobermann – Chaldonne Rock Tsar at Sharbara – Reg No ZA011848B16

Report received of an incident which took place at The Dobermann Club of the Cape Championship Show held 23.10.2022 where it was reported that the above-mentioned dog behaved aggressively by biting the Judge.

Reports were submitted by the Judge, Ring Steward, owner, handler witnesses (see attached).

TEO issued 08.11.2022.

5.2.4.3 Temporary Exclusion Order – American Akita – Zabush Zeus – Reg No ZA011567B19

Report received of an incident which took place at Goldfields Supporters Club of Northern Gauteng held 10.07.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking two French Bulldogs (“Trouvallia Storm at Edmondo” and “Edmondo Show Stopper”).

Letter of appeal submitted by the owner of the two American Akitas involved in the incident.

TEO issued.

Documents not legible and must be reissued – transcripts have been made available to relevant parties.

Having considered the appeal and information available it was agreed that the TEO is to remain in place. Socialisation training and CGC to be completed.

5.2.4.4 Temporary Exclusion Order – American Akita – Undercover Lover del Casa di Coniglio – Reg No ZA001150C21

Report received of an incident which took place at Working & Herding Breeds Association Golden Reef held 14.08.2022 where it was reported that the above-mentioned dog behaved aggressively by attacking a Giant Schnauzer (“Ch Gently Born Take My Heart, JM”).

The Club has submitted its report but are waiting for affidavits from the witnesses.

TEO issued.

Owner submitted the required documentation. TEO lifted.

5.2.5 OTHER CLUB / SHOW MATTERS

5.2.5.1 Motivation for Qualifying Certificate to be issued – Rally Dog

Working & Herding Breeds Club of the Cape Show – 09.10.2022

The above Club held a Rally Dog event at the above Discipline Championship Show. A Grand Master Class was added at the last minute, and the judge was unable to Judge the class. All reports regarding this are attached.

The class was judged by another Licensed Judge on the day. There was one exhibitor in the class, and a Qualifying Certificate was earned. The club did not award the certificate due to the class not being judged by the appointed Judge.

The WC Rally Dog Sub-Committee is requesting that the exhibitor be awarded the QC by the Club, as the point would count towards the dog’s Grand Champion status.

After discussion it was decided that the awards are to remain in place .

 5. 2.6  KUSA CLASSIC 2023

5.2.6.1 KUSA Classic Discipline Events

  • Friday, 26 May - commencing at 09.00 – KUSA WINNERS SHOW – Breed judging.
  • Saturday, 27 May - commencing at 08.00 – KUSA WINNERS SHOW – Group Finals and Best in Show events. This is followed by KUSA CHAMPIONSHIP SHOW – Breed judging.
  • Saturday, 27 May (Morning) – KUSA NATIONALS for Dog Dancing and the FCI INTERNATIONAL/NATIONAL (AFRICA) CACIAG – Agility and Jumping.

Provincial Councils are requested to submit applications for the hosting and organising of the KUSA Classic 2024 event.

Exco members are requested to remind their respective Provincial Councils to submit proposals as a matter of urgency .

Noted. BJ requested that Exco members approach their Provincial Councils. MA advised that the Flyball fraternity have indicated that they would be happy to host the Flyball Nationals in Cape Town.

Ms Wearne’s membership became due on 15.08.2022 and lapsed on 15.09.2022.

The office has received complaints from members of the public regarding Ms Wearne.

Exco expressed grave concern and it was reiterated that in accordance with the terms and conditions of Membership renewal, KUSA is under no obligation to approve membership applications and reserves the right to refuse acceptance. Further information to be attained.

9.1 Applications for Club Affiliation/Notification of Closure

9.1.1 SA Rhodesian Ridgeback Club

This club was disaffiliated by Fedco at the Fedco 06-2022 meeting. In accordance with Regulation 9.3 of the Articles:

Whenever a Club has been disaffiliated under provisions of sub-paragraph 9.1 and 9.2 of the Article, it may submit a request to the Federal Council for reinstatement to the list of Affiliated Clubs and the Federal Council may, on consideration of all the circumstances, grant reinstatement on such terms and conditions as may be decided including payment of all sums due and payable to the KUSA and provided such appeal is received by the Secretary within fifteen (15) months from the date of the Federal Council’s meeting at which the decision to disaffiliate the Club was taken.

The office received a request from Ms Arnel Sauer regarding the establishment of a Breed Liaison Council with KUSA for a particular breed (Golden Retrievers) and the process required to establish an “Advanced Registry” that will monitor and document the minimum breeding requirements for Golden Retrievers.

The following apply:

Regulation 20.3 of the Articles

20.3 Breed Councils

20.3.1 The Federal Council may on unanimous request from all the Specialist Clubs of a particular breed establish a Breed Council, the objects of which shall include the welfare of, interest in, breeding and importation of a particular breed of dog, provided the Executive Committee is satisfied that the body so formed is able to administer its own affairs and recommend to the Federal Council that such a Breed Council be established subject to its right to revoke any such delegation at any time and may delegate all or any of its power under this Constitution to such a Breed Council.

The office seeks advice regarding a response to Ms Sauer.

10.2 Members’ Advert KUSA Website – Mrs N van Buuren.

Objection to the unpublishing of advert posted on the KUSA website .

Member to be advised of requirements to be met.

10.3 Handler’s Class – handling of a bitch in season by Child and Junior Handlers

MA requested that consideration be given to amend the official KUSA Handler Entry Form to state that bitches in season may not be entered in Child and Junior Handler classes. As this would require that amendments be made to Schedule 3 Appendix 3, MA to table a proposal via the WC Provincial Council for consideration at Fedco 06-2023.
