Persons suspended in terms of KUSA Disciplinary Rules
as at 24.07.2023:
Ms N Baxter (Gauteng) – Case No. 02-2023
From 1 July 2023, the Respondent Ms N Baxter is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at, a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club for a period of six (6) months.
In terms of Rule 11.5 of Schedule 01, the DSC ruled that the penalty be suspended in full for a period of three (3) years (ending 30.06.2026) on condition that the Respondent does not contravene any of the provisions provided for in Rule 4 of Schedule 01, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint during the period of suspension.
Furthermore, the DSC ruled that the Acting KUSA Secretary, and Chairman of the Executive Committee (Exco), withdraw the awards given to Miss Baxter’s dogs in terms of Schedule 3, Regulation 18.1, namely:
- Exhibit 53 – Achante Breaking New Ground at Strathaven JM (ZA014196B21) – RCC award
- Exhibit 54 – Strathaven No Strings Attached (ZA008908B22) – Best Puppy in Breed
No appeal was lodged.
Mrs N van Dyk (E. Cape) – Case No. 1-2023
From 1.06.2023 the Respondent, Mrs N van Dyk, is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence for twelve (12) months, with the first six (6) months to be enforced in its entirety and the remainder be suspended for a period of three (3) years (ending 31.05.2026) on condition that the Respondent does not contravene any of the provisions as provided for in Rule 4 of Schedule 1 or any other provision in the KUSA Constitution, Rules and Regulations that would form the basis for a valid complaint in terms thereof during the period of suspension.
NOTE:
The Respondent is not disqualified from registration, recording or transfer of a dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee, or of the progeny of such a dog.
A dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee is not disqualified from exhibition or competition or evaluation.
No appeal was lodged.
Mrs K Livingstone (KZN) -Case No. 3 -2022
From 15.11.2022 for twelve (12) months, with the first six (6) months to be enforced in its entirety and the remainder be suspended for a period of three (3) years (ending 14.11.2025) on condition that the Respondent does not contravene any of the provisions as provided for in Rule 4 of Schedule 1 or any other provision in the KUSA Constitution, Rules and Regulations that would form the basis for a valid complaint in terms thereof during the period of suspension.
Rule 11.1.2
the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence.
NOTE:
The Respondent is not disqualified from registration, recording or transfer of a dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee, or of the progeny of such a dog.
A dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee is not disqualified from exhibition or competition or evaluation.
No Appeal was lodged.
Mr G Thompson (Gauteng) – Case No 3-2019
From 19.08.2019 for three (3) years, two of which are suspended for five (5) years:
Rule 11.1.2:
Suspension or exclusion from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club;
NOTE:
The DSC confirmed that the above penalty only applies to the Respondent in his personal capacity and does not in any way apply to dogs that are owned and registered or recorded in his name, or owned and registered or recorded by him jointly, viz such dogs may be entered and exhibited at KUSA licenced events, but without the presence of the Respondent.
Rule 11.1.5:
Disqualification from judging at, or taking part in the management of a Show, Obedience Class, Working Trial or Field Trial or other event held under a KUSA licence;
The initial 12 months of the above penalties take effect on 19.08.2019 until 18.08.2020. The remaining twenty-four (24) months will be suspended for a period of five (5) years until 18.08.2024 on condition that the Respondent does not contravene any of the provisions as provided for in Rule 4 of Schedule 1 or any other provision in the KUSA Constitution, Rules and Regulations that would form the basis for a valid complaint in terms thereof during the period of suspension.

Rule 8.1:
Expulsion for life, in terms of the provisions of Rule 8.1 of Schedule 1, from Membership of the Kennel Union and any Affiliated Club;
Rule 8.2:
In terms of the provisions of Rule 8.2 of Schedule 1, the Defendant is suspended from taking part in or having any connection with or attending any KUSA licensed Show, Obedience Classes, Working Trial or Field Trial or any other event held under a Kennel Union license or from acting as an officer of any KUSA Affiliated Club for life.
Rule 8.3
In terms of the provisions of Rule 8.3 of Schedule 1, the Defendant is disqualified from registration, recording, transfer, exhibition or competition of all dogs owned by him or registered or recorded in his name, or owned and registered or recorded by him jointly with another or others, or owned and registered or recorded in the name of a nominee, or the progeny of any dogs owned by him or owned or registered or recorded by him jointly with another or others, or owned or registered or recorded in the name of a nominee, for life;
Rule 8.5
In terms of the provisions of Rule 8.5 of Schedule 1, the Defendant is disqualified from judging at or taking part in the management of a Show, Obedience Classes, Working Trial or Field Trial or other event held under a Kennel Union licence, for life;

Rule 8.1
Expulsion from membership of the Kennel Union and any Affiliated club for Life:
Rule 8.9 The above “life expulsion” is suspended in full, but only after an initial period of two years has elapsed since the penalty came into effect and on condition that the Defendants must re-apply for KUSA membership after this period, which membership can only be approved in the event of the Defendants, at the sole discretion of Exco, having met certain conditions and have further paid the fine in full as referred to below.
Rule 8.2 - suspended from taking part in or having any connection with or attending any Show, Obedience Classes, Working Trials or Field Trials or other event held under KUSA license or from acting as an officer of any Club.
Rule 8.6 and 9.1 – fine of R6000 (jointly) to be paid on or before 30 October 2009. Ito provisions of Rule 9.3 of Sch 1, in the event of the Defendants making default in payment of this fine imposed on them, they shall for so long as such default continues, be suspended as provided for in Rule 9.2 of Schedule 1 pending the decision of the Federal Council on such alternative penalties that may be determined as the result of a default.
