5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2023 KUSA (Thuynsma & Moss) vs N van Dyk

The Disciplinary Hearing was held 11.05.2.23

Findings:

After careful consideration of all the submitted evidence, documents and affidavits, the DSC

unanimously reached the following decision, on a balance of probabilities, with regard to the case before them:

The DSC found that the complaint was fully substantiated and found that the Respondent wilfully engaged in conduct that was improper, disgraceful and disrespectful and which was prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith. They therefore found the Respondent guiltyin respect of Schedule 01 Rules 4.1.1, 4.1.1.4, 4.1.6, Schedule 04 Regulation 25 of the KUSA Constitution, and Schedule 09 Code of Ethics Regulations 1.3, 1.4, 2.5, 5.1, 5.3 and 5.17.

Penalties:

In terms of Rule 11.1.2 of Schedule 01, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or any other event held under KUSA licence for a period of twelve (12) months.

The first six (6) months of the sentence is to be enforced in its entirety . In terms of Rule 11.5 of Schedule 01, the DSC ruled that the remainder of the sentence is to be suspended for a period of three (3) years on condition that the Respondent does not contravene any of the provisions provided for in Rule 4 of Schedule 01, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint during the period of suspension.

The Respondent is not disqualified from registration, recording or transfer, of a dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee, nor the progeny of such a dog.

A dog owned by her or registered or recorded in her name, or jointly with another or others, or in the name of a nominee is not disqualified from exhibition or competition or evaluation.

The DSC ruled that the above penalty will take effect on the 1 June 2023.

No Appeal was lodged.

5.1.2 Case 02-2023 KUSA (Battey) vs Baxter

The Disciplinary Hearing was held on 20.06.2023.

Findings:

After careful consideration of all the submitted evidence, documents and affidavits, the DSC unanimously reached the following decision, on a balance of probabilities, with regards to the case before them:

The DSC found that the complaint was fully substantiated and found that the Respondent wilfully engaged in conduct that was improper, disgraceful and disrespectful and which was prejudicial and injurious to the interests of canine affairs and to members, officials and persons concerned and connected therewith. They further found that the Respondent failed to return to the ring with the RCC dog for the selection of Reserve Best of Breed, as well as bring the Puppy in for the Puppy Group challenge when called for by the Ring Steward.

They therefore found the Respondent guiltyin respect of Schedule 01 Rules 4.1.1, 4.1.1.4, 4.1.6, read with Schedule 3 Regulations 18.1, 18.3, 18.5, 18.6, 37.3, as well as the provisions of Schedule 9 Regulations 1.3, 1.4, 1.7, 5.1, 5.17, 5.18, 5.21 and 5.25 (Code of Conduct for KUSA Members) of the KUSA Constitution.

Penalties:

In terms of Rule 11.1.2 of Schedule 01, the Respondent is excluded from taking part in, or having any connection with, or attending or participating or handling a dog at, a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club for a period of six (6) months.

In terms of Rule 11.5 of Schedule 01, the DSC ruled that the penalty be suspended in full for a period of three (3) years on condition that the Respondent does not contravene any of the provisions provided for in Rule 4 of Schedule 01, or any other provisions in the KUSA Constitution, Rules and Regulations that would form the basis of a valid complaint during the period of suspension.

Furthermore, the DSC ruled that the Acting KUSA Secretary, and Chairman of the Executive Committee (Exco), withdraw the awards given to Miss Baxter’s dogs in terms of Schedule 3, Regulation 18.1, namely:

1. Exhibit 53 – Achante Breaking New Ground at Strathaven JM (ZA014196B21) – RCC award.

  1. Exhibit 54 – Strathaven No Strings Attached (ZA008908B22) – Best Puppy in Breed

The DSC ruled that the above penalty will take effect on the 1 July 2023.

No Appeal was lodged. Awards to be withdrawn .

5.2 SHOWS

5.2.1 Applications for Second Championship Show

5.2.1.1 Port Elizabeth Cluster Weekend 04-07.04.2024:

The above Clubs are applying for second licences for Breed and Disciplines on the above weekend.

5.2.1.2 Swartland Kennel Club 19.04.2024:

The above Club is applying for a second Championship Show licence, as in previous years, to form a bumper Malmesbury weekend which includes two FCI-CACIB Shows already approved by the FCI.

5.2.1.3 George & Outeniqua Kennel Clubs 14-16.06.2024 :

The above Clubs are applying for a second Championship Show licence, as in previous years, to complete their Oudtshoorn 4-show weekend.

5.2.2 Show Return Penalties (Schedule 08)

5.2.2.1 Transvaal Working Trials Association(Shetland Sheepdog Club)– 13.05.2023.

The above Club is requesting leniency with regards to the penalties imposed for their Working Trials Show.

E-mail attached.

Request to waive payment of Show penalties was denied. Instead, lenient payment terms were offered. Payment of the invoice within 30-days is waived on the proviso the penalty is paid in full prior to the end of current financial year (31 August 2023).

5.2.2.2 Saint Bernard Association of Northern Gauteng – 27.05.2023

The above Club is requesting leniency with regards to the penalties imposed for their Championship Show.

Extenuating circumstances came to light and were taken into account. By majority vote and with one objection, it was agreed that the penalties incurred should be paid out of the KUSA Classic bank account.

5.2.2.3 Shetland Sheepdog Club – 07.05.2023

The above Club is requesting leniency with regards to the penalties imposed for their Discipline Championship Show.

5.2.4 Entry in contravention of the Regulations in Schedule 3:

5.2.4.1 The Office received a Junior Merit application for Zandegal Iconic Prince William (ZA003070B23). The dog is co-owned but all awards were issued only in the name of the first Owner. The dog has since been transferred into the name of the first Owner as the second Owner apparently has no interest in the dog. (See attached)

May the Junior Merit title be awarded to the Dog?

After discussion, it was agreed that the Junior Merit title may be awarded and a R500 fine be imposed for the administrative errors on the show entry form in terms of Schedule 3, Regulation 33.2 .

5.2.5 Schedule 3 Reg. 14 & Reg. 19.8 – Exclusion of Dogs

5.2.5.1 Temporary Exclusion Order – Bullmastiff – Aire Del Norte De El Guardian Del Bosque of Lemietrivier – Reg No. ZA001047C19

It was reported that the abovementioned dog acted aggressively at the Swartland Kennel Club (1) Championship Show held 22.04.2023 where it reportedly attacked a Bearded Collie. The Office contacted the Club on 08.06.2023 to obtain the documents in the correct format. Statement received from Owner and witnesses (See attached).

Preliminary TEO issued 06.06.2023.

5.2.5.2 Temporary Exclusion Order – Australian Shepherd – Limited Kascaro of Modailene – Reg No. ZA001023C22

The Office received a report of an alleged incident of aggression that occurred at Swartland Kennel Club (2) Championship Show on 21.04.2023. The Club has submitted the relevant information, but the Office is following up to secure the documentation in the correct format (see attached). The Owner has submitted a statement. The Owner has requested approval of a training facility near Humansdorp where she will be based for the next few months and has sent through a brief on the facility (see attached).

TEO confirmed 27.06.2023.

Noted. The owner to be referred to the Baakens Valley Working and Herding Breeds Club.

5.2.5.3 Temporary Exclusion Order – Staffordshire Bull Terrier – Delu Lady Luck – Reg No. ZA006185B15

The Office received a report of an alleged incident of aggression that occurred at North West Staffordshire Bull Terrier Club Championship Show held 05.05.2023.

TEO confirmed 27.06.2023.

5.2.5.4 Temporary Exclusion Order – Rhodesian Ridgeback – Eskhaleni Gem of Mnumbumba – Reg No. ZA005860B22

The Office received notice of an alleged incident of aggression that occurred at Hottentots Holland Kennel Club Non-Championship Show on 04.06.2023 where the dog bit the Judge. The Club has submitted a copy of the Incident Report Form (Annex A) and a statement from the Judge (incorrect format) and Ring Steward (correct format) The Judge’s statement has since been submitted in the correct format. (see attached). A statement has been received from the Owner. (see attached).

Noted. The dog is to complete a training course with a Club, pass CGC Bronze and thereafter be judged by 2 Judges.

5.2.5.5 Temporary Exclusion Order – Golden Retriever – Savannalands Maverick – Reg No. ZA003232B19

It was reported that the abovementioned dog acted aggressively at the George Kennel Club (1) Championship Show held 09.06.2023 where it reportedly attacked a Golden Retriever. The Club has only submitted the Incident Report Form (Annex A) and all statements are still outstanding.

5.2.7.3 KUSA Classic 2025

A casual enquiry has been received from the WC Provincial Council to host the KUSA Classic event in

Cape Town in 2025.

See the attached email. Lori Thornhill requests that framework documents be forwarded so that they may determine whether it would be viable to go ahead. The Shows Department requests permission to forward the KZN KUSA Classic 2024 application documents and budget.

Noted. Permission granted for the Shows Department to forward the relevant documents.

9. ANY OTHER BUSINESS

9.1 Applications for Club Affiliation/Notification of Closure

9.1.1 Notification of Club Closure

Natal Coast Kennel Club held their AGM on 15.02.2023 where it was agreed to close the Club. It was further agreed that remaining finances were to be donated to the Highway Kennel Club.

However, the office noted some apparent irregularities in the financial statements for financial years ending 2021 and 2022. These have been discussed with KZN Provincial Council Chairman, Mr Michael Vorster, who has agreed to investigate further. Annual Financial Statements attached to Agenda.

MH to liaise with KZN Provincial Council Chairman – Mr M Vorster – and report back at the next Exco meeting. See attached response from the Club.

Natal Coast Kennel Club have submitted revised financials for 2021 and 2022.

The revised Financials submitted did not meet requirements. Carried forward from previous meeting.

The Club has since requested more information from the auditors on 07.06.2023 as all books were handed over to them.

MH and YJ to liaise with Michael Vorster regarding the outstanding financials.

9.1.2 Bearded Collie Club of Gauteng will be hosting their AGM on 28.05.2023 and have included an item to dissolve the Club.

MA reported that the reason for the decision to dissolve the club was due to lack of support at KUSA Events. BJ proposed that MA suggest that the Club be changed to a Herding Club. MA to propose this suggestion at the next AGM and report back on the final decision.

The Club hosted their AGM on 17.05.2023 but as no quorum was reached, the meeting was postponed to 24.05.2023. The Agenda contained an item to dissolve the Club. In terms of the Constitution, a quorum at an AGM must consist of 10 members with voting rights. However, the Club currently only has five (5) paid up members. All members voted unanimously in favour of dissolving the Club. It was agreed that the remaining funds (R2,652.64 as of 31/12/2022) would be used for a stand at PetExpo to promote the breed. (See attached)

MA to check whether there are any other assets such as trophies etc. and report back.

MA confirmed that there were no trophies or other assets to be declared.

9.1.3 Club Affiliation

Objection to new Club - Working Weimaraner Club

The KUSA Office received notification of a possible new Club forming on 28.03.2023. The Club provided details of their new Committee and a Letter of Support and requested a Constitution be drafted for them. The Club had consulted with DOGSPC regarding the process to form a Club and had also been in touch with the Field Trial Liaison Council.

Subsequently, objections were received from The Weimaraner Klub on 20.04.2023 and 10.05.2023.

CPA to draft a letter offering that BJ act as intermediary to mediate between the two parties.

A further e-mail has been received from Mr Frank Winder together with a letter from the Rainbow Hungarian Vizsla Club and attached to agenda.

The affiliation documents for the Working Weimaraner Club are attached. Ratification of the Club by the Provincial Council is on the NAPC Agenda, the meeting of which was postponed to 21.06.2023.

Affiliation approved subject to acceptance by the NAPC. The office received an email from the NAPC Secretary confirming acceptance for affiliation at the NAPC meeting of 21.06.2023.

See attached a letter received from Mr Frank Winder dated 07.07.2023 in response to the KUSA Secretary’s letter informing the Weimaraner Klub of Exco’s decision to accept the application for affiliation of the Working Weimaraner Club .

BJ advised that the Chairman of DOGSPC – Mr G Robinson should contact Mr Winder and address the concerns raised by the two DOGSPC Clubs

9.1.4 Pekingese Association

The Club took a decision at their AGM of 12.06.2023 to close. Funds will be distributed to three similar Clubs. (See attached).

  • Dogs recorded on the Non-registry Breed Listing (AB) may be bred to a Primary Breed registered dog (B), Breed Appendix Register (A) & (AA) or Non-registry Breed Listing (AB) dog where Exco has granted permission for the lifting of the KUSA imposed Breeding Restriction. Progeny remain on the Non- Registry Breed Listing (AB) until the criteria have been met for progressing to Breed Appendix Register (AA).

A KUSA imposed Breeding Restriction will be placed on each of the pups with the Notation-“Not

authorised for Breeding*” listed on the Non-registry Breed Listing Certificate

  • To register any progeny, will have to apply to Exco prior to mating to lift the KUSA imposed Breeding Restriction and both Dam & Sire must be DNA Profiled.
  • The KUSA IMPOSED Breed Restriction will only be lifted after consideration of all extenuating and extraordinary circumstances and if deemed in the interest of improvement of the local gene pool of the Breed.
  • All progeny / pups must be microchipped – mating and lifting of KUSA imposed Breeding restriction would have to first have been approved by Exco
  • Other notations to appear on the Non-registry Breed Listing Certificate:

“Progeny N/E for Primary Breed Register”.

“N/E Breed Champ Status”

“Not Eligible –Export Pedigree”

Not approved. Approval should have been sought from Exco prior to the mating having taken place. Furthermore, the breeding of French Bulldogs with colours that are not recognised and that are not in accordance with the Breed Standard is not in the interest of improvement of the local gene pool and cannot be supported and condoned.

10. GENERAL

10.1 At the WC Provincial Council meeting MA was asked by The Cape Heritage Bull Terrier Club to bring to Exco’s attention the need to to inform and educate Judges with regards to the measuring of Miniature Bull Terriers in the ring. It was suggested that JEC be approached. BJ stated that the Club should correspond with JEC directly.
