THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA HELD AT 13H00 ON TUESDAY, 21 JULY 2020, VIA SKYPE

PM advised that Sheila Thornberry will not be attending this meeting and that she will be retiring as of the 31 July 2020 after nearly 40 years of service.

BJ advised PM to extend Exco’s grateful thanks to Sheila for all her hard work and dedication over the years.

2. MINUTES

The Minutes of the meeting held on 18.06.2020 were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.3 Pinetown GSD Club & ABTC (Exco 03-20 item 9.2.1, Exco 04-20 item 3.4, Exco 05-20 item 3.3, Exco 06-20 item 3.3)

Letter circulated 13.03.2020.

MCA advised that a Provco meeting would be held on 21/06/2020 to address any problems and misunderstandings regarding the status of these Clubs within KUSA.

It was further recorded at Exco 06-2020 that it is the responsibility of Exco to ensure that the GSD Liaison Council was functioning in accordance with its Constitution and operating optimally.

BJ requested PM to liaise with Mr Gérard Robinson (GR) on a letter to be sent to the GSDLC by Exco. It was agreed that GR should be approached to represent Exco at any meeting convened by the GSDLC.

A letter to be sent to the GSDLC and its delegates requesting that a Special General Meeting (SGM) of the GSDLC take place no later than Saturday, 22 August 2020, via Skype, or on another virtual platform. In accordance with a decision taken at Exco 06-2020, GR would represent the Executive Committee at the meeting and, in the absence of a Chairman, act as Chairman of the Special General Meeting until the election of a Chairman. Mrs Jenny Hubbard (JH) and, depending on his availability, NdP, will act as co-observers. The Executive Committee directs the adoption of a new Constitution which enumerates the conditions under which it is prepared to continue delegating its powers to the GSDLC.

3.4 Use of Prong Collars (Exco 04-2020 item 5.9.2, Exco 05-2020 item 5.9.2, Exco 06-20 item 3.5)

At Exco 04-2020. it was agreed that the notice prepared by the Fedco Portfolio-holder for IGP in conjunction with the KUSA Office be circulated to Clubs and Provincial Councils and posted on the KUSA website. NdP’s input was required to amend the Regulations to make them more stringent, particularly with regard to training classes.

Due to a shuffling of priorities relating to COVID-19, the above-mentioned notice has not yet been circulated and will be sent to Clubs at the appropriate time.

The notice will be circulated once instruction to do so has been received from Fedco Portfolio-holder for IGP.

5.1 DISCIPLINARY SUB-COMMITTEE

NdP undertook to produce a manual after the lockdown, with the assistance of BJ, for the information of DSC members. Thereafter a Skype meeting will be arranged.

5.2 SHOWS

5.2.1 Applications for Second Championship Shows

Northern Tshwane Kennel Club Second Championship Show

Northern Tshwane Kennel club was granted permission for a second Championship Show that was to be held in May this year based on the fact that they had secured at least three foreign Judges. Due to COVID-19 restrictions, the Show was postponed till next year. Given the travel restrictions likely to remain in force for a considerable time, the Club is finding it difficult to secure foreign Judges for 2021, since Judges are not committing to appointments and might not be able to book international flights. The Club is requesting permission to be allowed to hold the Second Championship Show using local Judges, with the undertaking that they will contract foreign Judges for 2022.

5.2.1.1 Champion Application

The KUSA office received an application for Champion Status from Mr M van Niekerk (who is a KUSA Member) who had entered a dog owned by him at four of the five shows mentioned below. However, the dog in question, a Golden Retriever, QUILLQUEST KIMORA LEE, ZA054256B10, is still recorded in the registered ownership of Mr W & Mrs M Ackhurst.

A letter (see attached) was sent to Mr Van Niekerk, which is tabledfor Exco's attention. Copies of the CCs awarded to the dog are also attached .

It was agreed that, since the dog was not entered under the correct registered ownership, the 4 Challenge Certificates won when entered in the ownership of Mr M Van Niekerk, are to be withdrawn and the dog will be required to win 4 new Challenge Certificates when entered in the names of its registered owners in order for Championship status to be granted.

5.2.2 Awards at Kennel Association Championship Show - 29 February 2020

Mrs G.L. Abraham sent an email (see attached) in respect of Staffordshire Bull Terrier, Reg. No. ZA008990B18 - Stapphire Royal Warrior. The Club advised that no alterations could be made as information is as supplied at the time on the entry form.

The entry submitted by the exhibitor states that she, Mrs G.L. Abrahams, was the registered owner. However, the registered owners were, in fact, still Mrs DG Jackson and Mr GW Ousman. Mrs Abrahams is also not a current KUSA Member.

7.

ENTRY FOR EXHIBITION

Except as otherwise provided in the By-Laws applicable to a particular Discipline, only Members of the Kennel Union shall be entitled to enter and have dogs in their registered ownership compete in any Championship Dog Show, Championship Obedience Class, Championship Working Trial, Field Trial Championship Open Stake or Field Qualifier or any other Championship event, licensed by the Kennel Union, save for Breed Classes offered at Specialist Club Championship Shows, where entries will also be open to non-members.

7.1.1

When an entry is submitted to a show-holding club, a dog shall be solely and unconditionally the property of the Exhibitor and at the time of exhibition it shall be registered in the Exhibitor’s name at the Kennel Union, or at a registry formally recognised by the Kennel Union in a written agreement.

It was agreed that , since the dog was not entered in the correct ownership, the Challenge Certificate is to be withdrawn and the Reserve Challenge Certificate winner is to be awarded the Challenge

Certificate. The Club and Mrs Abraham to be advised accordingly.

5.2.2.1 2021 Events Calendar

The provisional 2021 KUSA Events Calendar has been completed and is ready to be placed on the KUSA Website. The Calendar was forwarded to the Shows Task Team prior to uploading for final input. Once uploaded, the Calendar will be sent to all Provincial Councils and requested to forward to

their Clubs asking them to confirm the provisional show dates with Mrs Bastick in respect of all their events for 2021.

AB has sent 2021 Events Calendar to Mrs Carol Immelman (CI) for approval and it will be sent out as soon as approved.

5.2.3 Schedule 3 Reg 14 – Exclusion of Dogs & Reg 19.8

KF to arrange Skype meeting to discuss the revised TEO Procedure ‘final’ document circulated by BJ on 01.04.2020. All existing forms and constitutional references are to be circulated to Exco members prior to Skype meeting to be arranged before August Exco meeting.

5.2.4 OTHER CLUB / SHOW MATTERS

COVID-19 STATE OF DISASTER - SHOW STATUS

The KUSA office has received numerous requests from Sub-Committees for DJ, AG, TT, IGP, and from various Dog Training Clubs, requesting whether they may start training and wanting to know when they may host their events.

We have previously advised that, under Level 3 lockdown regulations, no events, or training, are permitted. The interested parties need to be advised that KUSA was monitoring the lockdown situation closely and that they would be notified of any changes.

Should we add a notice on the KUSA website? The last notice was 8 May 2020 in respect of allocation of new dates for postponed events. Level 3 is scheduled to continue till 15 August 2020, or beyond. At this stage it is not even clear whether Training and Events will be permissible under Level 2.

Clubs are not confirming with KUSA when they cancel their shows and need to be reminded by email to keep the KUSA Office informed. There are still 6 shows in August, 17 in September and 35 in October listed as not having been cancelled. Some Clubs have clearly adopted a ‘wait-and-see’ attitude.

AB advised that the KUSA Office has received enquiries from training clubs wanting to resume training and requesting an updated communication.

NdP advised that, under the current lockdown regulations, public gatherings are not permitted and, in consequence, Exco cannot sanction any gathering, whether for training or other activities.

After deliberation, it was decided that all show licences already issued up to 31.12.2020 need to be rescinded. Should subsequent developments permit, licences may be reinstated upon application. Needless to say, Clubs will not sacrifice their slots on the Events Calendar.

5.2.5 KUSA Classic

All the 2020 KUSA Classic Events have been postponed or cancelled due to COVID-19. BJ will report on any further information from the Task Team established to consider the allocation of new Show Dates.

5.3 JUDGES EDUCATION COUNCIL (JEC)

5.4 JUDGES

Contracts for Judges whose services were cancelled in 2020 due to Covid-19, but who are invited to judge the same Discipline Class/Breed/Group/s & finals for the same Club and Event/s in 2021.

The Shows task team has confirmed that all Judges are required to sign contracts with the new date(s) confirming their availability and, if applicable, confirm accommodation, costs, etc., (for if out-of-Province or foreign Judges.)

“With regards to the amended by-laws, the members of the committee have all accepted/approved. My question to you is should I just sign the last page and return to you or must each page be initialled?

With regards to the AGM of this Sub-Committee, we have not had a meeting. It will be by the end of July 2020 that we have an AGM. This is due to the problem that I have not been at the same place as my computer and therefore have not seen any emails since the beginning of February 2020.”

The NSC Constitution states - The NAgSC shall hold a meeting (in terms of 10.1) between the first day of January and the last day of June each year to be designated the Annual General Meeting at which the Convener shall report on the activities of the NAgSC since the last Annual General Meeting.

9.8 Kennel Name Application – WC Sim

Application received from Mr WC Sim for the registration of Kennel Name “Northwind”, previously registered in the name of Mr DK Riley. Mr Riley’s membership application was rejected at Exco 03-2020 and the Northwind Affix subsequently lapsed on 30/04/2020, making the Kennel Name available to other KUSA members as from 31/05/20, provided there were no conflicts and subject to Exco’s prior approval.

This application was unanimously accepted, obviously subject to the required checks being done by the KUSA Office on the FCI Affix database to ensure that this Affix, or a substantially similar one, was not registered with the FCI.

9.9 Fedco 06-2020

Fedco 06-2020 Minutes circulated 16/07/2020.

BJ sought ratification from Exco that Mrs Claire Patterson-Abrolat be appointed, on behalf of Exco, to Revisit and update the rules for CGC, since she had offered this assistance to CI.

10. GENERAL

10.1 Mr L Kruger – Request to change the name of a dog registered in February 2019.

After discussion, it was agreed that the Executive Committee was not vested with the authority to override Schedule 2 Regulation 6.1 Regulation that provides that, subject to certain conditions, the common name of a dog may only be changed if received within four (4) months of the date of registration of the dog.

10.2 South African Dog Breeders Association (SADBA)

NdP advised that a document from the SADBA has been brought to his attention in which it is claimed that the SADBA is compliant with the Animal Improvement Act and operates in terms of the Act. To his best knowledge, this is a false claim and NdP believes that action should be taken to rebut such claims by other registries. On the instruction of the Executive Committee, PM undertook to contact JH to request her to pursue this matter with the Department of Agriculture, Land Reform & Rural Development as a matter of urgency.

10.3 Email circulated to clubs

BJ advised that several clubs had received an emailed request on information regarding its members. KF advised that he had received this email from the same person and it appears that the person is conducting market research on behalf of a KUSA member for a new dog-related product.
