At the July Meeting it was confirmed that, in terms of the Promotion of Administrative Justice Act, there should be a process whereby a person who does not agree with a decision made by an administrative body (e.g. the Exco, a Provco or Club) should be able to appeal to a higher authority to take the matter under review.

NdP undertook to prepare a clause for inclusion in the Articles of the Constitution for Exco to consider and table to the Federal Council.

[NdP was not present at the meeting, but wished it to be clarified that the above applies to KUSA’s “public” functions, i.e. its functions as a Registering Authority for purebred dogs under empowerment from the DAFF.]

3.3 Breeders’ Advertisements – KUSA Website (Exco 07-2019 item 9.6)

The following is carried forward from the previous meeting:

Current procedure and conditions for acceptance and processing of Breeders’ Advertisement applications.

At the July meeting, NdP advised that a clause needed to be included to the effect that we have the right of refusal or immediate removal of an advertisement without giving notification. Notification can be given afterwards.

Brief discussion ensued on whether the format and layout of the advertisements on the website should be reviewed and how much income they generated. It was also suggested that the heading should be changed to “KUSA Members’ Advertisements”.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 03-2019

Hearing held Tue 30.07.2019 by teleconference. Decision circulated to Exco and confirmed.

Subject to appeal.

5.1.2 Case 04-2019

After obtaining an expert opinion, the SCI decided that insufficient evidence existed for the matter to be progressed to the DSC. Further noted that no complaint deposit had been submitted.

5.2 SHOWS

5.2.1 Applications for Second Championship Shows

5.2.1.1 Note the following additional suggestions from Fedco (Fedco 06-2019 item 8.19):

With the benefit of hindsight, the affiliation of certain All-breeds Clubs should perhaps have been more carefully considered at the time of their application, but it was also acknowledged that these affiliations had taken place in a more favourable economic climate. However, since these Clubs now existed, the situation around the granting of 2 nd Championship Show licences needed to be even more carefully managed by Exco in future.

In summary, Fedco’s additional suggestions to curtail the number of 2 nd Championship Shows included:

Ÿ As far as possible, to restrict any licences granted in non-populous [Note: Confirmed that this was a typo and that it should read “populous”] areas.
Ÿ Where licences were justified, to permit no more than one extra Show per cluster weekend. There was no justification for turning a two-Show weekend into a four-Show weekend.
Ÿ Decline permission for 2nd Championship Shows to Clubs which had been part of clusters prior to “divorce”; the example of Whale Coast and Overberg Kennel Clubs cited.
Ÿ Reconsider 2nd (sometimes 3rd) Championship Shows granted to Specialist Clubs where the owners of exhibited dogs were not even required to be members of KUSA. To contain the proliferation of Shows of Specialist Clubs and the abundance of CCs on offer for certain Breeds, Exco might well consider a system of granting 2nd Championship Show licences to Specialist Clubs on a rotation basis.
Ÿ There was probably also a good case to be made for a more stringent application of Schedule 3 Regulation 5.16: “Where a Club, for any reason whatsoever, has been unable to finalise its Draft Schedule twelve (12) weeks before the first day of the Show, no licence shall be issued for that event.”

The Chairman requested the Chairman of Exco to discuss the above and other suggestions with her Committee and to revert at Fedco 12-2019 with firm criteria to be applied by Exco in its future granting of 2 nd Championship Show licences.

5.2.1.2 George & Outeniqua Kennel Clubs – 13-14 June 2020 (Exco 07-2019 – item 5.2.1.3)

The Clubs are applying to host second Breed Championship Shows in conjunction with their first Championship Shows as they did in 2019. As reported at Exo 07-2019, all documentation is up to date.

Following Exco 07-2019 an email was forwarded to the Clubs requesting them to advise KUSA what steps they were planning to take to improve the Show administration.

Response received and circulated. After discussion and consideration of the reply, it was agreed that the granting of a second Championship Show for each of the above Clubs was justified.

5.2.1.3 Northern Tshwane Kennel Club - 17 May 2020

The above Club is applying to host a second Championship show in conjunction with its first Championship Show and FCI Show on the same weekend.

Affiliation, AGM & financials, show returns & payments are all up to date. Non-Championship Shows are held each year.

Motivation attached to agenda. (Note: In May 2019 the Club had 6 foreign Judges)

Decision held over pending clarification of the number of overseas Judges have been appointed.

5.2.3 Schedule 3 Reg 14 – Exclusion of Dogs & Reg 19.8

5.2.3.1 Temporary Exclusion Order (TEO) - Apollo Prince of Stjephanic House of Torbrit Reg No ZA001028C16

BJ has made the necessary arrangements for the dog to be examined on 24.08.2019 at Goldfields Kennel Club.

It was confirmed that the above Rottweiler has successfully passed the above-mentioned examination.

It was agreed that the TEO be withdrawn. Apollo may now be entered and exhibited at KUSA Shows. The Secretary to immediately notify those concerned.

5.2.3.2 Western Province Boxer Club – Non-Championship Show - Disciplines 17.03.2019 (Exco 05-2019 item 5.2.2.2)

TEO issued following Exco 05-2019 to Border Collie “Chloe” Reg No ZA001057Y16, owned by Mr HD Armour.

The CGC Bronze has now been successfully completed.

LT, BJ and LW were to liaise on how to deal with the examination of this Obedience dog and, after further discussion, the following procedure was recommended for Working Discipline dogs:

When TEO has been issued to a Working Discipline dog for a first offence, the dog will be required to pass a CGC (Bronze). For a second offence, the dog will be required to pass a GCG (Gold). Should there be a third offence, the dog will be permanently excluded.

In addition to the above, the dog is to be tested in a ring situation, i.e. the dog is placed in a sit-stay, off-lead in a ring next to its handler. Three dogs are then walked, on-lead, around the dog at a distance of 2m and, if the dog does not move, then it is passed. This process is to be observed by a “Class C” Obedience Judge.

The Secretary was asked to immediately inform those concerned, i.e. the owner of the dog and the Chairman of the WC Obedience Sub-Committee.

5.2.3.3 Northern Tshwane Kennel Club – Championship Show held on 19.05.2019 – Border Collie

TEO issued in May 2019 to Border Collie Bitch Craignair Lasting Legacy Reg No ZA003853B18 Microchip No 953010002172748, owned by Mrs J Pott.

RJ advised that he had been informed that the owner has decided not to enter this dog at any further shows.

No further action to be taken for the time being.

5.2.3.4 Procedure and Cover Sheet for Reporting a Case of Dog Aggression at a KUSA-Licensed Show – Schedule 3 Regulation 14 (Exco 05-2019 item 5.2.2.3, Exco 06-2019 item 5.2.2.5)

“Cover Sheet to be amended as per suggestion tabled at Exco 05-2019.

All the Working Discipline Schedules are to be amended to include the wording of Schedule 3 Reg 14. The Regulation is to be included as a question in the Judges Exam on Rules and Regulations.

Note: Amendments to the various Schedules will need to be made and referred to Fedco.

NdP to look at wording of Regulation 14 with view to making provision for the imposition of a fine, should there be no report submitted to the KUSA Office.”

At the June Exco Meeting, LW read out a revised procedure, which was tabled at the Fedco informal discussion.

Fedco discussion indicated that clearer guidelines for TEO CGCs needed to be set.

5.2.4 OTHER CLUB / SHOW MATTERS

5.2.4.1 Collection of Blood at Shows for Health Testing Drive

The Western Province Boxer Club

Request for Inqaba Biotec™ to be permitted to be present at a Show late 2018 to take samples. This was approved by KUSA, provided a scanner was used to identify the dogs and any dogs not entered in the show would have an indemnity form completed.

This took place away from the main Show area due to KUSA Regulations which prohibit dogs not entered in the Show from being on the grounds.

Praetor Rottweiler Club

Permission requested to have a station run by Inqaba Biotec™ at its Show in September 2019 to collect blood for JLPP or DNA typing, giving owners the opportunity to have their dogs tested if they so wished. This will only be available to dogs entered in the Show and will be optional. Dogs are automatically scanned at Specialist Rottweiler Clubs and a scanner will be available also at the station. This was approved by KUSA in consultation with the Exco Chairman.

Approved , with the comment that it may be appropriate to compile a standard procedure document.

5. Subscription

a) The annual subscription fee shall be determined at the Annual General Meeting [ by the committee ], shall come into effect on the 1 January of the following year and is payable before the financial year end, namely 30 June This was approved via Round Robin so that the Club may put this clause into effect for its upcoming AGM.

With regard to any breed standards on the KUSA website that do not have pictures, appropriate wording is to be added where the picture would normally go.

10. GENERAL

10.1 Discussion ensued about outstanding payments owed to clubs.

10.2 Affiliation fees - AB reported that Club Affiliation fees are streaming in.

10.3 Terrier Club Eastern Cape (Exco 03-19) - DS reported that all outstanding matters and payments were up to date.

10.4 Requirements for International Champion – BJ advised that the wording on the KUSA website should be made clearer.

11. DATE OF NEXT MEETING

Thursday , 26th September 2019, at 13h00 Fedco 12-2019 will be held 30 November & 1 December 2019. Closing date for agenda items is 7 October 2019.

There being no further business, the meeting closed at 13h57 with a vote of thanks to the Chair.
