It was confirmed that, in terms of the Promotion of Administrative Justice Act, there should be a process whereby a person who does not agree with a decision made by an administrative body (e.g. the Exco, a Provco or Club) should be able to appeal to a higher authority to take the matter under review.

NdP undertook to prepare a clause for inclusion in the Articles of the Constitution for Exco to consider and table to the Federal Council.

3.3 Instagram (Exco 06-2019 item 10.3)

Instagram has been set up and was used at WODAC.

4. KUSA OFFICE

4.1 Office Report

After discussion the Office Report was approved.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 03-2019

Hearing scheduled for Tue 30.07.2019 by teleconference.

5.1.2 Proposed Amendments to Schedule 1

The proposed amendments to Schedule 1 were approved at Fedco 06-2019.

5.1.3 Case 02-2019 KUSA vs Mr L Kruger

Mr Kruger has taken the finding and penalties on review to the High Court of the Western Cape. The matter has been referred to the Attorneys to defend on KUSA’s behalf.

5.1.4 Refund of Complaint Deposit (Exco 06-2019 item 3.12)

Following enquiries about the refund of a complaint deposit from 2017, it was advised that confirmation of the bank details of the person concerned was awaited. The refund was in respect of a complaint that was not accepted by the SCI.

[Note: The refund has now been made.]

5.1.5 Case 04-2019

Under investigation. Expert advice awaited.

5.2 SHOWS

5.2.1 Applications for Second Championship Shows 2019

The decline in entries at KUSA Shows was debated at Fedco 06-2019. Fedco agreed that the granting of 2ndChampionship Shows needed to be even more carefully managed by Exco. Suggestions to curtail the number of Championship Shows were made and will be passed on to Exco to discuss once the Fedco Minutes are finalised. Exco to revert to Fedco 12-2019 with firm criteria to be applied by Exco.

After discussion it was agreed, in the meantime, to continue to apply the criteria already set down by Exco.

5.2.1.1 West Coast Kennel Club / Swartland - 2020 (Exco 01-2019 item 9.2.6, Exco 06-2019 item 5.2.1.6)

At the June meeting, Exco requested full details of which Shows will be held on the weekend and how the FCI Show will be split over 3 days.

Show Format will be:

Friday 19th June 2020 - Swartland KC - Championship Show 2

Friday 19th June 2020 - FCI Show - Group 3, Group 5 and Group 8

Saturday 20th June 2020 - Swartland KC - Championship Show 1

Saturday 20th June 2020 - FCI Show - Part Group 9, Group 1 & Group 4

Sunday 21st June 2020 - West Coast KC - Championship Show

Sunday 21st June 2020 - FCI Show - Group 7, Group 6, Group 10 & Group 2 - Finals

According to the FCI up to 7 days are permitted for an FCI CACIB event

[Note: At Exco 01-2019 it was decided that only one of the above Clubs would be given dispensation to hold a 2nd Championship Show in future. The Clubs are now requesting a 2nd Championship Show for one Club and an FCI Show for the other.]

Discussion indicated that an FCI Show was not considered to be a 2 nd Championship Show. It was further commented that previously the Clubs have successfully run two shows over a weekend and now they are asking to run an FCI Show in the place of one Championship Show. It should also be noted that following the George & Outeniqua Shows, a number of exhibitors travel on to the Malmesbury Shows the following weekend, and that these Shows should not be looked at in isolation.

Approved, with one objection.

5.2.1.2 Highway Kennel Club – Championship Show – 1 May 2020

The above Club is applying to host a second Breed Show on Friday 1st May 2020. (First application) together with its first Show on the same weekend.

Affiliation, AGM & Financials, Show returns & payments are all up to date. Non-Championship Shows are held each year.

Motivation attached to agenda.

After discussion the request for dispensation was approved.

5.2.1.3 George & Outeniqua Kennel Clubs – 13-14 June 2020

The above Clubs are applying to host second Breed Championship Shows in conjunction with their first Championship Shows as they did in 2019.

Affiliation, AGM & Financials, show returns & payments are all up to date. No Non-Championship Shows are held.

Motivation for 2020 attached to agenda.

After discussion the decision was deferred pending the Clubs advising what steps they are planning to take to improve the show administration.

It was further agreed that, going forward, where a lack of administration has been picked up by KUSA, Exco will be reluctant to grant dispensation for a second show as this will compound administrative problems.

5.2.2 Schedule 3 Regulation 5 Show Schedules – Reg 16 (Exco 06-2019)

"Where a Club, for any reason whatsoever, has been unable to finalise its Draft Schedule twelve (12) weeks before the first day of the Show, no licence shall be issued for that event."

5.2.3 Schedule 3 Reg 14 – Exclusion of Dogs & Reg 19.8

5.2.3.1 Temporary Exclusion Order - Apollo Prince of Stjephanic House of Torbrit Reg No ZA001028C16

Arrangements are to be made for the above dog to be examined by an appointed Judge at an upcoming Show. (BJ)

Any reply from FM Attorneys will be tabled, if received.

BJ has made the necessary arrangements for the dog to be examined on 24.08.2019 at Goldfields Kennel Club. ST to inform owner and send form to the Judge to complete.

5.2.3.2 Western Province Boxer Club – Non-Championship Show Disciplines 17.03.2019 (Exco 05-2019 item 5.2.2.2)

TEO issued following Exco 05-2019 to Border Collie “Chloe” Reg No ZA001057Y16, owned by Mr HD Armour.

Any further information will be tabled regarding suitable arrangements for this Obedience dog to be examined by Judges, once CGC has been successfully completed.

LT, BJ and LW to liaise on how to deal with the examination of the dog.

5.2.3.3 Northern Tshwane Kennel Club – Championship Show held on 19.05.2019 – Border Collie

TEO issued in May 2019 to Border Collie Bitch Craignair Lasting Legacy Reg No ZA003853B18 Microchip No 953010002172748, owned by Mrs J Pott. The owner has been liaising with Clr Carol Immelman to arrange CGC.

RJ advised that he had been informed that the owner has decided not to enter this dog at any further shows.

However, discussion indicated that, should the dog successfully pass a CGC (Bronze), then arrangements could be made for examination by three Judges, should the owner choose to avail herself of this opportunity.

No further action to be taken for the time being.

5.2.3.4 South African Bull Terrier Club (SABTC) – Championship Show 08.06.2019

TEO issued to Bull Terrier bitch Wilbod Geisha Girl, Exhibit no 20, Reg No ZA001315B19, Microchip No 991001000563171, owned by Mrs L de Bod.

Following receipt of an explanation which was tabled at Exco 06-2019, the owner was advised what action is to be taken (CGC Bronze and examination by 3 Judges), should she wish to show this dog again.

The owner was also advised that the CGC (Bronze) must be undertaken within twelve months of the issue of the TEO.

[Note – in the explanation tabled at Exco 06-2019, the owner advised that she will not be entering this bitch in any further shows.]

Noted.

It was further emphasised that should a CGC not be passed within twelve months of the issue of a TEO, then such dog will permanently excluded from entry and exhibition at KUSA Shows.

5.2.3.5 Procedure and Cover Sheet for Reporting a Case of Dog Aggression at a KUSA-Licensed Show – Schedule 3 Regulation 14 (Exco 05-2019 item 5.2.2.3, Exco 06-2019 item 5.2.2.5)

Cover Sheet to be amended as per suggestion tabled at Exco 05-2019.

All the Working Discipline Schedules are to be amended to include the wording of Schedule 3 Reg 14. The Regulation is to be included as a question in the Judges Exam on Rules and Regulations.

Note: Amendments to the various Schedules will need to be made and referred to Fedco.

NdP to look at wording of Regulation 14 with view to making provision for the imposition of a fine, should there be no report submitted to the KUSA Office.

At the June Exco Meeting, LW read out a revised procedure, which was tabled at the Fedco informal discussion.

Fedco discussion indicated that clearer guidelines for TEO CGCs need to be set.

For discussion at Fedco 12-2019.

BJ, LW and ST would be working on this within the next month.

5.2.4 OTHER CLUB / SHOW MATTERS

5.2.4.1 Praetor Rottweiler Club - Regional Sieger Show - 14-16 September 2019

The following has been received from the Chairman of the Rottweiler Breed Council (RBC):

“On 28th of June 2019 the show schedule of the Praetor Rottweiler Clubs Annual Championship show was distributed. The schedule indicated Mr. Pablo Piazza (Argentina) as the invited judge. As the RBC Chairman I asked the Club Chairperson, Mrs Letsie Fischer, to confirm whether the judge had judged at either the IFR World Show or the ADRK World Family show as per the current SCHEDULE 5E(25) required (Given that Argentina was not a accepted country). Mrs. Fischer then realized that an error had been made. Given the fact that flights, prizes, Rosettes etc. had already been purchased the club requested that we consider an exception be made in this instance. I requested a letter of motivation from Mrs. Fischer which was distributed to all clubs requesting a vote on the matter. Please find attached motivation letters received as well as official clubs’ responses/conditions where supplied. Based on the outcome of the vote, we kindly request Exco consider allowing this judge to officiate. An item will be added to the next Breed Council meeting where a new process is to be proposed for approving judges and ensuring that SCHEDULE 5E(25) is being adhered to. “

In the ensuing discussion the terms of Regulation 8 of Schedule 5E(25) were noted:

“Any Judge or Judges selected to judge this competition shall be Kennel Union Panel Rottweiler Judges, who are also Rottweiler Breed Council Specialist Grading and Critiquing Judges or, in the case of foreign Judges, qualified to grade and critique as Specialist Judges, in their own countries of permanent residence. Specialist Rottweiler Judges from a list of countries which, for the time being, is: Germany, Italy, Netherlands, Belgium, Norway, Sweden, Denmark, Switzerland, who are also approved by KUSA.

Alternatively, any Rottweiler Specialist Judge from any country where he/she has judged at the IFR World Show or the ADRK World Family Show within the last 10 years, and who is also approved by KUSA in consultation with the RBC.”

Although this Judge has been approved by KUSA, he does not meet the above requirements as Argentina is not currently on the list of countries set out in Schedule 5B(25), nor has he judged at the IFR World Show or the ADRK World Family Show within the last 10 years.

All Rottweiler Clubs have, however, agreed in writing to condone this non-compliance with the regulations, with the proviso that it is on this one occasion only.

Exco agreed that approving this request would be setting a precedent and thus its approval could not be on a “one-off” basis.

The application was approved on the understanding that any future such applications would also have to be considered on the same basis.

The above to be advised to the RBC with the recommendation that Schedule 5E(25) was reviewed and amended as it is considered to be too restrictive.

5.2.4.2 Champion Application - Membership

Eureka Cabaret - Miniature Pinscher - Reg. No. ZA002476B18 – Jointly owned by Mrs A & Mr O Kritzinger

Champion Status was applied for by the above owners, however, upon checking, the office found that Mr O Kritizinger was not a KUSA Member.

Mr Kritzinger applied & paid for membership 10 July 2019 - May the Champion Application be processed?

After discussion, in which it was noted that the Office had followed the procedure laid down by the Federal Council, it was agreed that there was still uncertainty about these new regulations and some leniency should be exercised for a period of one year.

Agreed that the Championship application should be processed.

5.2.5 KUSA Classic

5.2.5.1 2019 Gauteng – Nationals Breed, Obedience, Carting and Handling

5.3 JUDGES EDUCATION COUNCIL (JEC)

The revised KUSA Breed Judges’ Learning Programme has been implemented. Details will be included on the Fedco 06-2019 Minutes.

RJ enquired about representation at Fedco Meetings when neither the Chairman, nor the Vice-Chairman, are available. It was recommended that the Provco Constitution should be amended to provide for this and that the DOGSPC Constitution could be referred to for guidance.

8. ELECTION OF KENNEL UNION MEMBERS IN TERMS OF ARTICLE 10(1)

8.1 21 New Members and 52 Members (lapsed) were elected.

9. ANY OTHER BUSINESS

9.1 Applications for Affiliation/Closure

9.1.1 Closure – Afghan Hound Association (Exco 06-2019 item 9.1.1)

All documents and financials have now been approved and Club officially closed.

To be recorded as disaffiliated on Fedco 12-2019 agenda.

9.2 Amendments to Club Constitutions

9.2.1 Rainbow Hungarian Vizsla Club

At its AGM held 9 March 2019, various amendments to the constitution were made in order to update it in line with the latest constitution example received from KUSA. These were unanimously accepted by the members.

Paragraph 5

[OBJECTS] OBJECTIVES

The objects] objectives of the Club shall be:

Paragraph 7

[The Club shall carry on its activities in a non-profit manner, in such a way as to conform to the requirements of its tax-exempt status.]

The Club shall carry on its activities in a not-for-profit manner and shall acquaint itself with national legislation applicable to Public Benefit Organisations.

Paragraph 16 A

The management and control of the Club shall be vested in a Committee consisting of [ not less] no fewer than [six (6)] five (5 ) nor more than ten (10) [ Committee] members.

(i) from among its number elect a Chairman and Vice-Chairman who must all be Members in Good Standing of KUSA and remain so for their full term of office. Should their KUSA membership lapse during their terms of office, they shall forfeit the position of Chairman or Vice-Chairman, as the case may be, but shall be entitled to remain on the Committee as an ordinary member.

(ii) [not necessarily ] from amongst its number, appoint an Secretary and a Treasurer [ who may be one and the same person ] who must all be Members in Good Standing of KUSA and remain so for their full term of office. Should their KUSA membership lapse during their terms of office, they shall forfeit the position of Secretary or Treasurer, as the case may be, but shall be entitled to remain on the Committee as an ordinary member.

(iii) from among its number, appoint a Show Manager who must be a Member in Good Standing of KUSA and remain so for his full term of office. Should his KUSA membership lapse during his term of office, he shall forfeit the position of Show Manager, but shall be entitled to remain on the Committee as an ordinary member.

(iv) appoint all other Committee members to portfolios as may be determined by the Committee.

to determine the nature and extent of the duties of the Secretary and Treasurer ;

Paragraph 17 (b) vi

to ensure that all electronic funds transfers are authorised by at least two persons, one of whom shall be the Treasurer and the other an appointed member of the Committee who may not be the spouse, partner, close relative or member of the household of the Treasurer.

Paragraph 18 D

(i) At each Annual General Meeting [ an Auditor who may not necessarily be a member, but shall hold adequate experience to discharge his duties, shall be elected and he shall verify the assets of the Club, audit the annual accounts and balance sheets and report thereon prior to the Annual General Meeting. A signed copy of accounts or signed covering letter by the auditor must accompany the final documents. ] an Independent Financial Practitioner shall be appointed for purposes of verification of the Club’s finances and assets and for the audit of the Club’s accounts and its Statement of Financial Position (Balance Sheet). The Independent Financial Practitioner, who need not be a member of the Club, shall prepare a comprehensive and detailed report, or statement, on the financial position of the Club prior to the Annual General Meeting and such report, or statement, shall accompany the signed financial statements presented to the Annual General Meeting.

(ii) A copy of the signed financial statements presented and approved at the Annual General Meeting shall be submitted to KUSA as required by Article 8.6.2.

Paragraph 20 A iii

Annual General Meetings shall either be face-to-face, or by teleconference, or by videoconference (including Skype), or be face-to-face combined with either of the two forms of virtual attendance.

Paragraph 20 C

(i) The Committee shall meet for the despatch of business as often as[ is necessary but not less than once every two (2) months ] deemed necessary by the Committee, but at least three (3) times per annum, for the efficient management of the Club

(ii) Committee Meetings shall either be conducted face-to-face, or by teleconference, or by videoconference (including Skype), or be conducted face-to-face combined with either of the two firms of virtual attendance.

Paragraph 22

At Committee meetings each Committee member shall have one (1) vote. Matters before the Committee shall be decided upon by a simple majority of the votes.[ Committee members may take part in a meeting by electronic means e.g. a voice / video call.]

Voting by proxy shall not be permissible at any meeting of the Club.

Current procedure and conditions for acceptance and processing of Breeders’ Advertisement applications.

See email and attachments (sent to Fedco for response by 31.07.2019) circulated 18.07.2019.

NdP advised that a clause needed to be included to the effect that we have the right of refusal or immediate removal of an advertisement without giving notification. Notification can be given afterwards.

Brief discussion ensued on whether the format and layout of the advertisements on the website should be reviewed and how much income they generated. It was also suggested that the heading should be changed to “KUSA Members’ Advertisements”.

To be carried forward to next agenda.

9.7 WODAC 2019

PM gave a brief verbal report.

10. GENERAL

10.1 Colours of Ancestry of Dogs recorded on Registration Certificates

It was confirmed and noted at Fedco 06-2019 that the inclusion of the coat colours of the ancestry has been the norm since Jan/Feb 2019.

10.2 KUSA Showdog of the Year

LW reported that the presentations for the above will take place at the Championship Show of Goldfields Kennel Club (GKC) on 24 (or 25) August 2019. It needs to be established if there is to be a Eukanuba World Challenge award show in 2020 and, if so, where and when.
