THE KENNEL UNION OF SOUTHERN AFRICA MINUTES OF A MEETING OF THE EXECUTIVE COMMITTEE OF KUSA TO BE HELD AT 13H00 ON TUESDAY 18TH SEPTEMBER 2018 BY TELECONFERENCE

1. ATTENDANCE, APOLOGIES & ANNOUNCEMENTS

2. MINUTES

The Minutes of the meeting held on 21st August were formally adopted.

3. ANY MATTERS ARISING FROM PREVIOUS MINUTES

3.1 Articles and Schedules – Harmonisation and Rectification of contradictions ( Exco 11-17 item 3.3, Exco 01-18 item 3.3, Exco 02-2018 item 3.3, Exco 04-2018 item 3.3, Exco 05-2017 item 3.2), Exco 7- 2018 item 3.1, Exco 08-2018 items 3.1, 3.4, 3.5)

Exco is mandated to consider, investigate and propose changes to the Articles and Schedules in order to rectify contradictions. Exco has, for instance, identified Schedule 3 Regulations 31, 33 and 38 as requisite of alignment with Regulation 37 and for harmonisations with the content of Schedule 1.

3.2 Breed Assessments – Appeal Process (Exco 03-2018 item 9.8, Exco 04-2018 item 3.6, Exco 05-2018 item 3.3, Exco 07-2018 item 3.2. Exco 08-2018 item 3.2))

3.3 Terrier Club Eastern Cape (Exco 07-2018 item 5.2.4, Exco 08-2018 item 3.10)

At Exco 08-2018 it was recommended that Treasurers or any persons with financial signing powers should be members of KUSA.

To be carried forward to Fedco 12-2018 agenda.

3.4 SALKA Junior Dog of the Year – Schedule 5E(1) (Exco 07-2018 item 9.6)

References to Zimbabwe to be removed.

3.5 Dobermann Club of KZN – Query Best Puppy Challenge at Ch Shows (Exco 08-2018 item 5.2.3.1)

Deferred from August Meeting pending clarification of Regulation 24.3 of Schedule 3:

“At every Championship Show where dogs of one breed only are scheduled, the exhibits eligible to compete free of entry fees for Best in Show are Challenge Certificate winners and unbeaten prize

winners in any restricted class as defined in Appendix 1 of this Schedule, and the exhibits eligible to compete free of entry fees for Best Puppy in Show are all the Minor Puppy and Puppy class winners.”

It needs to be clarified if it is compulsory to hold the BBPIS Challenge if the Baby Puppy class is scheduled, and if a BBPIS certificate awarded in 2014 needs to be withdrawn.

Discussion ensued and the opinion was expressed that the KUSA Certificates that are on offer need to be awarded and should be printed and handed over to the exhibitors. As with the decision made about RCC awards, Clubs may state on their Schedules that they will be printed on request.

LW and AB to liaise with regard to an appropriately worded letter to the Club.

3.6 Ridgeless Ridgebacks (Exco 08-2018 item 9.8)

Correspondence received indicates that a proposal has been made to the FCI to classify the Ridgeless dog as a variety of the Rhodesian Ridgeback.

ZKC to be advised that KUSA was not in agreement with this and will keep them informed . In the meantime, information on dermoid sinus in the Ridgeback and other breeds is being collated.

3.7 Elbow Dysplasia - Right elbow not evaluated due to trauma and surgery (Exco 08-2018 item 9.7)

At the August Meeting Exco agreed that the above matter be referred to the RBC. The RBC has responded as follows:

The dog must have a right elbow grading even if it is the worst possible grading. RBC further advised that the owner should go back to the vet who did the original HD and ED grading so that no additional cost is incurred by the owner.

A revised International Hip/Elbow Dysplasia Certificate has now been received for the right elbow.

Noted – this matter was now finalised.

3.8 Deceased Estate – Mr Adrian Austen (Exco 06-2018 item 4.8, Exco 07-2018 item 3.7, Exco 08-2018 item 3.7 and 9.3)

A list of outstanding litters has been submitted to the Office and applications received are being processed. The Exco had previously, in a ‘round robin’ communiqué, agreed that the litters could be registered at a reduced rate but, subsequently, realised that it did not have the authority to reduce fees.

3.9 Schedule 3 Regulation 33 - Fines and Penalties (Exco 07-2018 item 3.1)

It was confirmed that the decision by Fedco to a cap of R10000 on all fines imposed by Exco did not require an amendment to Schedule 3 or Schedule 1.

4. KUSA OFFICE

4.1 Office Report

The Office report was discussed and approved.

4.2 FINANCE

The Financial Management Report for August 2018 was discussed and approved.

5. SUB-COMMITTEES

5.1 DISCIPLINARY SUB-COMMITTEE

5.1.1 Case 01-2018 KUSA vs Mr DK Riley

The Disciplinary Sub-Committee (DSC) met on 31.07.2018 by teleconference and carefully considered all the evidence submitted. The DSC unanimously found the Respondent guilty ito 4.1.1 and 4.1.1.2 of Schedule 1 with regard to the Respondent wilfully posting on social media Facebook (FB) comments on more than one occasion which are defamatory, prejudicial and/or injurious in nature to two KUSA Judges, who were acting in their official capacities as KUSA Judges at the Port Elizabeth Show weekend on 07/08 April 2018.

Although the above mentioned Judges’ names are not per se mentioned in the social media FB posting by the Respondent, it is clear that when read together with all supporting documents and surrounding circumstances and evidence, that the Judges referred to in the said social media FB postings as the “last two” are the two Judges identified, who are described as, inter alia, “idiots” and “crooked”, amongst other defamatory remarks.

It is noted from the Respondent’s replying affidavit that he claims the complaint is out of time and that the Secretary did not act according to the Rules of Schedule 1. In terms of the provisions of Rules 1.13, 1.13.1 and 1.16 of Schedule 1, the DSC condoned the Secretary’s actions and dismissed the in limine points raised by the Respondent.

The DSC imposed the following penalties which are effective for 6 (six) months from 01.09.2018 to 29.02.2019

Rule 11.1.2:

Suspension or exclusion from taking part in, or having any connection with, or attending or participating or handling a dog at a Show, Obedience Class, Working Trial or Field Trial or other event held under KUSA licence, or from acting as an officer of a Club;

Rule 11.1.3:

Disqualification from exhibition or competition or evaluation of a dog owned by him or registered or recorded in his name, or jointly with another or others, or in the name of a nominee;

Rule 11.1.5:

Disqualification from judging at, or taking part in the management of a Show, Obedience Class, Working Trial or Field Trial or other event held under a KUSA licence;

NOTE:

An Appeal was considered by the Fedco Appeals Committee (FAC) but was dismissed.

It was noted that the above (Mr Riley) was organising an event called “Fair Play” on 1&2 December 2018 at which the DOGSPC Best of the Best was going to be held. However, this has since been renamed as “Fair Play’s Simply the Best” with further rule changes and will not be held under a KUSA licence. The Judges are to be informed that this is not a KUSA-licensed event.

5.2 SHOWS

5.2.1 Applications for Second Championship Shows

5.2.1.1 Western Gauteng Kennel Club - 19 April 2019 - Breed, Handler Classes

The above Club is requesting to host a 2nd Championship Show as above. (Motivation attached to agenda.)

Affiliation/AGM & signed Audited Financials/documents and fees are all up to date. WGKC holds a Breed Non-Championship Show each year.

5.2.1.2 George Kennel Club - Friday 14th June 2019 & Outeniqua Kennel Club - Monday 17th June 2019

Affiliation/AGM & signed Audited Financials/documents and fees are all up to date. This Club does not plan to hold a Non-Championship Show.

After lengthy discussion with regard to holding an event such as a breed seminar to support the education of Judges, the request was approved.

[Note: Fedco 12-2017 ruling with regard to the criteria being applied more leniently in non-populous areas.]

5.1.2.3 Second Championship Shows – proposal

DS proposed that All-Breeds Clubs should only be allowed to hold a 2 nd show every second year. After discussion, LW requested written comments from all Exco Members in order to deliberate at the informal Fedco discussion in December.

5.2.2 Schedule 3 Reg 14 – Exclusion of Dogs & Reg 19.8

5.2.2.1. Temporary Exclusion Order - Apollo Prince of Stjephanic House of Torbrit Reg No ZA001028C16(Exco 07-2018 item 5.2.2.1.2, Exco 08-2018 item 5.2.2.1)

Arrangements were made for the above dog to be examined by two Working Group Judges on 15.09.2018, with the result being that the dog failed one of the assessments.

After discussion it was agreed that the owner be advised that as Apollo did not pass all of his assessments, the Temporary Exclusion Order will remain in place. It is recommended that Apollo goes ` for further training for at least six months and obtains a certificate from an established dog training organisation. Such organisation does not necessarily have to be a KUSA-affiliated Club.

On production of the certificate from the training organisation, Exco will decide how to proceed.

5.2.2.2 Temporary Exclusion Order - Rottweiler Vombladysnee Ava Reg No ZA007137B16 in place.

5.2.3 OTHER CLUB / SHOW MATTERS

5.2.4 KUSA Classic

5.2.4.1 Free State & N Cape – Breed 2&3 June 2018, Working Disciplines 09-12 August 2018

Finances to be finalised.

There were still some calculations to be done regarding what payment is due to Kimberley Kennel Club. As previously mentioned, Breed and Working Disciplines should in future be held on the same weekend at the same venue in order to avoid financial losses. Only the Agility Nationals will be held separately. Exco noted with regret the complaints regarding this year’s National Working Disciplines. Medals and rosettes have since been distributed to the owners of awarded dogs.

5.2.4.2 KUSA National Retriever Champion Stake – 25/26 August 2018

Report and results from the above are awaited.

5.2.4.3. 2019 – Gauteng 31 May to 2 June 2019

August 2018 Report attached to agenda. Noted that the National Agility and Dog Jumping will be held with the NAPC Bumper weekend in Gauteng while Breed and all other Working Disciplines will be held together on the above weekend.

5.2.3.4 Gauteng 2020 25/26 April - Dj,Ag,Fly (NAPC Bumper Weekend) & Br, Hcl,Ob,Ca - 29-31 May 2020

5.3 JUDGES EDUCATION COUNCIL (JEC)

5.3.1 The JEC Administrator will be in the KUSA Office in October between the Cape Shows to work with the KUSA Judges’ Department on the conversions and the updating of judges' qualifications as a result of the various amendments to the KUSA Breed Judges’ Learning Programme approved at Fedco 06-2018.

5.4 JUDGES – BREED

5.4.1 The following Judges completed KUSA requirements and are licensed for the Group/s as listed:

5.5 HANDLERS

5.5.1 Schedule 5E(12) Regulations for Handler of the Year Competition

The Handler Competition used to be hosted on the same day - elimination rounds and finals - however, over the last few years, the elimination rounds have been held on one day and the finals on another day. This affects the eligibility age on entry.

Currently Regulation 3 states:

3.1 Eligibility for Competition

3.2 National Junior Handler Class

For persons of eleven (11), but under eighteen (18) years of age. Only open to Handlers whose eighteenth (18th) birthday does not fall on the day upon which this Competition is held.

Suggested amendment:

For persons of eleven (11), but under eighteen (18) years of age. Only open to Handlers whose eighteenth (18th) birthday does not fall on any of the days upon which and stage of this Competition is held.

(This means that if you are going to turn eighteen on either the Prelims day or the Finals day, you are precluded from competing, which was probably the intention of the original Regulation.) For recommendation to Fedco.

5.6 OBEDIENCE - nil

5.7 WORKING TRIALS (CLASSIC) & WORKING UTILITY DOG (WUD) - nil

5.8 FIELD TRIALS

The FTLC has recommended amendments to the Field Trial Judges Contract as it is felt that quite a few of the Terms and Conditions do not apply to their Discipline & Judges.

In the ensuing discussion it was queried why the paragraphs relating to Judges’ fitness had been removed as well as the area for Judges’ expenses.

6.1 FBCSA – BC

6.2 Rottweiler Breed Council (RBC)

In the light of the number of incidents reported in terms of Schedule 3 Regulation 14 (Exclusion of Dogs), when Rottweilers are being judged, it was considered appropriate that the RBC should hold a handling seminar for Judges. It was suggested that this can take place when the RBC is visiting the various centres around the country. Discussion ensued on whether Non-Specialist Judges were inclined to touch Rottweilers unnecessarily.

6.3 German Shepherd Dog Liaison Council

AGM teleconference scheduled for 09.10.2018.

8. ELECTION OF KENNEL UNION MEMBERS IN TERMS OF ARTICLE 10(1)

8.1 28 new members and 34 lapsed members were elected.

9. ANY OTHER BUSINESS

9.1 Affiliation

It was reported that the new Specimen Club Constitution has been finalised, published on the KUSA website and forwarded to Provco Secretaries and should be used by Clubs when making amendments to their Club Constitutions.

9.1.1 IPO Club of KZN

At an SGM held 27 March 2018 the members present resolved to close the Club. All Club assets were handed to Natal Rottweiler Association as they were the remaining Club hosting IPO in KZN.

9.1.2 IPO Club of Northern Areas

NAPC Meeting July 2018 - Club needs to go through the correct disaffiliation process. Awaiting confirmation and minutes from the Club.

9.1.3 The following Clubs have advised via email they no longer wish to be affiliated to KUSA:

Vanderbijlpark Dog Training Club (Gau)

Verein für Deutsche Schaferhunde (S.V.) Namibia

Noted with the comment that it needs to be ensured that these Clubs follow their Constitutions with regard to the dissolution of their Clubs.

9.1.4 KZN Toy and Utility Groups Club - Merged Club from the Natal Utility & Natal Toy Group Clubs

At a KZN Provincial Council Meeting held 6th February 2018, a letter from the above Clubs was read and it was agreed to accept the merging of the two Clubs. The Club was requested to follow the procedures as per their Constitution.

An SGM was held 15 April 2018, with members of the Natal Utility and Natal Toy Dog Clubs, where it was confirmed that the two Group Clubs merge. The revised Constitution has been forwarded to KUSA for approval.

Subject to some corrections (grammatical, typing errors), the Constitution is the same as the KUSA Specimen Club Constitution.

We have suggested adding:

Clause 7 - Trading and Income

"The Club shall carry on its activities in a non-profit manner, in such a way as to confirm to the requirements of its tax-exempt status" (if they have applied for tax exemption already)

Clause 11 - Application for Membership

To add "The Committee shall have complete and absolute discretion to accept, refuse or defer any application for membership provided that a written explanation is forwarded to the applicant in terms of the promotion of Access to Information Act (PAIA) if such an explanation is requested".

Both Clubs were Championship Show holding Clubs. Permission is requested for the newly merged Club to continue holding Championship Shows.

Noted that the newly merged Club will adopt the new Specimen Club Constitution and it was agreed it would continue to hold Championship Shows.

9.1.5 Requests received and in process:

Heritage Bull Terrier Club (Boland area) - New Club (Pending WCPC Minutes)

Highveld Ridge Bull Terrier Club to convert to Northern Areas Terrier Club - (Pending NAPC Minutes)

9.1.6 Centenary Terrier Club

It was previously reported that this Club wished to migrate from the Free State Provco area to DOGSPC. The principle of Clubs’ migration was discussed at Fedco 06-2018 and, whilst reservations were expressed, the Fedco’s decision was that the matter be referred back to Exco to re-examine the desirability of a Club migrating to a different Province.

It was noted that a new Committee had been formed comprising people from the Gauteng area and this year’s Championship Show will be held in Sasolburg.

It was explained that this Club was not viable in the Free State due to a lack of local individuals willing to serve on the Committee as well as the lack of exhibits from the traditional area of operation with the majority of dogs shown originating from Gauteng. After further discussion, which included the impracticalities of closing the Club down and re-opening it in Gauteng, Exco supported the request and agreed that the Club should make application (to Exco) to amend its Constitution.

Delete struck through words in [ square brackets ] and insert words underlined:

In [a n Obedience and Trial Dogs a Canine Record dogs of any ancestry. Dogs on this record are not eligible to compete in any Breed (Conformation/Beauty) Show, Field Trial or IPO Annual Event (Meisterschaft) held under a Kennel Union Licence.

Motivation:

“Change of name to modernise, and new marketing ideas for KUSA. This will then cover any dog that cannot be registered on the Appendix Registers. As it is only a Record of the Dog it is not contra to FCI either. We can then capture a corner of the market that the other SA “Registries” have had. For people doing the disciplines such as Agility and Dog Dancing, their dogs are not on an Obedience Register.

This has caused confusion in the past as they say ‘but I am not going to do Obedience or Working Trials’.”

After discussion the above was approved for recommendation to the Federal Council.

10. GENERAL

10.1 LW asked members to consider suitable dates for the next Exco ‘face-to-face’ meeting to be held during 2019. Suggested dates are to be circulated amongst Exco members.

10.2 RZ referred to the licensing of events as required by local government. Comment on this will come through on the next WCPC Minutes.
